7 months after it struck down the practice of Triple Talaq, the Supreme Court today issued notice in a batch of petitions challenging the Islamic practices of Polygamy, Nikah Halala, Nikah Mutah and Nikah Misyar. The petitions, which assail the validity of Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937 insofar as it sanctions the above practices, were heard today by a Bench of CJI Dipak Misra and Justices AM Khanwilkar and DY Chandrachud.Bench, after issuing notice to the Central govt and the National Commission for Women, referred the matter to a Constitution Bench.4 petitioners are Sameena Begum, Nafisa Khan, BJP leader Ashwini Kumar Upadhyay and Moullim Mohsin Bin Hussain.Senior Advocates Mohan Parasaran, V Shekhar, Sajan Poovayya and advocate Gopal Sankaranarayan appeared for the petitioners.Appearing today, the lawyers referred to the judgment rendered by the Court in the Triple Talaq case, in which the Court had stated that the issues of Polygamy and Nikah Halala could be considered separately. Court agreed to the same and issued notice. According to livelaw.in, the ruling said, “LD counsel for petitioners submit that the challenge in these petitions pertain to prevalent practice of Polygamy and Nikah Halala arguing that they are unconstitutional. Various grounds have been cited in support of their stand on these two practices.They contend that these two practices cannot be permitted under the Constitution. It is contended by them that the Constitution Bench in the triple talaq matter had not dealt with these two issues and kept them open.On a perusal of the judgment we find it is correct. They also contend that these two issues also should be dealt by a Constitution Bench. New Delhi: Official mobile app of PM  Narendra Modi, downloaded over 5 million times on Android alone, sent user data to a US-based company without consent, security researchers have found in claims that were verified by NDTV. Allegations against the Narendra Modi app, which have sparked a furore on social media and biting criticism from Congress President Rahul Gandhi, come at a time of heightened sensitivity around the alleged misuse of personal data amid the unfolding Facebook-Cambridge Analytica controversy.The ruling BJP has denied the allegations and said the data was being used only for analytics to offer all users the "most contextual content". It was a security researcher, who has previously highlighted vulnerabilities in India's national identity card project Aadhaar and who tweets under the pseudonym Elliot Alderson, who first posted a series of messages on Twitter on Saturday stating the Narendra Modi app was sending personal user data to a third-party domain that was traced to an American company. Alderson, who initially pointed out that the application, popularly known as NaMo app in India, was sharing data with a third party without the consent of users, earlier on Sunday posted a new tweet saying the app had "quietly" updated its privacy policy after his previous tweets. NDTV checked the claims, consulting experts and using a popular tool called Burp Suite. The findings showed that as a user kept entering personal information such as name, email address, gender and city, the data was being shared with the website in.wzrkt.com.During the entire process of registration the user is never informed or asked permission for sending data to a third party - a procedure which is usually followed by most apps.NDTV found that the domain in.wzrkt.com belonged to a company called WizRocket Inc which is registered in California and the data is being sent to a server in Mumbai. WizRocket is a data analytics platform developed by a US-based company called CleverTap.CleverTap's website says it is as a mobile marketing platform that "visually builds and delivers omnichannel campaigns based on user behavior, location and lifecycle stage". The company was founded in 2013 by three Indians and has offices in several cities in USA and Indian offices are in Mumbai, New Delhi and Bengaluru.The link, earlier pointed out by Alderson and fact-checking website AltNews, sponsored an attack by Rahul Gandhi who tweeted, "Hi! My name is Narendra Modi. I am India's PM. When you sign up for my official App, I give all your data to my friends in American companies. Ps. Thanks mainstream media, you're doing a great job of burying this critical story, as always."Stung by mounting criticism on social media, the BJP admitted that it was sharing information but that this was par for the course. Experts say that data shared with political parties is prone to misuse. Srinivas Kodali, a cybersecurity expert said, "It can be misused by sharing with private companies like Cambridge Analytica which could build voter profiles of volunteers who are active through the Narendra Modi application."BJP's response, however, did not appear to address the crucial issue of consent.The backlash was also compounded by criticism over 13 lakh cadets of India's NCC being asked to install the app and share phone numbers and email addresses with PMO.NDTV

