Govt’s stand on triple
talaq, polygamy under Sharia to figure in law panel report
New Delhi: Gov’s recent
arguments in the Supreme court against the practice of triple talaq and
polygamy under Sharia law are likely to figure prominently in the Law
Commission’s report on having uniform civil laws for all Indians irrespective
of their faith or personal law, informed sources have said.Last week, in a
29-page affidavit to the SC, Centre said the practice of triple talaq and
polygamy is unreasonable, discriminatory and denies gender justice enshrined in
the Constitution. “We are studying the government’s response closely,” a member
said. The commission last week had a full-strength meeting on issues pending
before it, including a reference from the govt in June asking the commission to
explore whether the time is ripe for enforcing common civil laws.“Law
commission reports are read and referred in courts, they cannot be prepared in
a hurry,”Law Commission chairman Justice (retired) Balbir Singh Chauhan
said.“We will wait for the Supreme Court’s judgement on Triple Talaq and
maintenance before completing our report,” he added. The commission has time
until August 2018 to submit reports on matters pending before it.Currently,
criminal laws in India are applied uniformly but different personal laws govern
different communities in matters such as marriage, divorce and transfer of
property. Ruling BJP has long argued for a uniform civil code.“The Supreme
Court itself has said in the past that the time has come for uniform civil
laws. The commission is involved in an academic exercise, studying the
constitution and seeing if these practices are in consonance with it,” the
member said. The panel is studying previous judgements. The panel has begun a
45-day exercise of seeking comments from the public and stakeholders on the
matter. After the suggestions are received, they will be discussed within in
the panel and experts. hindustantimes

Govt is clearing a way for
Uniform Civil Code through triple talaq : Jamiat Ulama
New Delhi: Strongly
condemning Central government’s affidavit filed before Supreme Court that
opposes practice of triple talaq and polygamy, Jamiat Ulama-e-Hind (JUH) called
it NDA govt’s first move towards implementing Uniform Civil Code. Centre on
Friday opposed the practice of triple talaq and polygamy in the Supreme Court
and said it can't be regarded as an essential part of religion. Maulana Arshad
Madni, President of Jamiat reacted sharply to Centre’s stand and said by
interfering in Muslim Personal laws under the pretext of gender equality, the govt
is making its way clear for implementing Uniform Civil Code. “Muslim Personal
laws are based on Islamic scriptures mainly Quran and Hadees which cannot be
replaced and hence there is no scope of interference in these laws. We reject
govt’s stand opposing these laws that are prevalent in the country since its
inception during British era. This is for the first time that Indian govt has
opposed these laws and hence clearly reflects its ambition of implementing
uniform civil code”, Madni said in a press release. He also said that Jamiat is
the oldest Muslim body that was also functioning during country’s independence
struggle and then it was agreed by Mahatma Gandhi and Pandit Nehru that
minorities will be given freedom to practice their personal laws. “I am sure
99% Muslims in the country will want no interference in these laws. With the
help of Personal Law Board and other organizations Jamiat will continue
awareness campaign among Muslims. We will tell them to express their views
before law panel”,he said.TCN

Muslim leaders had earlier pointed out that Section 44 of the directive

China justifies its stand
on Masood Azhar, warns India against using counter-terrorism for ‘political
gains’
In an apparent snub to
India, Chinese authorities have warned that no country should use counter-terrorism
as a tool for “political gains”. The statement comes in the wake of India’s
attempt at getting Chinese help to declare Jaish-e-Mohammad chief Masood Azhar UN-designated
terrorist. Indian authorities have been trying to persuade China in this regard
but the latter have opposed it in the UN Security Council, even as the Indian
proposal has the backing of countries like US and Russia. PTI quoted China as
saying, “No one should pursue ‘political gains in the name of
counter-terrorism’.Ban on Azhar will expectedly come up for discussion during
the upcoming visit of Chinese President Xi Jinping to India for the BRICS
Summit. PTI today reported China as saying that it is “ready” for talks with
India on its entry into the NSG but defended extending a hold on India’s bid
for a UN ban on JeM chief Masood Azhar, saying Beijing is opposed to anyone
making “political gains in the name of counter-terrorism”.Briefing reporters on
Xi’s visit to India this week, China’s Vice Foreign Minister Li Baodong said there
was a need to build consensus over the admission of new members in the
48-member NSG.Replying to a question on criticism about China’s move to stall
India’s bid for a UN ban on Azhar, Li sought to justify Beijing’s recent
technical hold in the matter, saying: “China is opposed to all forms of
terrorism. There should be no double standards on counter-terrorism. Nor should
one pursue own political gains in the name of counter-terrorism,” he said in a
veiled reference to India, which is pressing for the UN ban against Azhar over
his role in the Pathankot terror attack. financial express

Kashmiris instead of drowning them in anti-Pakistan hysteria. They were speaking
at a conference in New Delhi at the launch of noted journalist, Urmilesh’s
Hindi book ‘Kashmir: Virasat aur Siyasat’, which is the first-ever book in
Hindi that covers Kashmir’s entire modern history, different phases of
‘Kashmir’s freedom struggle’, era of Sheikh Muhammad Abdullah, and militancy

aspects of life in India, which includes another volume on Kashmir, ‘Jhelum
Kinare Dahakte Chinar’, a travelogue, which earned him Hindi Academy Award. The
experts at the conference stressed that India must acknowledge that people of
Kashmir were anguished and called upon an urgent need to responding to their
cries compassionately. During the meet most speakers expressed grave
apprehensions about “Kashmir slipping out of India’s hand”.The experts felt it
was completely wrong to analyze ‘our internal problem merely as Pakistani
mischief’ and pleaded with GoI to address the concerns of Kashmiris instead of
“diverting attention through war-mongering”.Speaking on the occasion, veteran
journalist and Kashmir interlocutor,Kuldeep Nayar said, “Current problem is exceptional
as the separatist leaders have lost credibility and the completely alienated
youth have come to the forefront of protest.”Expressing deep anguish over war
hysteria and the irrelevant noise over Kashmir in the media, documentary
filmmaker and prominent Kashmir Pandit, Sanjay Kak said, “Despite so much
noise, there is silence on Kashmir and nobody is willing to understand the
nature of Kashmir problem.”Eminent journalist Prem Shakar Jha apprehended
J&K was slipping out of hand and felt only an out-of-box solution could
salvage the situation.Ex-interlocutor MM Ansari also spoke on the occasion.

