Do not pass any order
without hearing argument on demonetisation: Centre tells SC over PIL; plea to
be heard on 15 Nov
New Delhi:Centre on
Thursday filed a caveat in the Supreme Court asking it not to pass any interim
order without hearing its argument on the demonetisation issue. Centre today
filed a caveat in the Supreme Court that it be heard if the court entertains
any petition on demonetisation of Rs. 1,000 and Rs. 500 notes even as the apex
court indicated that it may hear on Nov.15 a plea challenging the govt decision. “Let it be listed on Tuesday if the
petition gets numbered by the registry,” a 3-judge bench headed by Justice AR
Dave said when a lawyer today sought urgent hearing of his plea on the ground
that demonetisation is causing a lot of problem to the common citizens. Modi
govt filed a caveat in the SC registry saying that it be heard if the court entertains
and passes some directions on the petitions. The plea was mentioned by advocate
Sangam Lal Pandey who has filed the PIL in his personal capacity. He has sought
quashing of the Nov.8 notification of the Department of Economic Affairs (DEA)
of Finance Ministry on the grounds that the common public had not been granted
sufficient time and as a result they are facing a lot of hardship. PIL has also
sought a direction to the Centre that sufficient time be given to the citizens
for exchanging the demonetised currency notes.Besides this petition, another
plea was filed yesterday in the apex court seeking quashing of the decision to
demonetise Rs. 1,000 and Rs. 500 currency notes on grounds that it infringed on
citizens’ right to life and to trade, among others.PIL filed by Delhi-based
lawyer Vivek Narayan Sharma, which could be listed for hearing during the week,
has termed the notification of DEA as “dictatorial” claiming it did not grant
reasonable time to citizens for exchanging the specified bank notes to
legitimate notes to avoid “large scale mayhem, life threating
difficulties“.PTI/india live today

Govt to re-introduce all
currency denominations with new designs, features
The govt will re-introduce
all currency note denominations with new designs and feature, economic affairs
secretary Shaktikanta Das said on Thursday, a move apparently aimed at draining
illegal cash from the economy. Govt sprang a surprise on Tuesday by withdrawing
Rs 500 and Rs 1,000 notes, causing an upheaval with millions of people holding
cash savings hurled into uncertainty. But the case will be different for smaller
denominations, Das said.“Let me make it clear, tender status of existing Rs
100, 50 or other denominations will continue to be legal,” the secretary said,
as quoted by ANI.“From time to time, new series of notes with new features and
designs will be infused in market.”Banks and automatic teller machines started
dispensing new Rs 500 and Rs 1000 notes from Thursday. The new banknotes
feature a radically new design, colour with additional safety mechanisms.HT
Deposits above Rs 2.5 lakh
to face tax, 200% penalty on income mismatch
New Delhi: Govt has warned
that cash deposits above Rs 2.5 lakh threshold under the 50-day window could
attract tax plus a 200% penalty in case of income mismatch. "We would be
getting reports of all cash deposited during the period of Nov.10 to Dec.30,
2016, above a threshold of Rs 2.5 lakh in every account."The (tax)
dept.would do matching of this with income returns filed by the depositors. And
suitable action may follow," revenue secretary Hashmukh Adhia said last night.Any mismatch with income declared
by the account holder will be treated as a case of tax evasion."This would
be treated as a case of tax evasion and the tax amount plus a penalty of 200%
of the tax payable would be levied as per Section 270(A) of the Income Tax
Act," he said. Adhia said small businessmen, housewives, artisans and
workers who had some cash lying as their savings at home should not be worried
about any tax department scrutiny. "Such group of people... need not worry
about such small amount of deposits up to Rs 1.5 or 2 lakh since it would be
below the taxable income. There will be no harassment by the Income Tax
Dept.for such small deposits made," he said.On people resorting to buying
of jewelery, he said persons buying jewelery has to provide the PAN
number."Action will be taken against those jewellers who fail to take PAN
numbers from such buyers. When the cash deposits of the jewellers would be scrutinised
against the sales made, whether they have taken the PAN number of the buyer or
not will also be checked," he added.PTI

BJP, its friends informed

Kejriwal
New Delhi: BJP and its
"friends" were informed about the demonetisation of high value
currency "a week before" the move was effected, especially keeping
the upcoming UP polls in mind, Delhi CM Arvind Kejriwal today alleged. Kejriwal questioned the logic behind the
introduction of Rs 2000 notes saying it will fan corruption and the black money
economy instead of containing it and that demonetisation has hit the common men
hard. AAP chief, in a video message, said a racket of commissions was thriving
across the country. The fault lies in their (government's) intentions, Kejriwal
said. In a series of tweets, Kejriwal
also took pot shots at an advertisement of Mobile payments firm 'Paytm' that
featured Prime Minister Narendra Modi's image, saying the company was the
biggest beneficiary of the move. "There is evidence that their (BJP)
friends and own people were informed a week before the decision was announced.
They have made all arrangements like buying property or gold. BJP is going to
fight polls in Uttar Pradesh and other states. It has made arrangements.
"Common men are the only ones suffering. I spoke to many people, they told
me that black money holders have done settings already. Money will be delivered
to their homes in lieu of 15 to 20 per cent commission," Kejriwal said.
"Utterly shameful. Do people want their PM to model for pvt cos? Tomo, if
these cos do wrongdoings, who will act against them? Paytm biggest beneficiary
of PM's announcement. Next day PM appears in its ads. Whats the deal, Mr
PM?" Kejriwal said in a series of tweets. economictimes

Shiv Sena slams PM Modi

Mumbai:Shiva Sena hit out at PM Narendra Modi over the
demonetisation of Rs 500 and Rs 1,000 notes, saying ever since the surgical