At a media briefing on Monday, investigative news portal Cobrapost screened a two-hour-long purported sting operation dubbed ‘Operation 136’, conducted on major media outlets, claiming to expose how media owners, publishers and managers agreed to peddle content and political propaganda in return for money. These outlets allegedly agreed, in exchange for money, to run political campaigns, mythology and spirituality cloaked in political terms and a “soft Hindutva” agenda for electoral gains by way of content. Cobrapost indicated that this was just part one of the sting and that part II would follow. Cobrapost also posted several clips from the purported sting operation on its YouTube channel. Masquerading as a representative of Bhagwad Gita Prachar Samiti, Cobrapost said undercover reporter Pushp Sharma met managers and owners of around 20 media houses. He recorded the conversation and the video with the help of spy cameras and the edited version was screened for the media on Monday.Describing deal as ‘commercial’, a media executive is purportedly seen declaring to undercover reporter Sharma that he had no problem diluting or blanking out news ‘against Hindutva’, belittling political parties such as SP, BSP and RJD, or defaming political leaders like Congress President Rahul Gandhi as long as they were paid fully in advance.Most media representatives told undercover reporter Sharma that they had no problem accepting 50% of the payment in cash. The money had to be paid in advance though, and the receipts could indicate that the rest of the money were in the form of donations. One of the media managers is heard telling the undercover reporter, “There are smart ways of doing it and there are foolish ways of doing it.” He offered to do it the smart way.

Kalahandi : It has been 41 days since Saida Begum (50) began her vigil in front of Kalahandi collector’s office, seeking help to get a share of her dead husband’s property that has been denied by her in-laws for years. On Saturday, her case was taken up for hearing at Odisha State Legal Services Authority (OSLSA) — constituted by the state Govt  in 1996 to provide free legal aid to the weaker sections of the society.Born Kumudini Nayak to a Dalit family, the woman says her in-laws never accepted her as she had converted to Islam at the time of marriage with Abdul Habib. Saida’s parents too had disowned her as she had eloped with a Muslim man against their wishes. But this was just the beginning of her troubles. After Habib died of some illness in 1999, Saida was allegedly beaten and thrown out of her his house by her in-laws. All these years, Saida made a living selling golgappas and firewood, but five years ago when she approached her in-laws seeking a share in her husband’s ancestral property, she was allegedly abused and threatened.“I approached them (brothers of her husband) hoping that I could use the money for my two daughters’ marriage and for opening a shop for my son. But my brothers-in-law were enraged and my nephews threatened me,” she says.According to Ruksana, Saida’s daughter, many in local community still saw her family as an outsider. “…More so because my cousins are powerful in Bhawanipatna Masjid Committee.21-year-old, who is in the final year of a bachelors course in home science, adds: “I have to stay beside Maa because our cousins have said they will slit her throat.” Saida’s eldest daughter Ruby is 23, while her son Salman is 19. The masjid committee, however, refused to take sides in the family feud. “What are we to do in this matter?”, says Muna Khan, president of the committee, adding that he is not aware of any threats to Saida and her children.Recently, a local BJP leader Pradip Nayak also visited the family. Thousands of Muslim women protest against Triple Talaq Bill in Thane
Mumbai; Thousands of Muslim women gathered in Mumbra, Thane, on Monday afternoon to protest against Triple Talaq Bill, proposed by the central govt. Women thronged to the Thane town from areas like Kausa and Shil. Protesters began a march around 2 pm from Daru Falah Masjid, after which they gathered at the Jain Mandir ground in Mumbra, where members of the community would be speaking. The protest has been organised by AIMPLB and Kul Jamat, a Muslim organisation based in Mumbra.“We have gathered to represent the sentiments of women from our community. We strongly oppose the Triple Talaq Bill, and so the Govt should not go ahead with it,” said Shabana Asan, 40, a representative of the Shia community in Mumbra. Madina Ansari, 32, a resident of Mumbra, said, “We are against the Triple Talaq Bill. Hence, we have participated in this protest. We do not want any change in our Sharia law.”Rauf Lala, from Kul Jamat said, “Triple Talaq is a part of our religion, and the Govt  should not interfere in the Islamic law.The thousands of women who have participated in the march share this sentiment.”The protestors will submit a memorandum to PM  Narendra Modi, through the DM of Thane. hindustantimes

