Karnataka: As SC clears path to contest bypolls,
all 17 disqualified MLAs to join BJP tomorrow
New
Delhi:After the Supreme Court upheld the disqualification of 17 Congress-JD(S)
MLAs in Karnataka but paved the way for them to contest the December 5 bypolls,
disqualified MLA Ramesh Jharkiholi said all of them would join BJP on Thursday
at the party headquarters in Bengaluru. “All 17 of us will join the BJP in the
party HQ in Bengaluru on Thursday at 10.30 am,” Jharkiholi said.Earlier,
Karnataka Deputy Chief Minister Ashwathnarayan CN said the disqualified MLAs
were welcome to join BJP. “They (disqualified legislators) have expressed
interest to join BJP and have met our senior leaders. They have been welcomed
to join the party,” PTI quoted Ashwathnarayan as saying. The Supreme Court today
upheld then Karnataka Assembly Speaker KR Ramesh Kumar’s decision disqualifying
17 MLAs, which eventually led to fall of Congress-JD(S) government. However,
the SC set aside the portion of the order by the then Speaker by which the
legislators were disqualified till the end of 15th Karnataka Assembly’s term in
2023.The verdict is of high importance to the politicians as byelections to
their 15 of their respective seats – except Rajarajeshwari Nagar (N Munirathna)
and Maski (Pratapgouda Patil) – have been scheduled for Dec.5. Earlier,
Karnataka Congress president Dinesh Gundu Rao said, “If BJP has any morality
left, they should not give tickets to disqualified MLAs to contest.”indianexpress
‘BJP morally bankrupt’: Congress calls for
dismissal of Yediyurappa govt after SC verdict
Congress
has sought the dismissal of BS Yediyurappa-led BJP government in Karnataka
after the Supreme Court upheld ex Speaker KR Ramesh Kumar’s decision to
disqualify 17 MLAs belonging to Congress and JDS in July. State Congress leader
and former Chief Minister Siddaramaiah welcomed the top court’s judgement,
saying it proves that the MLAs had defected with ulterior motives. “The
defection is not voluntary and not genuine,” he added. “Once an MLA is elected
in a democratic setup, they can’t switch parties as they wish.”The verdict
“exposes the moral bankruptcy of BJP leaders and the disqualified MLAs”, he
added. “Operation Kamal is now a proved act and there is nothing more shameful
than this.”“Supreme Court’s decision upholding the disqualification of
‘defector MLAs’ has burst the bubble of BJP’s ‘Operation Kamal’,” tweeted
Congress spokesperson Randeep Singh Surjewala, echoing Siddaramaiah. “It is now
proved that BJP brazenly and illegally brought down an elected JD(S)-Congress
government in Karnataka. Yediyurappa government is an illegitimate government
and should be dismissed.”Surjewala also called for an inquiry into the
“sinister conspiracy of the BJP to bring down an elected government by misusing
‘money power’”. Congress leader said the ball was in PM Narendra Modi’s court
and wondered if he will “show the courage of conviction to dismiss Yediyurappa
government”.Senior national Congress leader Abhishek Manu Singhvi also said the
Yediyurappa government had no moral right to continue in office, PTI reported.

Office of CJI to come under RTI: SC
New
Delhi :Upholding the 2010 Delhi High Court verdict, the Supreme Court today ruled
that the office of CJI was a public authority under RTI. While cautioning that
RTI cannot be used as a tool of surveillance, CJI Ranjan Gogoi-led bench held
that judicial independence had to be kept in mind while dealing with
transparency. In 3 separate but concurring judgments, the Supreme Court bench,
also comprising justices NV Ramana, DY Chandrachud, Deepak Gupta and Sanjiv
Khanna, dismissed the 3 appeals filed by the Secretary General of the SC and Central
Public Information officer of the SC.The Supreme Court’s Central Public
Information Officer had appealed against a January 2010 ruling of the Delhi
High Court that held that the Supreme Court and CJI are “public authorities”
under RTI.The SC said only names of judges recommended by Collegium could be
disclosed and not the reasons, holding that method of appointment had an impact
on the independence of the judiciary.indianexpress

to pass judgment tomorrow

Delhi :The Supreme Court will tomorrow pronounce its judgment on review
petitions challenging its order in the Sabarimala and Rafale cases. After the
Ayodhya verdict, these are the next set of high-profile cases that will be
signed off by CJI Ranjan Gogoi, who is retiring on Nov.17.In the Sabarimala
case, a five-judge bench including CJI will review the Supreme Court’s
Sept.2018 ruling that had lifted a ban on menstruating women from entering the
Sabarimala temple.On Sept.28, 2018, a 5-judge bench headed by then CJI Dipak

