Won’t impose yoga on
anyone: Supreme Court rejects PIL to make it mandatory in school curriculum
New Delhi: The Supreme
Court has said that it will not impose yoga on anyone and refused to entertain
a PIL seeking to make it mandatory in the school curriculum."Go and
persuade people to take up yoga. If people want, they will pick it up
themselves. It is for the govt and
academicians to decide what should be included in the school curriculum,"
a bench of Chief Justice TS Thakur, Justice DY Chandrachud and Justice LN Rao
said.Petitioner and advocate Ashwini Upadhyay had engaged 2 senior advocates —
MN Krishnamani and V Shekhar — and later jumped into the arguing arena himself
in an attempt to convince the bench to seek answers from the Centre. But the
bench refused to entertain the petition while permitting the petitioner to
intervene in a pending petition filed by advocate JC Seth on the same issue
that will be taken up for hearing on Nov.29.At the beginning of the hearing,
the CJI made light of Upadhyay’s petition by asking Krishnamani, “In this
polluted atmosphere, are you racticing yoga?Can you name an ‘asana’?
Krishnamani named ‘pranayam’ as one yoga but the bench was unimpressed. To test
the senior advocate’s knowledge in yoga, CJI asked, “What is the last asana
done after a yoga session?” Krishnamani failed to answer it. CJI said it was ‘shavasana’,
one which everyone who does yoga loves to do as it is relaxing. Finding
Krishnamani’s knowledge on yoga limited, the CJI said,“You are espousing a
wrong cause.”

‘unconstitutional’ triple talaq, polygamy in affidavit to SC
New Delhi:National
Commission for Women has demanded a ban on instantaneous triple talaq or
talaq-e-bidat and polygamy in its affidavit to Supreme Court on the grounds
that these practices are against the rights of Muslim women. “Triple talaq
(talaq-e-bidat), nikah halala and polygamy are unconstitutional because they
compromise the rights of Muslim Women (or of women who are married into the
Muslim community) to their disadvantage, which is detrimental to them and their
children. Therefore, these practices should be strictly prohibited,” reads the
affidavit.The affidavit adds that the Commission supports the stand taken by
Centre in the Supreme Court last month. “National Commission is herein
supporting the stand taken by the Union of India and is adapting the affidavit
filed by them.” NCW said that its submission before the court comes in the
backdrop of several complaints made to it by aggrieved Muslim women. “The
Commission is partaking of a large number of cases relating to women who have
been at the receiving end of the practice of unilateral talaq.”NCW is a
respondent in a case in SC on triple talaq and submitted its affidavit. PTI

Chairman B S Chauhan, a retired Supreme Court judge, has stressed that the
Uniform Civil Code (UCC) should come step-by-step from the people instead of
knocking out the personal laws applicable to people of various religions for
centuries in one shot. He said the commission won’t impose its views on the
stakeholders in a report sought by the Centre on a directive last year by the
Supreme Court, pointing out that even Article 44 of the Constitution is in the
form of a suggestion and not a directive or mandatory injunction as it says
“the State shall endeavour to secure for the citizens a uniform civil code
throughout the country of India.” Even the recommendations of the law
commission, a statutory authority created through an Act of Parliament, are not

host a mega rally of Muslim leaders from across the country to drum up support
for their battle against the Centre’s bid to do away with personal laws and
replace them with a Uniform Civil Code.While the organisers of the 3-day
conclave, culminating in a public meeting on Nov.20, told HT that the turnout
could well cross quite a few lakhs, around 350 delegates are to attend the
convention and the meeting at Park Circus Maidan. They include prominent
national level leaders of community like MP Asaduddin Owaisi and Jamiat
Ulema-i-Hind president Maulana Syed Hussain Ahmad Madani. Rooms in more than 70
hotels have already been booked for the delegates. Giant screens will be put up
in different parts of the city as the meeting ground won’t be able to
accommodate more than 1.5 lakh people at the most. Incidentally, quite a few

Mumbai: With no complaints of
cheating or duping of funds so far against the IRF, the NGO run by Dr Zakir
Naik, the Mumbai Police has closed its probe in the case. “For us to probe the
irregularities, we require a complaint. In the IRF case, the Rs 60 crore
donation which has been found to be suspicious, no one has come forward to
lodge a complaint that they have been cheated or the money was fraudulently
obtained by IRF. In the absence of a complainant, we have closed the case,” a
senior official from the State Home Dept.said. A probe was ordered by the
Maharashtra Govt after reports appeared of two terrorists in the July Dhaka
bombings being inspired by Naik. “During the probe, we came across one local
bank account in which over Rs 50-Rs 60 crore had been transferred from middle
eastern countries. This account allegedly belonged to a relative of Naik. When
probed deeper, we found out that funds were subsequently transferred to the
accounts of Naik’s wife, his children and even some of his close relatives,”
said the official from the State Home Dept., who spoke on the condition of
anonymity. Agencies had also identified 4 shell companies allegedly controlled