New Delhi:Jamaat-e-Islami Hind (JIH) has criticized the Govt  of India for opposing the minority status of Jamia Milia Islamia (JMI). “By submitting an affidavit in the court, opposing the minority status of Jamia, the Govt  of India has negated the history of Jamia Milia as well as the constitutionally guaranteed rights to the minorities,” said JIH Secretary General Muhammad Salim Engineer.“The minority character and status of Jamia cannot be denied as it is so apparent by its name and the very well established fact that it was formed by the Muslim community of India with whatever limited resources they had at their disposal. There exists complete documentary evidence for the same and there is a historical background that led to its formation.Jamia and its founders played an important role in the freedom struggle of India and played a prominent role in our nation building,” he added.Salim Engineer further said: “In 1963 JMI acquired deemed university status and became a recognized University in 1988 by an Act of Parliament.In 2011 NCMEI awarded Jamia its minority status. Bhopal:A stringer for a TV channel was mowed down by a truck on Monday morning in MP’s Bhind district. Sandeep Sharma, who was working for News World channel, was rushed to a local hospital where he succumbed to injuries during treatment. Sharma, who had conducted 2 sting operations on police officers, had sought police protection citing a threat to his life.In the letter seeking police protection, Sharma had accused a SDOP of being hand-in-glove with those engaged in illegal sand mining.Bhind SP Prashant Khare said an offence under Section 304 has been registered in connection with the death. He said the police have formed a SIT to probe into the incident. HE said the truck involved in the accident has been seized and they are looking for driver who fled after the accident.indianexpress

NEW DELHI:A case has been registered against JNU students for rioting, destruction of public property and obstructing public servants from discharging their duty, two days after the students were thrashed and a woman journalist allegedly molested by Delhi Police personnel during a protest march.A case has also been registered on a complaint by a photojournalist who had alleged snatching of her camera, Delhi Police said. One woman constable of Delhi Armed Police and a male head constable have been placed under suspension on the basis of the preliminary findings of a vigilance enquiry into the matter.“The camera has since been traced and the police is contacting the photojournalist to facilitate its restoration,” the statement said.The police are expected to complete by Monday an internal investigation into a complaint by a female journalist alleging molestation by an SHO during the protest.The case against the students has been registered at the Sarojini Nagar police station.JNU Students Union said that it was a peaceful march and the police were trying to save their men who had allegedly molested and thrashed students and journalists.“JNUSU condemns the brutality and filing of false FIRs on peacefully marching students and teachers, which is nothing but a desperate bid on the part of Delhi Police to hide their own culpability in wanton violence and molestation,” JNUSU said. New Delhi:In the wake of sexual harassment allegations against JNU professor Atul Johri, a section of scientists from across the country have condemned the incident and called for blacklisting of such accused from serving on scientific committees, receiving funding, awards and election to academies.It is alleged that Atul Johri, had been sexually harassing at least eight women students of the School of Life Sciences of the varsity since 2014.Issuing a statement, a group of 165 scientists across the country said the recent incident has once again trained the spotlight on the issue of sexual harassment in science labs. “That the alleged incidents span several years and multiple victims, all students/project employees point to a pattern that appears to be specific to the nature of working conditions for women in scientific labs in India.”Pointing out that not every science lab in the country is an unsafe space for women, the scientists said to think of JNU incident of sexual misconduct as an isolated case of an individual wrongdoing would be an “oversimplification and an understatement of the problem.”indianexpress

Mumbai:Sambaji Brigade, aggressive Maratha organization, has joined hands with Prakash Ambedkar, leader of Bharip Bahujan Mahasangh, and will participate in ‘Elgar’ march – a protest rally – to be held in Mumbai on Monday.The rally will demand to arrest of Manohar Kulkarni, better known as Sambhaji Bhide, chief of Shiv Pratishthan, for his alleged role in the Bhima-Koregaon caste riots which claimed the life of a youth in January this year. Mumbai police has not given permission for a protest march from Byculla to Azad Maidan but permitted the public rally at Azad Maidan.The morcha was expected to begin at Rani Baug at Byculla in the morning; however, since the police has denied permission, the protestors will assemble at CST and head towards Vidhan Bhavan. The ‘elgar’ march has been organised by Dalit and Other Backward Class outfits.  Ambedkar will lead the morcha. Ambedkar on Sunday said the police has cited ongoing board examinations as reason for denying them permission. “State Govt informed us about denial of permission on Sunday afternoon. Karnataka polls: Congress Will Better its 2013 Tally, Predicts Survey
New Delhi: Congress will not only return to power in Karnataka but will also end up improving its tally in the 224-member Legislative Assembly, a pre-poll survey conducted by C-Fore predicted.Survey was conducted between March 1 and 25 and spoke to 22,357 voters across 154 assembly constituencies. The respondents were spread across 2,368 polling booths covering 326 urban and 977 rural locations. C-Fore said it had a margin of error of 1 percentage point. Sources told News 18 that Congress itself had commissioned this survey. In 2013, C-Fore had predicted that the Congress would end up winning 119-120 seats and it ended up with 122. The Congress will improve its vote share by 9% and end up with 46% of the vote. BJP, the survey said, will have 31% of the vote and JD (S) will have 16%.news18