New Delhi; In the wake of
the escalation of a war of words between the BJP and the Congress following a
revelation that Indian Army had conducted a surgical strike on Pakistani
military outposts earlier in 2011, ex-external affairs minister Salman Khurshid
on Monday said his ex cabinet colleague P. Chidambaram made this disclosure to
put the record straight as the incumbent regime was trying to create an
impression that the UPA did nothing in its tenure.“This has been said very
categorically by ex-home minister Chidambaram and it’s also been validated and
repeated by other people. This has been said only for this purpose that an
impression was being created by the govt of the day that we never did anything
when we were in power, I think that was unfair,” Khurshid said. “And just to
put the record straight, Chidambaram and others have put this out in the public
domain and I am glad it is being done,” he added. Stating that it would be
unfair to discuss this matter any further, Khurshid said,“Since we have said
that these are operational details that we don’t discuss, we only credit the
army and give the army the opportunity to take whatever steps are to be taken
whether it was then or now,we will leave it at that.” ANI

Ahmedabad: Ex-Gujarat High
Court judge, Justice (retd) Behram Jahanbux Sethna, Sunday said terrorism was

Justice Sethna had hit the headlines in Jan.2004, after a 2-judge bench headed

the 21 accused in the Best Bakery case in which 14 people were burnt alive

finally punished. He was speaking at the launch of the NGO, Justice for Victims

the Sohrabuddin Sheikh and Ishrat Jahan encounter cases, and other retired IPS
officers, including former Gujarat DGP SS Khandwawala, KP Raghuvanshi, among
others. NGO aims to “provide financial and legal aid to victims of terrorism as
well as to family members of the accused named for terror activities”.Referring
to the reversal of his judgment by the Supreme Court in the Best Bakery case,
he said, “Terrorism sirf terrorists hi nahi karte, judicial terrorism bhi hai.
(Terrorism is not perpetrated by terrorists alone, there is judicial terrorism
also).” Sethna said that the lower court in Vadodara had acquitted all the
accused after the complainant, Zahira Sheikh, had turned hostile. indian

US funding 'Israeli state
terrorism' in military deal: Al Jazeera
Last month, US signed a
$38bn record military aid deal with Israel, described as the "largest
single pledge of military assistance in US history to any country".
Traditionally, US military aid is provided to Israel on the provision that the
bulk of the money is spent on US war machinery and weapons. As such, many of the
warplanes, rifles and bullets that Israel uses against Palestinians, often in
ways that may amount to human rights violations, are manufactured and supplied
by US. While US domestic law under the Foreign Assistance Act states that
"no security assistance may be provided to any country the govt of which
engages in a consistent pattern of gross violations of internationally
recognised human rights", no US administration since 2000 has held Israel
accountable.US has continued providing unprecedented amounts of military aid to
Israel, the largest recipient of US foreign aid, in violation of its own

Afghan Taliban chief Haibatullah taught, preached in Pakistan
Kuchlak: For 15 years until
his sudden disappearance in May, the new leader of the Afghan Taliban
insurgency openly taught and preached at Al Haaj mosque in a dusty town in
southwestern Pakistan, associates and students told Reuters. Details of
Haibatullah Akhundzada's life in Kuchlak, near the city of Quetta, have not
previously been reported, and could put further pressure on Pakistan to do more
to crack down on militants openly living there.A spokesman for the US State
Dept's South Asia bureau said it was not "not in a position to confirm Haibatullah
Akhundzada's whereabouts, past or present." Akhundzada is now believed to
be in hiding after crossing the long and porous border between Pakistan and
Afghanistan, but not before going untouched in Kuchlak, located in Baluchistan
province, as he rose up the ranks of the Afghan Taliban. He was promoted to
"emir" in May after a US drone killed his predecessor, Mullah Akhtar
Mansour, in another part of Pakistan, a strike that infuriated Islamabad but
reflected growing impatience over what Washington sees as ambivalence towards
its enemies."Once he became Emir, he left with his whole family,"
said Hafiz Abdul Majeed, who runs the Al Haaj mosque, adding that he himself
studied for several years under Akhundzada.Analysts say Pakistan has
historically backed the Afghan Taliban as a hedge against the influence of
arch-rival India, with whom Pakistan has fought 3 wars, in its backyard.
Pakistan denies this."I strongly reject any organised presence of Taliban
in Baluchistan," Sarfaraz Bugti, home minister for the province, told
Reuters. At the Al Haaj mosque, scores of teenage boys wearing turbans and
traditional "shalwar kameez" robes attended classes at a religious
school, typical of remote parts of Pakistan, where they provide education for
millions of boys.Asked how someone closely associated with the Taliban could live
so openly, Majeed replied: "He was just a man of faith. He was a
'Sheikh-ul-Hadith' (scholar of Hadith). And when he became Emir, he left here.
