Islam allows 4 wives
without ‘talaq’, observes SC; it issues notice to Centre plea seeking ban on
triple talaq
New Delhi: The Supreme
Court on Friday observed that if Islam allowed a man 4 wives, then the husband
can marry a 2nd time even without ‘talaq’.Making this oral
observation, Chief Justice TS Thakur -- heading a 3-judge Bench -- indicated
that prima facie there was nothing wrong in a Muslim man having 4 wives without
divorcing the first wife. The Bench, which also included Justice AM Kanwilkar
and DY Chandrachud said unless and until the constitutionality of the ‘triple
talaq’, permitted under the Muslim personal law, is struck down by court, a man
can divorce his wife by pronouncing the phrase thrice. The CJI told V K Biju,
counsel for petitioner Ishrat Jahan of Howrah, “We have seen that you have
challenged the constitutionality of the ‘triple talaq’. But until it is
determined, he (husband) is entitled to have four wives. Even without ‘talaq’,
he can marry again.”When counsel complained that her husband had taken away her
4 children and that they should be secured as the police had failed to register
an FIR, the CJI asked the petitioner to file a habeas corpus petition in the
Calcutta High Court. The Bench, however, issued notice on her petition
challenging ‘triple talaq’ and directed this petition be tagged with similar
petitions in which the response of the Centre and the All India Muslim Personal
Law Board had already been sought. Deccan Chronicle

‘unlawful’; to slap terror charges on Zakir Naik: financialexpress
As per sources in the govt,
Home Ministry along with some legal advice has decided to book Naik under the
UAPA for his speeches. The popular Islamic missionary is accused for motivating
the terrorists behind the Dhaka restaurant attack in July this year.“The
primary ground for invoking terror charges against Naik are statements by those
involved in past terror acts, conceding that they were motivated by his
speeches,” said an intelligence officer.Authorities have also decided to impose
the UAPA on IRF on the grounds that it is spreading hatred between religious
communities. Under the UAPA, an ‘unlawful’ organization is different from a
‘terrorist’ association. The law, while defining an “unlawful association”,
covers any organisation “which has for its object any activity that is punishable
under Section 153A or 153B of IPC” – provisions dealing with threat to social
and communal harmony.Once IRF is declared ‘unlawful’, it might face closure of
its offices across the country. Currently, IRF has its head office in Mumbai,
runs the Islamic International School in Mumbai and Chennai and own many
properties in Mumbai itself. IF a ban is imposed, Maharashtra govt might also
take charge of the Islamic International School or entrust its management to
another organization. Financialexpress

several decades back on Kashmir dispute but now it is not fulfilling its

broken pledges and ruthless oppression,” Sharif claimed. He emphasised that this
anniversary of the UN ought to be a catalyst, spurring the world body into

To bring peace in Valley,
govt corners separatists
Srinagar: Authorities
detained 2 top separatists, Syed Ali Shah Geelani and Mirwaiz Umer Farooq,
under various sections of the Unlawful Activities Act, as the situation
continued to remain grim in the valley following the death of another youth in
Pulwama on Friday, taking the toll in the recent unrest in the state to 69.JKLF
chief Yasin Malik, who was arrested on July 9, will be flown to New Delhi on
Saturday, ostensibly for a check-up at AIIMS.The 3 Hurriyat men had constituted
a group, 'joint resistance force', in June to spearhead the agitation against
the "proposed establishment of Sainik colony, a separate cluster for
Kashmiri Pandits, and industrial policies that allow non-locals to get lease of
land for 90 years in the state". Police sources said Hurriyat hardliner
Geelani was detained at his Hyderpora residence and barred from meeting
anybody. Mirwaiz, the head of the moderate Hurriyat faction, was lodged in a
J&K tourism development hut at the Chesmashahi tourist resort. Shakeel
Ahmad Ganai, the youth killed in Pulwama on Friday , was hit when the security
forces acted to foil the 'eidgah chalo' call by imposing strict curfew in
Rajpora area. Scores of people were injured as clashes erupted after the Friday
prayers across the valley .As the Centre looks for ways to restore normalcy in
J&K, possible replacement of governor NN Vohra is one of the several steps
under consideration. Sources in the govt told TOI on Friday that some probable
candidates have already been identified, though the final decision is yet to be
taken. Vohra, a veteran who served as Union home secretary, principal secretary
to ex-PM IK Gujral and also as Centre's interlocutor on J&K, brought rich
experience to the office of governor. However, after the prolonged unrest in
the valley, there is a growing feeling that Vohra does not have the reflexes
any longer to deal with a situation that poses an altogether different
challenge with the jihadi elements having taken over. timesofindia

with protesters in the state."There will be talks with all stakeholders in
J&K . There needs to be an institution for it which should include people
whom the residents of the state trust," she said. "Problems we are
facing today are because the steps that PM (Atal Bihari) Vajpayee took - which included a
dialogue with Hurriyat - were stopped," she said.Around 70 people have

Meeting Rajnath cost me
credibility built over 3 decades: Zafar-ul-Islam Khan
Srinagar: Zafar-ul-Islam, a
prominent Muslim journalist and intellectual, said on Thursday that he lost his
credibility by attending the meeting with Indian home minister Rajnath Singh
that was called in the wake of the raging uprising in Kashmir. Zafar-ul-Islam“It
was clear during our interaction with the HM that he is not ready for any
confidence-building measures as of now… No talk of lifting AFPSA from
unaffected areas like north Kashmir and moving the army away from inhabited
areas… Instead more troops are being airlifted to the Valley. No readiness to
talk to Hurriyat or Pakistan for a final solution of this festering wound.
Hence, personally I do not see any usefulness of visiting Kashmir. In any case,
it should be an independent initiative, not one sponsored and paid for by the
home ministry. By accepting such help, we lose credibility. Personally, I have
over night lost my credibility in the Valley which was built over three
decades,” Khan wrote in Milli Gazette. kashmir reader

notification on facilities extended to persecuted minorities from neighbouring
countries, as well as allowing them more “political” space in India. In the next

Will help Haji Ali fight

Delhi:After women were
allowed entry into the inner sanctum of the Haji Ali dargah in Mumbai, a kin of
the family of priests at Sabarimala temple in Kerala has promised support for
the plea of the Haji Ali Trust in Supreme Court. Bombay High Court, in a
landmark ruling on Friday, allowed entry of women into the inner sanctum of the
centuries-old shrine in Mumbai. Haji Ali Trust, which manages the dargah, said
it will appeal to the Supreme Court against the High Court order.“Sabarimala
Devotees will help #HajiAli to fight the case in Supreme Court,” tweeted Rahul
Easwar, an activist who belongs to the family of priests at Sabarimala temple.
The shrine dedicated to Lord Ayyappa atop a hill in Kerala does not allow the
entry of women of menstrual age.Temple management has tied the rule to
essential religious practices and traditions, along with the belief that the
presiding deity, Lord Ayyappa, is a ‘perennial celibate’ (Naishtika
Brahmachari). Easwar argued on Twitter saying freedom of faith should not be
interfered ‘beyond a Lakshman Rekha.’ The activist, who appears on television
panels supporting the Sabarimala management’s decision to disallow entry of
women of menstrual age, claimed the movement is a ‘clever script’ and a ‘game

Sharia Law, peoples’

Mumbai: High Court order
lifting ban preventing women from entering Mumbai’s iconic Haji Ali mausoleum

riot-displaced people of neighbouring Muzaffarnagar district make it to the

riot-displaced people live. "I think, this was only done out of

consequences."And hardly a week passes without a television pundit or a