Nagpur: VHP chief Pravin Togadia on Sunday advocated for “temple only” at the disputed site of the demolished Babri mosque and continued to attack PM  Narendra Modi on many issues besides Ram temple. “If we were to finally agree to a judicial process on temple issue, which will inevitably allow construction of Babri mosque near temple once the title suit is finally disposed of, why did we have to do agitation since 1982, why did thousands of kar sevaks have to go to jail and hundreds take police bullets on their bodies?” Togadia asked at a press conference in Nagpur.VHP leader further asked: “What happened to the 1987 party resolution to resolve the issue through an Act of Parliament when the party would get a full majority? 4 years have elapsed since the Modi govt came to power with a full majority. Hyderabad: Situation in Nirmal Town became tense due to stone pelting on Masjid during “Rama Navami” procession which was taken out in the night of 25th March.According to report when the procession reached Masjid Gulzar located at Vegetable Market, it was alleged that stones were pelted on Masjid by miscreants as a result of which the window panes of Masjid got damaged.On receiving this news, a large number of Muslim youths assembled at the masjid. They started protesting for taking stern action against the miscreants. Meanwhile, Addl. SP, Dakshina Murthy got injured after which police resorted to lathicharge and used tear gas shells to disperse both the groups. This action of the police created unrest among the residents of Nirmal.Police got alert and posted additional policemen at sensitive areas.SP, Varier also reached the spot and camped near the Masjid till late at night. He assured the Muslim youths that stern action would be taken against the miscreants.Police patrolling increased. Vadodara: Clash breaks out after miscreants pelt stones at Ram Navami procession
Vadodara: A clash broke out between two communities in the old city area of Vadodara on Sunday evening after miscreants allegedly pelted stones at a procession to mark the occasion of Ram Navami.The incident occurred after 7 pm in the communally sensitive area of Fatehpura, from where the Ram Navami procession was passing. According to local eye witnesses, violence broke out when unidentified miscreants hurled stones at the procession, which brushed past the statue of Lord Ram that was mounted atop an open truck.As groups clashed, the police — which had been deployed in advance on bandobast duty — swung into action even as additional officers were called in. Officials said that several tear gas shells were lobbed to disperse the clashing mob. Even as the police cordoned off the entire area, locals shut shops as cautionary measure.DCP Crime Saroj Kumari said, “We are yet to know what triggered the violence.”indianexpress

Patna: At least 20 shops were gutted in fire and more than 7 persons got injuries after a communal clash broke out in town area of Aurangabad district after stone pelting took place on a Ram Navami procession at Nawadih area. The procession, consisting of bike borne youths, was passing through Nawadih Colony under Town police station when miscreants pelted stone on it.Later in retaliation, at least 20 shops located at Ramesh Chowk were gutted in fire by the agitating mob. The chowk is hardly a kilometre away from the spot where stone pelting took place on the procession. Aurangabad DM Rahul Ranjan Mahiwal said that prohibitory ordered under Section 144 were issued as precautionary measures in town area and situation was under control.DM Mahiwal also said that stone pelting took place between two groups and an agitating mob torched some shops at Ramesh Chowk.Patna zonal IG Nayyar Hasnain Khan said that district armed police personnel were deployed in the area and the situation was brought under control."At least 5 rioters were arrested and several others were detained,"he added.TOI

