New Delhi: The Supreme Court today granted 4 weeks time
to the Centre to file its reply on a batch of petitions on triple talaq and the
plight of Muslim women.A bench comprising Chief Justice TS Thakur and Justice
DY Chandrachud gave time after additional solicitor general Tushar Mehta sought
more time to respond. On Sept.2, All India Muslim Personal Law Board (AIMPLB)
told the Supreme Court that personal laws of a community cannot be
"re-written" in the name of social reforms and opposed pleas on
issues including alleged gender discrimination faced by Muslim women in divorce
cases. The Supreme court had taken suo motu cognizance of the question whether
Muslim women faced gender discrimination in cases of divorce or due to other
marriages of their husbands and a bench headed by Chie Justice of India TS
Thakur is examining the issue.Subsequently, various other petitions including
one by triple talaq victim Shayara Bano were filed challenging the age-old
practice of 'triple talaq' among the Muslim community. AIMPLB and
Jamiat-e-Ulema had defended triple talaq and said it was part of Quran-dictated
personal law which was beyond the ambit of judicial scrutiny.PTI

Hyderabad:Noted Muslim
Women’s organization, “Muslim Mahila Research Kendra” filed an affidavit in
Supreme Court against any intervention in Muslim Personal Law. It may be
mentioned that some Muslim women’s organization had challenged the right of
husbands to divorce by pronouncing “Talaq” thrice at one go. SC bench headed by
CJI, Justice TS Thakur is hearing this case.Ms. Tahniyath Athar, President,
Muslim Mahila Research Kendra and Dr. Asma Zehra, Director of the organization,
in a press statement said that in the affidavit filed in SC, it has been stated
that SC cannot intervene in Muslim Personal Law under the pretext of protection
of women’s right or social reforms. SC also cannot interpret Muslim Personal
Law. They also said that SC cannot decide about the authenticity of three
divorces pronounced one time. The process of pronouncing divorce is fixed and
recognized which cannot be changed by anyone.In their press statement they
mentioned that the issues pertaining to marriage, divorce and maintenance
allowance are different in various religions. Any court of law cannot raise any
question about the authenticity of the provisions made in any religion.Although,
divorce is an unpleasant event but it need be it has to be exercised. Due to
ignorance, haste and atrocities, matrimonial relations get spoiled and the
matters reach the courts of law. Such cases should be decided by the community
itself in the light of Muslim personal law. Husband has the right to divorce
his wife which no court of law can take away from him. No state law can
challenge this authority of the husband.Siasat

The facts about Polygamy
in India suggest the practice is down from 5.7% of Muslim families in 1961 to
2.55 % in 2006. Latest figures of polygamy, released by the third National Family
Health Survey (NFHS), carried out in 2006, also show that 2% women reported
that their husbands had more than one wife. It found that polygamy was
prevalent among 1.77% Hindus, down from 5.8% in 1961. 1961 figures – based on
Census of India data – also show that among tribals it was then widely
prevalent: 15.25 of them were polygamous. A paper based on NFHS data on the
subject said, “In modern times, a person is bound by the marriage laws laid
down by their religion and have to be adhered to and any deviation from the
norms are considered to be illegal. Until recently, no scientific data also was
available at the national or regional level to assess whether polygamy is still
practiced or is non-existent.” It added, “For the first time data required to
study and understand such marriage practices was collected as part of the
2005-06 NFHS. Data was collected from both women and men – women were asked a
direct question whether besides herself, her husband had other wives and men
were asked if they currently have one wife or more than one wife.”It added,
“One interesting finding is that women across religious groups – Hindu (1.77
partners), Muslim (2.55 partners), Christian (2.35 partners), Buddhist (3.41
partners) have reported that their husbands have multiple wives.It is more
common for husbands of women belonging to scheduled castes and tribes to have

