Central govt's change of
stand on minority status is political motivated: AMU to SC; files reply on
govt’s affidavit
New Delhi: Aligarh Muslim
University has described as "politically inspired" Modi govt's
decision to withdraw the 2006 appeal challenging the Allahabad High Court
verdict that the university was not a minority institution. The appeal was filed
by the then UPA govt against the 2006
High Court order that struck down an 1981 amendment to the AMU Act, 1920, which
said the institution was established by the Muslims and thereby permitting 50% reservation for the community in the
university. The said amendment had sought to erase a 1967 judgement by a
Constitution Bench of the apex court in the Azeez Basha case, wherein it had
said that AMU was not a minority institution. AMU's latest contention was made
in an affidavit filed last week in the top court, which was made available on
Tuesday. The university assailed the Centre's June 30 affidavit, whereby it
conveyed to the top court its decision to withdraw its 2006 appeal against the
High Court verdict. AMU affidavit said: "The decision taken after a change
of govt at the Centre by the present NDA govt led by a member of the BJP does
not appear to be a sound decision based on cogent and valid reasons, but one
based on political considerations."It said: "It is well settled that
a decision taken at the govt al level will not be nullified by a change of govt
after another political party assumes power, particularly when such a decision
affects the interest of the nation as a whole."AMU referred to earlier SC
judgements in support of its contention. On the BJP-led NDA govt's U-turn on
the 2006 decision of its predecessor, AMU said:"In any event, this is
nothing but a deliberate dereliction of constitutional duty on the part of the
union govt."IANS

Divorced Muslim woman also
entitled to maintenance till she gets remarried: Bombay HC
http://www.livelaw.in/divorced-muslim-woman-also-entitled-maintenance-till-gets-remarried-bombay-hc/
After a long wait of 27
years hoping to get maintenance from her husband who had divorced her, a Muslim
lady in Maharashtra, got relief from Bombay High Court when it held that that
even if the parties are governed by Mohammedan Law and provisions of Muslim
Women (Protection of Rights on Divorce) Act, 1986 are applicable, still the
maintenance is not required to be confined only to iddat period but till said
lady gets remarried. (Rehana Sultana Begum vs. Hashmi Syed Mujib) Justice N.W.
Sambre referred to observations by Apex Court in Danial Latifi and another vs.
Union of India (2001) 7 SCC 740, 2) wherein it was held that liability of
Muslim husband to his divorced wife arising under Section 3(1)(a) of the Act to
pay maintenance is not confined to iddat period. The lady had approached High
Court against the Magistrate order dismissing her application under section 125
CrPC for future maintenance on the ground that, the parties to the proceedings
are Muslims by religion and as such, in view of provisions of Muslim Women Act,
1986 she is not entitled to maintenance beyond Iddat period. The Court held
that the lady is entitled for maintenance of Rs.1000/- per month from the date
of filing of the application i.e. 22/09/1989. The Court, taking into account of
the pendency of her application for more than two decades, granted liberty to
move the appropriate Court for modification i.e. enhancement under Section 127

Charged with sedition for 'pro-Kashmir
azadi' slogans Amnesty International says employees not behind slogans
Bengaluru: Amnesty
International's India chapter on Tuesday said none of its employee had shouted
any anti-India slogan at an event on Kashmir in Bengaluru, allegations based on
which sedition charges were slapped against the human rights body. Amensty
India said allegations mentioned in a complaint by an ABVP representative
against it were "without substance" and that only discussion at the
event on Saturday was about allegations of human rights violations and denial
of justice in J&K."No Amnesty International India employee shouted any
slogans at any point," the human rights organisation said in a statement
referring to allegations that "slogans were raised that Indian Kashmir
should be part of Pakistan."To charges that the event indirectly supported
terrorists, Amnesty said the only discussion that had taken place was about allegations
of human rights violations and the denial of justice to families in
Kashmir."These are issues that have regularly been discussed in the media.
They have been written about at length by members of Parliament, politicians,
judges and civil society,"it said. The event was held as part of a
campaign based on the report "Denied: Failures in accountability for human
rights violations by security force personnel in J&K ", published in
July 2015, it said.Amnesty said the report was based on in-depth research in J&K,
including interviews with family members of "victims", RTI
applications, examination of police and court records, and interviews with
civil society groups, lawyers, and govt officials. The families of three Kashmiri
victims that were interviewed for the report were invited to share their
stories at the event, said Amnesty."Towards the end of the event, some of
those who attended raised slogans, some of which referred to calls for 'Azaadi'
(freedom). Amnesty India as a matter of policy does not take any position in
favour of or against demands for self-determination."However, Amnesty considers
that the right to freedom of expression includes the right to peacefully
advocate political solutions. Amnesty International India had invited the
Bengaluru police to be present at the event in the interest of the security of
the invited families and other attendees," the statement said.TOI