BABRI MASJID VERDICT
Ayodhya Mandir Trust: Split wide open among
different mahants, Akharas
Mahants
and sadhus connected with the Ayodhya Ram temple movement have expressed
differing views over the composition of the trust for Ram Mandir in Ayodhya to
be set up by the union government. President of Ram Janmabhoomi Nyas Mahant
Nritya Gopal Das said there is no need for forming a new trust by the
government as one trust (Nyas) already exists for the construction of Ram
temple.Ram Janmabhoomi Nyas is run by the VHP.Mahant Nritya Gopal Das, in a
statement, said: "The trust (Ram Janmabhoomi Nyas) already exists, we can
give a big shape to it, new members would be added as per need."Mahant
Suresh Das, mahant of Digambar Akhara, who has a long association with the Ram
temple movement, said: "The court has very clearly said that the new trust
is to be formed and it is the responsibility of the Union government to form
the Trust, not of Ram Janmabhoomi Nyas, though representatives of Nyas should
be in the Trust "Mahant Dinendra Das the chief of Nirmohi Akhara, whose
claim was turned down by the apex court, said the government must take
representatives of the Nirmohi Akhara in the trust. "The trust must be
formed as per the directions of the Court," Das said, adding, "the
court has clearly mentioned that a new trust has to be formed by the
government."Dinendra Das, however, expressed his reservations over joining
a government trust. He said: "Our Nirmohi Akhara is also a trust, so our
trust members will decide on joining a government trust."Triloki Nath
Pandey, who represented the deity, Lord Rama, in court as "friend of Ram
Lalla" and won the title, said: "The trust must be formed by the
government and must have members from the government."He said: "The
government should appoint Mahant Nritya Gopal Das, president of VHP's Ram
Janmabhoomi Nyas as president of the government's trust."Pandey said,
"The grand Ram temple must be build according to the model that was
proposed by VHP and all the carved stones prepared by VHP must be used in the
construction of Ram Mandir."IANS
Ayodhya verdict: Mahasabha may file review over 5
acre land for mosque
Lucknow
:Days after the Supreme Court, deciding the title suit of Ramjanmabhoomi-Babri
Masjid, ruled that the entire disputed land be handed over to a trust to be
constituted for construction of a Ram temple and that Muslims be given 5 acres
of either the acquired land near the site or at “a suitable prominent place in
Ayodhya” for building a mosque, Akhil Bharat Hindu Mahasabha (ABHM), one of appellants
in the apex court, has raised an objection over the direction to provide 5-acre
land to Sunni Waqf Board.Hindu Mahasabha said they are studying the judgment to
decide on filing a review petition against the order.“We have strong objections
over the court direction to provide Sunni Waqf Board 5 acres of land near the
site or a suitable prominent place in Ayodhya. If it has been proved that a
temple was there, then why any land should be given to them. We are presently
studying the Supreme Court judgment and will decide later on filing a review
petition,” said advocate Shishir Chaturvedi, the present president of ABHM.
ABHM appeal in the Supreme Court against 2010 Allahabad High Court judgment was
filed in 2011 by its then president Kamlesh Tiwari who was murdered at his
residence in Lucknow last month. Chaturvedi, who is now also a “pairokar” on
behalf of Tiwari in the Supreme Court appeal, added that Tiwari got down from ABHM
president’s post over a year ago.“I had applied for a power of attorney on
behalf of Kamlesh Tiwari in the Supreme Court in the title suit case,” said
Chaturvedi. ABHM had formed a high-power committee and nominated Tiwari, the
then president, to be an appellant in the title suit case on behalf of the
outfit against the 2010 Allahabad High Court judgment.indianexpress
Muslim community mulls rejecting offer of
alternative site for mosque in Ayodhya
New
Delhi: With prominent voices joining in, a view is gaining ground within Muslim
community that it should not accept land for building a new mosque anywhere
else in Ayodhya. In order to articulate the sentiments of its members and the
community, the All India Muslim Personal Law Board will on Sunday spell out its
view on the offer of 5 acres of land for a new mosque as per the Supreme Court
judgement in the Ram Mandir- Babri Masjid case. The Board at a special meeting
of its working committee on Sunday in Lucknow will also decide whether it is in
favour of filing a review petition against the judgement or not. While AIMPLB
meeting is being seen among Muslim organisations as critical to put forth a
public statement, the fact remains that the decision whether or not to accept
the land is going to be the prerogative of UP Central Sunni Waqf Board. UPCSWB
on the day of the judgement issued a statement welcoming the SC verdict and
made it clear that it was not going to file a review petition. UPCSWB was also
one of the petitioners in the case. However, the community voices over the way
forward have started growing with Jamiat Ulama -i- Hind president Arshad Madani
saying, “While it is up to the UPCSWB to take the land or not in my view they
should not take it. The reason is that the case was about Babri Masjid and that
it existed on the site that was under dispute. It was never about seeking an
alternate site. We don’t need five acres land like a compensation. We have lost
the case and we accept the top court’s verdict with dignity. However, building
a mosque elsewhere does not make any sense to me,” Madani said.A prominent
member of the AIMPLB, Kamal Faruqui, said, “There is a sentiment within the
community that land should not be accepted. I also feel if a new mosque is
built at an alternate site it will be a reminder of Babri Masjid and the
associated developments ever since it was demolished. Therefore a new mosque
should not be built at an alternate site.”Jamaat -e- Islami Hind national
secretary Malik Mohtashim Khan too said that there was a sentiment within the
community that 5 acres of land should not be accepted by those at the helm of
affairs.TOI
Sikhs are angry for referring Sikhism as 'cult' in
Ayodhya verdict, showing them as idols worshippers
As
it attempted to sort out a century-old Hindu-Muslim issue with its 1045-page
judgment on the Ayodhya land dispute, the Supreme Court has inadvertently riled
Sikhs. It has described their religion as a ‘cult’ and seems to have relied on
the testimony of someone who Sikhs believe has “misinterpreted the purpose of
Guru Nanak Dev’s visit to Ayodhya in 1510-1511”. The court relied on the
testimony of one Rajinder Singh, ‘a person having interest in the study of
religious, cultural and historical books of Sikh cult’ who had been fielded as
a witness by Hindu parties to strengthen their claim to the disputed site. The
SC further noted on Rajinder Singh’s evidence, “In his examination-in-chief, he
has referred to several books about Sikh cult and history.”Kendri Guru Singh
Sabha in Chandigarh has publicly criticised the judgment and described it as an
“affront” to the Sikh community. “The court has called us a ‘cult’ — a word
which bears a definite negative connotation. The learned judges should have
consulted experts before doing so,” said professor Gurdarshan Singh Dhillon, a
Sikh historian associated with the Sabha. Neena Singh, a Delhi lawyer, has
written to the SC registrar that she and a group of Sikh lawyers will be
submitting a representation to CJI soon, asking for a correction of the portion
of the judgment that refers to Sikhism as a cult. “It is derogatory and goes
against all that Sikhism stands for. The judges should have rebuked the witness
for using such language against a peaceful and independent religion like ours.
The community is shocked and hurt by the false submissions of the witness and
the judgment of the Supreme Court,” Singh said. Sikh intellectuals are also
angry over the allegedly false janam sakhies or biographical writings about the
Guru that have been taken on record by the SC from the evidence presented
before the Allahabad high court. These state that Guru Nanak went to the
alleged Ram Janambhoomi in Ayodhya for ‘darshan’.“Guru Nanak went to religious
places like Mecca or Ayodhya to preach and spread the message of one formless
God. He did not go for ‘darshan’ at any place. There is no place for idol
worship or ritualism in Sikhism and the Guru, in fact, preached against it,”
said Singh. Gurpreet Singh, head of Kendri Guru Singh Sabha said, “Instead of
relying on an unknown person, the court should have asked for opinions from
Sikh historians or the Akal Takht or the Shiromani Gurdwara Prabandhak
Committee who would have produced authentic ‘janam sakhies’ written by renowned
Sikh writers and not a ‘fictitious’ account that has been presented before
it.”thewire