Bhagalpur: Arijit Shashwat, son of Union Minister of State (MoS) Ashwini Kumar Choubey on Monday said he saw no need for him to surrender in a case of violence in Bihar’s Bhagalpur earlier this month. “Why should I surrender?Court issues warrant but the court also gives shelter. Once you go to the court, you will do only what it decides for you,” as quoted by ANI.An arrest warrant has been issued against Shashwat for allegedly inciting communal violence in the state of Bihar. Meerut;Leaders of several opposition parties on Sunday questioned the Yogi Adityanath-led BJP Govt ’s move to withdraw cases pertaining to 2013 Muzaffarnagar communal riots that claimed more than 60 lives and displaced over 40,000 people.“Why only 131 cases? If they really want to withdraw cases against innocent people, they should examine the cases against 7,000 villagers. Agra: Following the busting of a criminal gang run by former AMU students, the UP Police on Sunday asked the vice chancellor of the university to ensure that proper records of "entry" of students are maintained in their hostels and "CCTV cameras" are installed at all hostel gates.Aligarh police on Friday night had busted a gang of 9 well qualified youths, majority of them former students of AMU, who were involved in heinous crimes including attempt of murder and dacoity and were taking shelter in AMU hostels.SSP, Aligarh, Rajesh Pandey said that a letter has been sent to the university VC, Tariq Mansoor requesting him to take immediate steps in this direction.He said, during interrogation the arrested gang members had admitted that they took shelter in AMU hostel after committing crimes.He said, that all have admitted that they were involved in recent cases of violence connected with AMU campus, its student leaders and staff which include an attempt to kill former vice president, Nadeem Ansari, attack on AMU Pro VC, Prof Tabassum Shahab’s house and firing at SS North hall in AMU, in which one student was injured.According to police, the suspects were nabbed after a brief encounter near Firdaus Nagar on Friday night.TOI

Kochi: Trial in Wagamon SIMI camp case which began at the NIA Court here over a year ago is about to enter the final stage with the examination of the defence witnesses set to conclude next week. Delhi: Bail for 2nd accused in case of stone-pelting
New Delhi:A Delhi court has granted bail to the second accused, Javed Ahmed Bhat, in a terror-funding and stone-pelting case being investigated by NIA. Bhat, a 24-year-old resident of Qaimoh in Kulgam, used to sell crockery. He was arrested by the NIA on September 5 for alleged involvement in “anti-national” and “stone pelting” activities. NIA has alleged that his location was found to be near various encounters sites where stone-pelting activities were reported.Additional Sessions Judge Tarun Sherawat granted bail to Bhat, but a detailed order is yet to come. NIA had said that Bhat was arrested after prima facie witness statements on record against him. “Statements of 3 protected witnesses (public servants) under 161 CrPC has revealed that the applicant was present and an active participation in the offence of stone-pelting on security forces,”NIA had stated while filing the reply on Bhat’s bail plea.Bhat’s counsel MS Khan had argued in court that he was “wrongly and falsely” implicated. “He has never indulged in anti-national activities at any point of time, neither was he associated with any organisation nor participated in stone-pelting and that there is no material evidence available to this effect,” submitted Khan in his bail plea.indianexpress
UP encounters: Police claim accused tried to flee, family cries foul
Lucknow; Saharanpur Police said they shot dead a wanted man, Saleem alias Ahsaan (36), in an encounter at Mandi police station on Sunday. Police claimed to have recovered a 9mm pistol, eight cartridges, and a stolen motorcycle from the spot. According to police, Saleem, from Shamli’s Jhinjhana, was carrying a reward of Rs 25,000 for his arrest. The reward was declared on March 20 in a case lodged at Deoband police station on March 16, police added.In the cross-firing, police said SI Sachin Sharma sustained a bullet injury in his stomach, and is undergoing treatment at a private hospital in Sahranpur. Can’t wear abaya during training, Jammu medical school tells students, makes them sign affidavit
Students of Ancillary Medical Training School in Jammu have been asked to sign an affidavit barring them from wearing an abaya or a veil over their face during clinical training hours, Greater Kashmir reported on Sunday. An abaya is is a long, loose-fitting robe that may or may not cover a woman’s face.“I will maintain the dress code as per the policy of the institution,” the affidavit reads. “I will maintain the code of ethics as per the policy of the institution, and I will not wear an abaya or cover my face during clinical postings.”Students have criticised the medical school’s order. One of them said the “dictatorial order was “un-Islamic” and that students “will not do anything under compulsion”. Another student said they were scolded if they entered the institute’s premises wearing an abaya in the morning.“This is a Muslim state,” a student told The Kashmir Monitor. “We have to abide by the principles of our religion. We are in a shock as we fail to understand the reason for such an order. This is not France, or any other foreign country. Egypt: Police kill 6 people in connection to Alexandria bombing
Egyptian authorities said they killed six people on Sunday in connection to a deadly car bombing that targeted the coastal city of Alexandria's security chief. Blast occurred near Tolip Hotel on Saturday in Rushdi, a neighbourhood in Egypt's second city, close to the motorcade of Major-General Mostafa al-Nemr, head of security in Alexandria. The attack killed two soldiers.
