Bombay Lawyers Association moves SC seeking
review of Loya order
New
Delhi:Bombay Lawyers Association has approached the Supreme Court seeking
review of its judgment dismissing its plea for an independent probe into the
death of CBI special judge BH Loya. The petition settled by senior advocate
Dushyant Dave also sought deletion of the court’s findings in the judgment that
the petitions were a “veiled attempt to launch a frontal attack on the
independence of the judiciary and to dilute the credibility of judicial
institutions”. It contended that the “judgment has resulted in miscarriage of
justice if not complete negation of justice on the facts of the case”.A 3-judge
bench of CJI Dipak Misra and Justices AM Khanwilkar and DY Chandrachud had on
April 19 dismissed the petition along with certain others with similar prayers.
The court ruled that “documentary material on the record indicates that the
death of Judge Loya was due to natural causes”. Association had originally
filed its petition seeking a probe before the Bombay HC. The SC subsequently
transferred the plea to itself. The lawyers’ body said its attempt was not to
“sensationalise the subject matter nor make a veiled attempt to launch a
frontal attack on the independence of the judiciary or to dilute the
credibility of judicial institutions”. “On the contrary, the whole attempt of
the Petitioner Association was to reassure the entire judiciary that the
Association would stand behind every Judge in times of challenge in his or her
life. The effort was for an independent enquiry to reassure all Members of Judiciary
and nothing more. If the enquiry was ordered as prayed for and if it found that
Judge Loya had indeed died of heart attack it would have set all doubts to rest
but it would have sent a strong message to the Judiciary and to the country
that individuals are willing to stand up for the judiciary and not desert it in
time of challenge. As against that if enquiry had found some foul play it would
have truly been a great service to the independence and impartiality of
Judiciary and its Members.Either way the efforts of the Petitioner Association
were to uphold the dignity and independence of judiciary and not otherwise,” it
said. The review petition said the Association was only questioning the
veracity of the discreet enquiry report prepared by the Commissioner of
Intelligence, Maharashtra Police, on the death and that was in no way to malign
the dignity of the judges whose statements formed part of the report.indianexpress

Govt’s refusal to condemn Israel’s violence
shameful: Mani Shankar Aiyer
Kozhikode: Hundreds of people sat in a
day-and-night stir even while observing Ramadan fasting at Muthalakkulam in
Kozhikode on Sunday to express solidarity with Palestinians and to condemn the
recent Israeli human rights violations in Gaza.Protest organized by Solidarity
Youth Movement was held to mark the 70 anniversary of the Nakba, during which
lakhs of Palestinians were expelled from their homes during the course of
Israel’s creation in 1948. People sporting head bands inscribed with the slogan
‘Return to Palestine’ chanted slogans against Israel. Inaugurating the
programme, ex-Union minister Mani Shankar Aiyer said that the refusal by the Govt
of India to condemn the killing of around 60 Palestinians during demonstrations
at Gaza last week was utterly shameful.“Even as British PM and the French President strongly condemned
the violence by the Israeli forces at Gaza border, the Modi Govt is refusing to
say anything on the atrocities being committed by Israel against Palestinians.
It is utterly shameful and against even the principles of Hindu ethics, against
principles of Muslim and Christian ethics and even against the Jewish ethics,”
Aiyer said.Taking dig at the the central government, Aiyer said that instead of
condemning violence happening in Gaza, they are conducting ‘Al Naqba’ in
Karnataka where they were trying to form a Govt without having a clear
majority.“There is no greater evil than not speaking up when there is injustice
and cruelty,” Aiyer added.Aiyer said that it is even sadder that Arab countries
are not demonstrating the kind of solidarity that they ought to have extended
to Palestinians when fellow Arabs are mercilessly mowed down by the Israelis,
he said. “Palestinian cause is not a Muslim cause. It is a secular cause and it
is a cause of justice and peace,” he added. Solidarity state president PM Salih

Karnataka: Congress claims it set tape trap,
BJP walked in
Behind the string of audio recordings of BJP