Owaisi on Ayodhya verdict: Don’t need ‘khairat’,
our fight was for Babri Masjid:
Expressing
his dissatisfaction with the Supreme Court verdict on Ayodhya issue again,
AIMIM president Asaduddin Owaisi has said his party was not in favour of the
five acres of land proposed in the judgment for building a mosque.“I speak for
my party, we do not want this ‘khairat’ (donation or charity). Our fight was
for a legal right, for a Babri Masjid. Our fight was not for, to get this piece
of land,” Owaisi said. He said the struggle for so many years was not for a
piece of land. “Why did we have this patience so much. We went to the court, if
it was a piece of land we could have accepted it somewhere else. But, from last
50 years, we have been fighting this case in a court of law with all the
patience,” he said.He also claimed that with this decision, the country has
furthered on the path of “Hindu Rashtra”. “How attempts are being made to make
Muslims in Imdia as second class citizens. Keep watching. Political
disempowerment is happening. Nobody can deny this..bring NRC, citizen amendment
bill, what message you are giving. My regret is that all the secular parties,
their mouths are shut,” Owaisi said. indianexpress

Forget closure, Muslims can’t even say how unhappy
we are: Rana Ayyub on Ayodhya verdict:
India’s
Muslims have been silent after the Supreme Court’s Ayodhya verdict because they
are afraid of what will happen if they speak up, said journalist Rana Ayyub.
There is a lot of anger and sadness in the community over the Babri Masjid
demolition, but people are scared that “anything they say or do will only make
things worse for them,” Ayyub told HuffPost India in phone interview. “This
silence is of fear, not happiness. It’s only when you are intimidated that you
are silent. We have been asked to shut up. Muslims are numb right now. The
community has gone into a cocoon. People are just going about their routines
because they don’t want to think anymore. They don’t know what is going to
happen next,” she said. Ayyub’s opinion was shared by other Muslim leaders and
activists this reporter spoke to after a five-judge bench of the Supreme Court
ruled in favour of the Hindu parties last week, granting the disputed land in
Ayodhya to a Hindu trust for the construction of a temple devoted to Ram, and
offering an alternative five acres to the Muslim parties to build a mosque.