Sedition, defamation
charges cannot be invoked for criticism: Supreme Court
New Delhi:Sedition or
defamation cases cannot be slapped on anyone criticising the govt, the Supreme
Court on Monday said in a clear message.“Someone making a statement to
criticise govt does not invoke an offence under sedition or defamation law. We
have made it clear that invoking of section 124(A) of IPC (sedition) requires
certain guidelines to be followed as per the earlier judgement of the apex
court,” a bench of Justices Dipak Misra and UU Lalit said while refraining from
saying anything further on the issue.The observation came as Advocate Prashant
Bhushan, appearing for an NGO, said sedition was a serious offence and the law
on it was being grossly misused for stifling dissent. He cited the examples of
sedition charges being slapped on agitators protesting against Kudankulam
Nuclear Power Project and cartoonist Aseem Trivedi, among others.To this, the
bench said “we don’t have to explain the sedition law. It’s already there in
the five-judges constitution bench judgement in Kedar Nath Singh vs state of
Bihar of 1962.” The court, while disposing of a petition filed by NGO Common
Cause alleging misuse of the sedition law, refused to pass a direction on the
plea that a copy of this order be sent to all Chief Secretaries of states and
the Directors General of Police.“You have to file separate plea highlighting if
any misuse of sedition law is there. In criminal jurisprudence, allegations and
cognisance have to be case specific, otherwise it will go haywire. There can’t
be any generalisation,” the bench said.PTI

India's central bank has
proposed working with the govt to introduce interest-free banking to tackle
financial exclusion for religious reasons, potentially opening Islamic finance
to the largest Muslim minority population in the world.RBI made the proposal in
its annual report last week, as departing bank governor Raghuram Rajan hands
over the reins to close ally Urjit Patel.The proposal marks a shift in stance
by the RBI, which has previously said Islamic finance could be offered through
non-bank channels such as investment funds or cooperatives.That has meant an
estimated 180 million Muslims in India, the country's second-largest religious
group, have been unable to access Islamic banking because of laws that require
banking to be based on interest, which is forbidden in Islam.RBI said it would
explore introducing interest-free banking products in consultation with the govt,
a key detail as this opens the prospects of supportive legislation."This
is definitely a significant development as it is the first time that the RBI
has concretely mentioned that it will now work with the govt to introduce Islamic banking," said Saif
Ahmed, managing partner at Bangaluru-based Infinity Consultants, which

what it called "undue hues and cries" over the Muslim woman rights
and several courts’ judgments on matters of Muslim personal laws seemingly
contrary to the provisions of the Islamic law, Jamiat Ulama-i-Hind Sunday
launched a training course in Muslim personal law for lawyers. Former Chief
Justice of India AM Ahmadi while launching the courses at Jamiat HQRS, ITO New
Delhi, noted this move as a positive way to deal with the misunderstanding
about the Islamic Sharia.“Each and every community has to face difficulties at
sometimes. But, a wise community is the one which instead of resorting to the
sentimentalism, first evaluates its own faults and then correct it.If there is
a concerted attempts unleashed for distorting its image then it responds with
wisdom and full acumen", he said.While speaking on Common Civil Code he
said that this was not issue of a particular community but in country like
India which is a pluralistic society, such move will not be accepted even by

The refusal of separatists
to engage in talks with All Party Parliamentarian Delegation has given rise to
fears in Kashmir that the present phase of political uncertainty and turmoil
will drag on. Although there was no hope of any major breakthrough or announcement
from the delegation, the delegates were expected to break the ice with the
Hurriyat and calm tempers in the valley.But with separatists hardening their
stand and Home Minister Rajnath Singh accusing them of going against the ethos
of Kashmiryat, insaniyat and even jhamooriyat, the hardening of the posters
from both sides is a warning sign for a Kashmir reeling under unabated curfew. Home
Minister announced that parliamentary delegation leaders who met the Hurriyat
leaders did so in their individual capacities, thereby distancing himself from CM
Mehbooba Mufti’s overtures towards the separatists.This has further weakened
Mehbooba’s position as a leader in Kashmir. Mehbooba had written a letter to separatists
to come forward and engage with the parliamentary delegation.This development
will further complicate problems for the ruling alliance of the PDP-BJP led by Mehbooba
Mufti.That BJP was not on board Mehbooba’s decision to invite Hurriyat for
talks was reinforced by Home Minister Rajnath Singh's statement that Mehbooba

and final day of the summit in this east Chinese city, Modi met Erdogan and
Hollande in separate "pull-aside" meetings.In his meeting with