Beijing unlikely to take
sides between India, Pak: Chinese State Media
Beijing: China is "unlikely" to give up on USD
46 billion China-Pakistan Economic Corridor being built through
Pakistan-occupied Kashmir despite India's protests, but it may not be
interested in taking sides in the Kashmir dispute due to close economic ties
with both nations, state-run media said today."It is regrettable to see
CPEC become another inharmonious factor in Sino-India ties, but China is
unlikely to give up on the idea of CPEC because of India's protest," an
article in Global Times said."In fact, the economic corridor, linking
northwest China's Xinjiang Uyghur Autonomous Region to Gwadar Port in
southwestern Pakistan, does not target any third party, India included. Given
that China has developed close economic ties with both India and Pakistan in
recent years, Beijing is unlikely to be interested in taking a side between the
two countries," it said. Significantly, the article uses the term 'PoK'
twice even though at one place it makes the mention attributing it to Indian
media reports."External Affairs Minister Sushma Swaraj voiced India's
concerns over the China-Pakistan Economic Corridor (CPEC), which passes through
PoK, during Chinese Foreign Minister Wang Yi's India trip, Indian media
reported," the article said."It is precisely because of the region's
worsening investment environment that PoK's economy is still heavily reliant on
agriculture. Also, the northern part of India bordering Pakistan" both
lack basic infrastructure, the article stated. Chinese media usually refers to
PoK as 'Pak-administered Kashmir'. Another state-run news outlet, People's
Daily which published photos of Chinese and Pakistani troops patrolling
together for the first time in Pakistan-occupied Kashmir last month referred to
the area as China-Pak border.PTI

Must speak in one voice
about Balochistan, POK: Union Minister Venkaiah Naidu
New Delhi:Appealing to
parties, including Congress, to speak with one voice on the issues of
Balochistan and POK, Union Minister Venkaiah Naidu today said all should avoid
making any statement which hurts India’s interests. Naidu’s remarks came in
response to a question on Congress Leader Salman Khurshid’s statement in which
he attacked the PM for raking up the
issue of Balochistan in his Independence Day address.“As far as international
issues are concerned India should speak with one voice. But unfortunately
Congress party is not speaking with one voice within the party also. There is a
statement from Salman Khurshid, there is a statement by Kapil Sibal, subsequently
a statement given by Congress spokesperson Randeep Surjewala. I only appeal to
the main opposition party please bear with the country. Try to understand the
implications. We must all speak with one voice. Our neighbor is aiding,
habitating (sic) and funding terrorism in the country continuously. It can’t go
on like this,” Naidu said at the sidelines of an event here.“I appeal to all
domestic parties do not make any such statements which hurts India,” he added.
Khurshid had yesterday accused Modi of “ruining” India’s case on PoK by raking
up the issue of Balochistan in his Independence Day address. But later Congress
distanced itself from the remarks and asked the govt to raise the issue of “atrocities in
Balochistan and PoK” in bilaterals with Pakistan as also at international
forums. Taking a strong note of Pakistan’s position on Kashmir, Naidu said that
Kashmir is integral part of India.PTI
CPI (M) slams PM for
Balochistan reference
Hyderabad:CPI (Marxit) on
Tuesday hit out at PM Narendra Modi for referring to “human rights violations”
in Balochistan and Gilgit during his Independence Day speech, saying it would
give Pakistan an opportunity to “internationalise” the Kashmir issue. Party general
secretary Sitaram Yechury said the Kashmir issue cannot be treated as a mere
law and order problem and needs political solution.“Yesterday, in his speech,
the PM spoke about human rights
violations in Balochistan and Gilgit. We have been saying that Kashmir is an
integral part of India. Nobody has the right to interfere in its affairs. But
now we have started talking about Balochistan.“We are giving an opportunity to
Pakistan by raising the Balochistan issue. Now Pakistan may say that since
India is taking about Balochistan, which is an integral part of that country,
they have the right to talk about Kashmir. With this kind of foreign policy, we
are giving an opportunity to others to internationalise the Kashmir issue,” Mr.
Yechuri said.PTI
PM Modi’s Balochistan
reference unnecessary: Kapil Sibal
New Delhi:Terming PM Narendra Modi’s reference of Balochistan in
his speech “unnecessary”, former law minister and Congress leader Kapil Sibal
on Monday said instead of addressing issues concerning the nation, he spoke on
“vague matters”. Asserting that it was not a well-thought statement, Sibal said
the way PM spoke about other country
from the rampart of Red Fort is a matter of concern.“Prime Minster should have
applied his mind and addressed the nation, but the real issues were absent in PM’s
address. Instead we had some reference to Balochistan and I don’t know who advised
him to raise that issue from the ramparts of the Red fort,” said Sibal. “I
don’t think it was a well-thought out statement on Balochistan. And, there will
be a fall out of this statement by the PM from Red Fort. No PM in the history
of India has talked about some other country in this fashion. So, I am a little
concerned about the manner in which this statement was made,” he added.ANI