New Delhi: The ball is now
in the govt 's court as the Supreme Court on Tuesday refrained from hearing
NDTV's petition against a 1-day telecast ban on Nov.9, now put on
hold."What is there now? We have read in the newspapers that the ban is
already put on hold," Justice AK Sikri, the lead judge in the Bench also
comprising Justice NV Ramana, remarked. Both NDTV counsel and senior advocate
Fali Nariman and Attorney General Mukul Rohatgi confirmed the position to the
Bench.The court did not issue notice or indulge further in the case, which had
come up for hearing as a mentioning matter. The court posted the matter for

NDTV ban on hold until we

New Delhi:Ministry of I&B
put on hold its decision to take NDTV India off air for a day on Nov.9 after
the TV channel made a “representation in this regard”. The order came after 4
NDTV officials, including its co-founder Prannoy Roy, met Union Minister for
I&B M Venkaiah Naidu. It is learnt that I&B Secretary Ajay Mittal and
PIB DG Frank Noronha were also present at the meeting. Order by Director
(Broadcast Content) Neeti Sarkar stated:“Channel has made representation in
this regard,which is under examination. Pending such examination, it is hereby
ordered that operation of the said order be held in abeyance till further
orders.” Sources said Prannoy Roy, at the meeting with Venkaiah Naidu,
requested that the I&B order be put on hold. He was said to have pointed
out that NDTV’s point of view had not been fully appreciated in the right
perspective by the inter-ministerial committee (IMC) which recommended the ban.
Sources said Naidu acceded to the request till disposal of the appeal and had a
detailed discussion with Roy on different aspects of NDTV India’s coverage and
IMC recommendation. Earlier, representatives of Editor’s Guild of India, Indian
Women’s Press Corps, Federation of Press Clubs, Delhi Union of Journalists,

Raipur: Delhi University
(DU) professor Nandini Sundar has been booked along with a professor of JNU and
others on charges of murder of a tribal villager in the insurgency-hit Sukma
district of Chhattisgarh, police said Tuesday. “An FIR was lodged against DU
Professor Nandini Sundar, Archana Prasad (JNU Professor), Vineet Tiwari (of
Delhi’s Joshi Adhikar Sansthan), Sanjay Parate (Chhattisgarh CPI (Marxist)
State Secretary) and others along with Maoists for the murder of Baghel based
on the complaint of his wife on Saturday,” Inspector General of Police (Bastar
Range) SRP Kalluri told PTI. They were booked under sections 120 B (criminal
conspiracy), 302 (murder), 147 (punishment for rioting), 148 and 149 of IPC at
Tongpal police station, the IG said, adding, “strongest possible action will be
taken against those guilty after the investigation”. Though the case was
registered on Saturday, the matter came to light late Monday evening.PTI

Petlawad (jhabua): A 4-page
report prepared by Petlawad police on last month’s communal tension in the town
accuses RSS zila sah karyawah Akash Chouhan and his father Mukut of trying to
“polarise Hindu voters” to win the upcoming Petlawad nagar panchayat elections.
“They want to cause communal violence and win the election by polarising Hindu
voters. By their untiring efforts, the police foiled their attempts to cause
violence,” says the report, signed by subdivisional police officer Rakesh Vyas
and submitted to Jhabua SP Sanjay Tiwari. Blaming the Chouhans for the communal
tension in Petlawad from Oct.12 to 14, and for other instances, the report adds
that they could not register the cases “from [an] administrative point of
view”, “due to their [the Chouhans’] RSS background”.Says the confidential
report, “Uprokta sabhi ghatnaon me apradh panjibadhha hona the. Lekin inki RSS

Kinshasa:An explosion
killed a child and injured 32 Indian peacekeepers in the eastern Democratic
Republic of Congo city of Goma on Tuesday, the UN mission there said.The blast
hit the peacekeepers while they were out on a morning run in the western Goma
neighbourhood of Keyshero, the mission added. The cause was not immediately
clear.Ismael Salumu, an imam at a nearby mosque, said three peacekeepers were
killed. “We just heard the explosion and the cries. We then ran over to see,”