External Affairs Ministry Spokesperson Vikas Swarup said. Discussion with
Erdogan on NSG was significant as Turkey was among the few countries - along
with China - which had stalled India's bid to join the elite grouping at its
plenary meeting in June in Seoul. Turkey too raised its concern over the
presence of supporters of dissident Fethullah Gulen, who it accusses of

secretary-level officers in the home ministry have lodged a protest with home
secretary Rajiv Mehrishi against "unfair" suspension of their
colleague, joint secretary GK Dwivedi , over renewal of the FCRA licence of
Zakir Naik's NGO IRF. Sources said they plan to take up the issue with home
minister Rajnath Singh, with one of the officers maintaining that govt was being "too harsh on an honest IAS
officer". Sources, however, indicated that Mehrishi, while hearing the
agitated officers on Saturday, justified the action against Dwivedi. He stated
that Dwivedi had been instructed several times not to process any clearance to
IRF pending an inquiry into its FCRA dealings. With the NGO's licence renewal
still having gone through, the home secretary argued that there was valid
ground for holding the joint secretary responsible for "oversight and lack
of supervision".Dwivedi, along with 2 under-secretaries and a section
officer, was suspended after IRF's registration was 'erroneously' renewed
through the FCRA online renewal system, even as it is probed for FCRA
violations and faces prospects of a ban under the UAPA.The home ministry has
also ordered that a departmental inquiry against Dwivedi be conducted by
additional secretary M Gopal Reddy, which has further upset some of Dwivedi's

govt has decided, putting the organisation on what it calls a "prior
permission category list."This is a first step towards canceling
permission for Dr Naik's organisation to receive foreign funds. Ministry has
said the foundation's licence to receive funding under FCRA was
"accidentally" renewed last month, even though Dr Naik is under
investigation for allegedly misusing foreign donations."We have suspended 3
officers, because permission couldn't have been renewed when the probe was
on," Minister of State for Home Affairs Kiren Rijiju told NDTV last week

Hind has urged the govt to control fundamentalist forces to ensure peace in

a comprehensive law to curb communal violence. They asked for strict

wife using garbage after being turned away by crematorium
In an incident that brings
to light a dangerous pattern in India, a tribal in Madhya Pradesh had to gather
waste paper, tyres, twigs and plastic bags to cremate his wife after he was
turned away from a crematorium because he could not afford to pay for
it.According to TOI, Jagdeesh Bhil, from Ratangarh village in Neemuch district,
spent three hours collecting garbage for the pyre last Friday after he was spurned
by the crematorium.The report added that someone even suggested that he throw
his wife in the river instead. "My wife, Nozibai, died early on Friday
morning. We went to the Ratangarh village panchayat to arrange for logs for the
cremation. But the (village) heads claimed that they couldn't do anything
because we did not have enough money to get the 'parchi', which costs Rs
2,500," the report quoted him as saying. Incidents of neglect like the one

appellate authority holding some students including Umar Khalid and Anirban

penalised along with 19 others, including JNUSU president Kanhaiya Kumar,
challenging the findings of the appellate authority.In a related development today,

country later this month against incidents of atrocity on members of the community.He
said the date of the agitation would be announced on September 16 during a

protest… and for this purpose a rail roko andolan will be held across the
country at the end of this month,” Mevani told The Indian Express after

leader Arif Baig passes away
Bhopal: Former union
minister and senior BJP leader Arif Baig died on Monday after suffering a heart
attack, his family said. He was 81 and is survived by two sons and five
daughters. Baig, who was suffering from blood sugar, died at his home due to
sudden heart failure around 9AM, his younger son Noorul Hasan Baig said.2-term
Lok Sabha MP from Madhya Pradesh, Baig was first elected to the lower house
from Bhopal on Bhartiya Lok Dal ticket in 1977 by defeating Dr Shankar Dayal
Sharma, who later became President. Thereafter, he was made the Union Minister,

from Mumbai’s municipal corporation that their establishment – a tiny room in a
civic-run school – would be shut down because it was engaged in
“non-educational activities”. Similar notices had come in the last two years,
but the Markaz had successfully argued their case. This time, even while they
were planning to make a representation, the corporation’s officers came and
shut the room two days after sending the notice.“We were surprised and shocked;
we never even got a chance to put up any resistance. At the very least we would

execution, foreign ministry of Turkey issued a condemnation. "We have

integrate into modern society, according to a latest study conducted in 25
Islamic nations. Study, done by researchers from Oxford University and European

week, tested earlier mathematical models to see how the intensity of wearing
the veil varied according to the women’s education, employment, urbanisation