Modi's decision is a joke,
calamity and a brake on Indian economy: Kerala Finance Minister
Coming down heavily on the
central govt for its decision to scrap Rs 500 and 1000 notes, Kerala Finance
Minister Thomas Isaac has called the decision a joke, a calamity and a brake on
the economy. Isaac said that the decision will bring the economy to a
standstill."It is going to disrupt economic life. The whole economy is
going to be on a standstill. It makes no sense. The reason that this is done to
battle counterfeit notes from Pakistan does not hold water," said
Isaac.Criticizing the decision further, Isaac said "If the PM is thinking black money is held in cash in
almirahs in India, then that's not right. Major proportion of black money is
stacked abroad, the rest is invested in gold or other precious metals and
properties. It is ordinary people who keep cash in hand," he added. india

Ramping up defence ties to

New Delhi: Further
deepening the already close defence ties will be a major focus of Israeli
President Reuven Rivlin's 8-day trip to India beginning Monday during which
both sides are also set to ink a number of MoUs to expand cooperation in areas
of energy, agriculture and trade.Ahead of Rivlin's visit here, first by an
Israeli President in nearly two decades, the Jewish country's envoy Daniel
Carmon said the bilateral defence ties were beyond buyer-seller and
military-to-military relationship and the message will be to broaden it further
besides boosting cooperation in some other sectors.During his stay, the Israeli
President will hold extensive talks with his Indian counterpart Pranab
Mukherjee and PM Narendra Modi covering key bilateral and regional issues
besides attending a ceremony in Taj Hotel and Chabad House in Mumbai to pay
tribute to victims of 26/11 attack in which 6 Jews were also killed. On defence
cooperation, Carmon said Israel has plans for fresh joint ventures and
technology transfer in developing weapons systems and ensuring implementation
of Modi's Make in India initiative in the key sector which is a "major
facet" of his country's "special relationship" with India.Asked
about Modi's proposed visit to Israel, he said it will happen and will be a
very important trip.It was being decided by the two governments when it will
happen, the envoy said. There were indications that the PM may visit Tel Aviv in
the first part of 2017 which will be the 25th year of formal diplomatic ties
between the two countries. India had established "full" diplomatic
relationship with Israel in 1992 though it had recognised the country in
1950.President Rivlin will head business and academic delegations including
chancellors of 12 Israeli universities as well as Israeli companies, some of
which are already active and successful in India.PTI

Court today held as unconstitutional the state govt ’s law to terminate a
water-sharing agreement with other states by constructing the Satluj-Yamuna Link

Presidential Reference, opining that Punjab cannot terminate agreement
unilaterally and its 2004 Act was hence unconstitutional. Bench led by Justice
Anil R Dave, reading out the verdict in the court, said that all the questions
referred to it by President have been answered in negative. This effectively
meant that Punjab’s attempt to wriggle out of the agreement to share water with
Haryana, Delhi and other states has been shot down. The Constitution Bench
judgment also restores the 2004 decree passed by the Supreme Court, directing
Punjab to construct the SYL canal on its territory. Protesting against the

Mega protest by tribals in
Ranchi jolts Jharkhand govt, sparks ‘conversion’ row:HT
Ranchi: Jharkhand govt
plans to crack down on misuse of funds and what it calls forcible conversions
of tribals by Christian missionaries after a report accused the Church of
inciting the state’s sizeable population to block development schemes.Alarm
bells were set ringing in the power corridors of Ranchi last month after a
massive tribal protest against proposed changes in the state’s land acquisition
law — demonstrations that the govt says
were planned and funded by Christian missionaries with foreign money. On
Sept.15, more than 100,00 tribals converged in Ranchi to protest against 2
ordinances that proposed acquisition of tribal agricultural land for
development purposes such as roads, schools, hospitals and flyovers.Never
before had the state seen such a huge congregation of tribals — who account for
more than a quarter of the state’s population — in the capital on a
non-political platform daring the govt. A little known Adivasi Buddhijivi Manch
(ABM) — Tribal Intellectual Cell — headed the protests.A shocked state
govt asked its special branch to probe
the protests. The branch’s report says the rally was conceived and executed by
the churches, who are allegedly using foreign funds meant for development work
to incite tribal unrest.Senior RSS functionary Indresh Kumar has demanded a
‘surgical strike’ against conversion. However, many Christian groups and
tribals say the report is fabricated and is being used by the ruling BJP to
target minorities. “CM doesn’t have any understanding of tribal society,”said
ABM head Premchand Murmu, man who apparently led Sept.15 protests. He said if
conversions were happening, the Christian population in the state would not
have been merely 0.43%. “Christians constitute merely 5.8% of the total tribal
population while 37% tribals were enlisted as Hindus in census columns against
their wishes,” he said.He accused the state govt of turning a blind eye towards the alleged
forcible conversions of tribals, who mostly follow the Sarna religion, into
Hindus by the RSS and other right wing groups.“CMis threatening the minority
community in the state. Instead of finding a solution to the rising protests
over controversial land ordinance, he is trying to divert attention by raising
the conversion issue,” Adivasi Sangharsh Morcha (ASM) convener Karma Oraon

Donald Trump losing popular
vote as Hillary gets 47.7% & Trump 47.5%
Hillary Clinton has won
more votes than Donald Trump, but there is no chance that she will become the
new president. The Democratic candidate looks almost certain to win the popular
vote, with the final ballots left to be counted. Margin is small – with only
0.2% points between the two candidates – but Ms Clinton is winning and looks
set to continue to do so. On the morning after election night, Ms Clinton had
collected 59.4 million votes, giving her a 47.7 % share, while Trump had 59.2 million votes and
a 47.5 % share. Independent UK