Bengal records more Muslims
in govt jobs: thehindu
Kolkata: TMC govt in Bengal
and the Left Front are both claiming credit for a rise in the percentage of
Muslims in govt service in the State.A recent census conducted by the State
administration showed a rise in the percentage of Muslims in govt jobs, but employee numbers are drastically
down overall. Of 3,31,249 govt employees
in Bengal, 18,991 are Muslims, making up 5.73 %. Muslim population is a little
over 27% as per 2011 Census.Nearly a decade ago, during the Left Front regime,
the Justice Rajinder Sachar Committee report on social, economic and
educational status of Muslims created ripples. Committee report said there were
4.7%Muslims (Groups A and B) and 2.1 % in (Groups C and D) in govt jobs, averaging about 3.4% . The number of
Muslims with govt jobs is a politically
sensitive issue for both the Left Front and TMC.
Delhi’s Muslim areas have
higher school dropouts
New Delhi:50% of the
children living in Delhi’s Muslim dominated area Jamia Nagar drop out of school
at various age groups, this number is more than double as compared to the
drop-out rate of children in entire Delhi. Among those who are attending
school, 79% of the children do not get proper education due to lack of
facilities. Fact that has been revealed in a report by IOS, a think-tank that
deals with minority issues, is shocking as Jamia Nagar is considered better
than other Muslim localities in terms of the socio-economic strata.Jamia Nagar
is a part of a larger Muslim-majority area “Okhla”, which officially has a
population of around 1.2 lakh.Reason, according to report is the inadequate
number of govt schools and lack of awareness among people. There are three
municipal corporation-run primary schools and two govt -run senior secondary
schools. The number is clearly inadequate in light of the population, the
report says.The survey was conducted recently in 14 areas in Jamia Nagar
including Zakir Nagar, Abul Fazal Enclave, Shaheen Bagh, Okhla Vihar, Batla
House and others by professors from IOS. This number is much higher than the
overall drop-out rate of the entire Delhi, which was 21.57 % in the year

Bijnor: 2 months after
being on the run, rape-accused Bijnor cleric Maulana Anwar-ul Haq surrendered
in court on Monday. He was later taken into judicial custody for 14 days and
sent to jail.The cleric reached the court of CJM around 11:30 am and
surrendered.He was accompanied by a large number of supporters, and a heavy
police force was deployed in and around the court premises. Talking to media persons, the imam said,
"I was framed in a false case. I am innocent and believe in the judicial
system. I hope I will get justice soon.”On Oct.3, police had announced a cash

to come up with a Common Minimum Programme in 48 hours on how to tackle the

have a CM’s Cow Welfare Fund, Home Minister Gulab Chand Kataria said on Monday.
The announcement came after the HM chaired a meeting of the cabinet
sub-committee that made the recommendation, among several others, on cow
welfare.Kataria said the CM’s Cow Welfare Fund or Mukhyamantri Gau Sanrakshan
Kosh will be funded by introducing 10% surcharge on mandi tax, by reserving 5% of corporate social responsibility funds and
levying 5% surcharge on temple trusts under

at helping RSS and BJP propaganda about the killings. "Your selection of
Justice SK Pandey is neither fair nor impartial, but tainted to help the
propaganda of RSS and BJP about the encounter," senior advocate and former
advocate general Anand Mohan Mathur said in a letter to the CM ."As far as
I know, and this can be verified from various sources in Jabalpur, Indore and
Gwalior that Justice Pandey has been a sympathizer and supporter of RSS and
BJP, therefore, Justice Pandey will not be an impartial judge of inquiry under
the Inquiry Commission Act," he said. Mathur's allegations came at a time
when right wing activists staged a protest near his house on Monday against his
plans to form a human chain in Indore after jailbreak demanding appointment of
a Supreme Court Judge to head the encounter. The activists accused Mathur of
backing SIMI activists by attempting to form the human chain at Regal Square
here on Nov.5. But Mathur and his fellow protestors were stopped by the police.
Mathur referred to the police action in his letter and said due to repression
of govt and arrest of large number of his fellow protestors, the chain could
not be formed. The human chain was planned to push for appointment of Supreme
Court judge to probe the encounter because '8 prisoners, who are citizens of
India, have been killed by your administration'.He also accused PM Modi of
controlling print and electronic media. Mathur also demanded that FIR lodged in
encounter case and the post-mortem reports should be made public. Information
about the circumstances in which the head constable was killed should also be
revealed. "People of Madhya Pradesh want and answer from you so that
neither the FIR nor the post-mortem report could be manipulated," Mathur

to protest against the encounter, whose veracity has been questioned by many
individuals and groups. A number of social activists were also intercepted by

in an encounter late last month has contested police claims that the prisoners
had unlocked the cell from inside with makeshift keys. Mohammed Khalil, 40, is
the nephew of Mohammed Aqeel Khilji, one of the 8 men killed. Khalil said he
was imprisoned in the same barracks of the jail for five months between Oct.

Bhopal:Under pressure,
Bhopal Central Jail authorities have put all the inmates under a strict
regimen, a week after eight SIMI men were gunned down following their escape
from the high-security prison.Jail officials, many of whom have taken charge
recently, are adhering to the jail manual religiously not wanting to leave any
room for mistakes. According to sources, not only the remaining 21 SIMI
operatives, but all the other prisoners have been put under a strict
regimen.“Senior officers check the cells of non-SIMI inmates also,”a source
said, adding that mobility of nine SIMI operatives in Block B has been totally
restricted.Restrictions have also been imposed on bringing in food items.“They
(inmates) cannot bring in huge quantity of food at one time,” source said,
stressing that the jail manual is being adhered to at every step.Authorities
have put a complete ban on heating of food inside the cells. Reportedly, the
slain men had made keys for the locks of their cells by heating plastic tooth
brushes with rotis.“No one could ever imagine that the SIMI cadres were burning
the extra rotis to heat plastic tooth brushes to make keys,” the source said.HT