Fresh Violence Erupts
Against Dalits In Gujarat After Protest Rally In Una
On the day PM Modi urged
the nation to exercise greater tolerance towards Dalits in his Independence Day
speech, fresh violence against lower-caste communities erupted in Una, Gujarat.
According to NDTV, Balubhai Sarvaiya, one of the four youths who were brutally
beaten up in Una after being wrongly accused of killing and skinning a cow,
needed eight policemen to escort him back to his village. He was among the
10,000 others who had gathered on a school ground to protest against the atrocities
against Dalits in Gujarat yesterday. The assembled people promised not to
remove dead cows or work at menial jobs that were badly paid, which have been
their lot since generations. After the rally ended around 5 pm, clashes broke
out near Samter village, where many of the Dalits, riding motorcycles, were
attacked by the upper castes. Samter is home to the 30 people who were arrested

Chennai: PMK founder S

the position that Dalit youth were ‘enticing’ girls belonging to other communities
in the guise of love and later deserting them, said, “In Erode district, 200
Muslim women have been kidnapped. The Imam had expressed this to me… Every
community – Brahmins, Reddys, Vanniars – has been affected. Dalits are being

the encounter of gangster Mohammed Nayeemuddin could be linked to Sohrabuddin

Lucknow: Taking part in
debates on TV by Muslim clerics is un-Islamic and should be avoided, according
to a fatwa issued by a prominent Bareilly-based Islamic seminary. The fatwa,
issued by the Markazi Darul Ifta of the Dargah Ala Hazrat at Bareilly, said
that the Shariat does not permit watching TV or video. “If watching TV and
video is barred, then naturally taking part in debates is also not permitted”,
said Mufti Mohammed Nazim Ali Quadri, a cleric at the seminary. The fatwa was
issued in response to a query by a resident of Shahabad town in the state. He
had sought to know if it was appropriate for Muslim clerics to participate in
TV debates, especially on those concerning religious issues.Quadri also
referred to a book authored by a well-known Islamic scholar to buttress his
contention. Another senior cleric at the Dargah, Mufti Ghulam Mustafa Noori,
also echoed similar sentiments and said that Muslim clerics and religious
leaders should avoid taking part in such debates. deccan herald

Those who stop using
savings Bank accounts to avoid interest may be IS-leaning youths: intl.agencies
latest clue
Mumbai: Agencies
investigating terror cases have come across a new trait among youths inclined
towards the IS. Youths have stopped using savings accounts in banks and instead
are operating current accounts. Reason: they do not want interest on money
lying in banks. This characteristic came to their attention while they were
probing recent cases involving IS sympathisers, including those who have left
the country to join the IS."Police have come across at least 3 such
savings accounts which the holder stopped using to begin financial transactions
through current accounts," said a police source. A current account is
mostly used by businesses for transactions, but it does not earn any returns.
According to sources in intelligence agencies, this new information on IS
sympathisers may yield leads in future if they start scanning more bank
accounts. Sharia prohibits acceptance of interest. However, what many orthodox
Muslims with bank accounts do is they give away interest earned from an account
to charities. Since it is regarded by sections to be un-Islamic, many Muslims
don't even take loans from banks. Shifting from a savings account to a current
format is a relatively unknown trend. Police sources said in the light of the
recent findings, they may consider looking at bank accounts of potential
suspects.TOI