Congress released 6 audio recordings of BJP leaders, among those the recording
of a purported conversation between Bellary mining baron and BJP leader
Janardhan Reddy and Congress MLA Basanagouda Daddal on Friday night, and 2 more
on Saturday — while MLAs took the oath of office — allegedly involving
Yeddyurappa and BJP general secretary and Karnataka-in-charge Muralidhar
Rao.Congress sources said plan to record conversations began 3 days ago, when
an alleged middleman for BJP approached state leadership.“The middleman told us
that he had been asked to find MLAs for BJP and that senior leaders would
personally talk to members willing to switch sides. We discussed this with
senior party leaders and decided to use the information to trap BJP leaders in
the act of negotiating with our MLAs,’’ said a senior Congress leader, who
played a central role in the release of the audio clips.“We decided to pick
MLAs who are capable of carrying out the pretence of a negotiation with the BJP
leaders without them realising they were being trapped,” he said.indianexpress

Aligarh: Youth converts to Islam for love,
arrested
Aligarh: A 21-year-old Aligarh youth who
converted to Islam was arrested on Sunday after his family members and some
right-wing organisations created a ruckus outside the Kwarsi police station in
the district. He has been arrested under section 151 of the CrPC (arrest to
prevent the commission of cognizable offences). A complaint filed by his family
members has alleged that “their son was influenced by a Muslim girl and forced
to convert” even though the youth said that he has embraced the religion of his
own free will.According to police, Ved Prakash, who has now taken the name of
Aadil, had left Hinduism around 8 months ago while he was employed at a furniture
shop in the district’s Nagla Patwari locality. The matter came to light on
Saturday evening when he had allegedly expressed his desire to marry a Muslim
girl who lives in the same neighbourhood. Aadil is a resident of Baraula
Jafrabad area of the district. On Sunday, members of his family along with some
right-wing groups lodged a complaint against the girl’s relatives alleging them
of “forceful religious conversion”. Rejecting allegations of his family, Aadil
said, “No one forced me to convert. I have embraced Islam and have no regrets
about it. What is wrong in that?”SSP, Aligarh, Ajay Kumar Sahni said, “The

UP: Ganna trumps Jinnah in this bypoll when
sugarcane arrears pile up
Kairana:“Uth gaya ganna, dab gaya Jinnah
(Sugarcane has displaced Jinnah),” says Jitender Hooda as he interprets the
upcoming bypoll to the Kairana Lok Sabha constituency. For this 48-bigha (8.1
acres) farmer from Kheri Bairagi village of Shamli district and tehsil, the
main issue in the election scheduled on May 28 — necessitated by the death of
BJP MP Hukum Singh — is sugarcane. Kairana constituency has six sugar mills:
four private (the Shamli factory of Sir Shadi Lal Enterprises, Rana Sugars’
factory in Unn, Bajaj Hindusthan’s in Thana Bhawan and Uttam Sugar’s in
Shermau) and two cooperative (in Sarsawa and Nanauta). In current 2017-18 season
(Oct-Sept.), 6 mills have, as on May 18, bought sugarcane worth Rs 1,778.49
crore at the UP government’s State Advised Price (SAP) of Rs 315-325 per
quintal. Of this, they were to pay Rs 1,695.25 crore within 14 days of
purchase, but have so far disbursed just Rs 888.03 crore. That translates into
Rs 807.22 crore in arrears – for a single constituency.“How does it matter
whether or not AMU has a photo of Pakistan’s founder? Our only concern today is
cane payment,” says Hooda, who supplies to the Shamli factory, which alone has
cane dues of Rs 190.33 crore. The other 5 mills, too, have sizable arrears: Unn
(Rs 182.84 crore), Thana Bhawan (Rs 182.80 crore), Nanauta (Rs 115.66 crore),
Shermau (Rs 80.79 crore) and Sarsawa (Rs 54.79 crore).Brahm Pal Singh, who
grows sugarcane on 34 out of his 45-bigha holding in Laprana village of
Shamli’s Unn tehsil, is more direct. “Their (BJP) manifesto stated that we will
get full payment for our cane within 14 days of sale.Minister for Sugarcane
Development Suresh Rana is himself the MLA from Thana Bhawan. Yet, there been
no payment after Dec.31 and this Govt is even allowing sugar imports from
Pakistan,” he alleges (the Commerce Ministry has clarified that only 13,110
tonnes was imported in 2017-18 and another 1,908 tonnes in the current fiscal
till May 14).indianexpress

Doval hasn’t changed policy, just more
hardline, says ISI ex-chief General Durrani: indianexpress
Indian NSA Ajit Doval’s experience in Pakistan
affected him in a manner that he believes that the country must be dealt with
an iron fist, according to ex chief of Pakistan’s ISI, Lt General Asad Durrani
(retd). This is part of a new book, “Spy Chronicles: RAW, ISI and the Illusion
of Peace”, which has been co-authored by Durrani and ex R&AW chief AS
Dulat, along with journalist Aditya Sinha. The book is set to be launched in
Delhi this week, but Durrani will not be able to attend the event as he has not
been given a visa by New Delhi so far.About Doval, who served in India’s
intelligence agencies before retiring in 2005, Durrani says, “He hasn’t changed
policy. He’s just a little more hardline but it’s still what I believe has been
Indian policy for a long time. He shouts more, like Trump does, a lot of hot
air. He provides that masala.”“The upshot is he’s just doing what his boss
wants done. Maybe more muscularly, more vocally,”Durrani adds.Durrani attributes
Doval’s attitude to his stint with the Indian High Commission in Islamabad in 1980s,
saying that “In Ajit Doval’s case it probably affected him in a way where he
felt, ‘Oh God, this country must be dealt with an iron fist’.”Dulat, however,
argues about “his colleague and good friend” and “Modi’s henchman” Doval that
“As far as his capabilities go, he’s one of our outstanding operational guys.
He’s a field man.” “The trouble, though, with people who are so much into
themselves, is that they’re lonesome and they stay aloof. In A Legacy of Spies
there’s a relevant line that says, the trouble with spooks is that they find it
difficult to invest in trust,” he adds, “Ajit is a guy who won’t trust
anybody.”Dulat goes on to say that Doval is “not necessarily a hardliner” on
Pakistan, arguing that “He toes Modi’s line. He also toed Mani Dixit’s line. He
at one point-toed [M K] Narayanan’s line…I’ll tell you something. He is
convinced that Modi is the greatest thing that has happened to India. That I
can vouch for.”In turn, Durrani says that Doval “matters nowadays, as Modi
matters. I agree he is smart and would not miss an opportunity for another
spectacle.” indianexpress

the corporation held meetings with all the stakeholders and have directed them

stirred fierce passions, died at an assisted living facility on Saturday,The
Washington Post reported. He was 101.Mr. Lewis, who was born in London and was
a long-time professor at Princeton University, was a Cold War hawk, a strong
pro-Israel Jew, and influential among White House and Pentagon planners of the
US-led 2003 invasion of Iraq. His books included The Arabs in History (1950),
The Emergence of Modern Turkey (1961), and The Crisis of Islam (2003).Critics,
however, derided what they said was his Eurocentric “clash of civilisations”
view of West Asia.Edward Said slammed
Lewis as “active policy scientist, lobbyist and propagandist” in a 1982
reply to Mr. Lewis in New York Review of Books. Mr. Lewis in turn accused Mr.
Said — author of the influential book Orientalism (1978)— of unleashing an
“unsavoury mixture of sneer and smear, bluster and innuendo.”Israeli PM Benjamin Netanyahu called him "one of the
great scholars of Islam and the Middle East in our time." AP/AFP

After meeting Abadi, Sadr says new Govt will
be 'inclusive'
Muqtada al-Sadr, Shia leader whose bloc beat
expectations to come out on top in Iraq's parliamentary vote, has held separate
meetings with rival political leaders, ushering in what could be an extended
period of negotiations over the formation of a new government.Al-Sadr first met
incumbent PM Haider al-Abadi late on
Saturday, before holding talks with Hadi Al-Amiri, the leader of the
pro-Iranian Fatah bloc, a day later. The meetings in the Iraqi capital, Baghdad,
came after the Iraqi electoral commission announced the official results, which
saw al-Sadr's Sairoon coalition taking 54 out of 328 seats in the May 12
vote.Al-Amiri's bloc came in second with 47 seats, while al-Abadi's Nasr
Coalition disappointed by finishing third with 42.With no bloc winning the 165
seats required for an outright majority, negotiations to form a coalition Govt are
expected to drag on for weeks, if not much longer - such talks in the past have
lasted up to nine months.Al-Sadr cannot become PM himself, because he did not run as a
candidate. However, as head of the majority coalition, he is expected to play a
central role in the coalition negotiations. aljazeera