Gujarat govt aiding traders, not farmers, says RSS

chapter of Bharatiya Kisan Sangh (BKS), a RSS-affiliated farmers’ outfit, on

cultivation and the subsequent crop loss the farmers faced in Gujarat. It said
that the farmers in the state are “Ram Bharose” (left to their fate). At a press
event organised in Ahmedabad on Tuesday, BKS Gujarat president Vitthal Dudhatra
said, “They (govt) have a good system in place but unfortunately failed in its
implementation. There is a system under which the Talati is supposed to keep
track of which kind of crop is cultivated in each farmland under their
jurisdiction. But for the past 10 years, there is no record of this data. When
the government doesn’t have the data on cultivation, how is it expected to have
data on crop loss,” said Dudhatra. BKS state president alleged that the state
government was busy creating an “illusion of numbers” in order to assist the
traders of the state, but not the farmers.indianexpress

Palestinian death toll climbs to 24 as Israel
bombards Gaza for a second day
At
least 24 Palestinians have been killed by Israeli air strikes on Gaza,
including a father and his two sons, as the military continued its air campaign
for a second day today. The latest flare up was triggered by Israel's
assassination of a top member of the Islamic Jihad on Tuesday morning, and is
showing little sign of easing. The enclave's ministry said 69 people had also
been wounded during the bombardment. Some of the bodies of those killed in Gaza
City were brought into Shifa hospital in taxis and ambulances early on
Wednesday, as relatives wept and screamed, Reuters reported. Medics and
witnesses said they were civilians who lived in densely populated
neighbourhoods.A father and his two sons were killed by an air strike while on
a motorcycle, an eyewitness told Middle East Eye, adding that they had just
reached their home when the attack took place. The father was a farmer with no
political affiliations and was coming back from his field, the eyewitness said.
They started this, we did not want war," said one grieving
relative.Islamic Jihad confirmed that two of its fighters were killed in
separate strikes south of Gaza City during the morning. It identified one of
the men as Khaled Farraj.Israel launched deadly strikes against commanders of
Islamic Jihad early on Tuesday, triggering a wave of tit-for-tat rocket salvoes
and air strikes.Israeli military said it had carried out a series of strikes on
Islamic Jihad targets on Wednesday in response to new rocket fire from Gaza.
Abu Musaab al-Breem, spokesman of Al-Quds Brigades, armed wing of Islamic
Jihad, said: What’s going on is retaliation for the assassination of Abu
al-Atta and is coordinated by all Palestinian factions.Israel's PM Benjamin
Netanyahu, who ordered the assassination, on Tuesday accused Abu al-Atta of
masterminding recent attacks against Israel and planning more in near
future.middleeasteye

Point Blank: Egypt, Russia and UAE sent arms to
Libya's Haftar
An
Al Jazeera investigation has uncovered Egyptian, Russian and UAE arms support
to Libya's renegade military commander Khalifa Haftar. The commander has - since
April 4 - waged a months-long offensive against UN-recognised, Tripoli-based
Government of National Accord (GNA).The Point Blank investigative programme
incorporated exclusive documents and interviews with GNA leaders who spoke
about the complex workings of the three countries' support for Haftar and his
self-styled Libyan National Army (LNA).According to GNA Interior Minister Fathi
Bashaga, Haftar's "biggest support lies in the fact that [Haftar-controlled]
eastern region directly borders Egypt," making the border crossing with
Egypt the main channel for military supplies. The hour-long Arabic language
documentary revealed the existence of secret Egyptian foreign ministry
documents dating back to May 26, 2017, implicating Cairo in the facilitation of
Sudanese militia deployment to Libya.aljazeera

commonly cited figure of one million people. East Turkistan National Awakening
Movement, a Washington-based group that seeks independence for mostly Muslim
region known to China as Xinjiang, said on Tuesday it assessed images from
Google Earth and found 182 suspected "concentration camps" that it
listed by coordinates. The group, which said it matched its findings with
on-the-ground information, said it also spotted 209 suspected prisons and 74
suspected labour camps, which it would share later."In large part, these
have not been previously identified, so we could be talking about far greater

Saudi authorities backtrack on description of
feminism as extremism
Saudi
Arabia’s state security agency distanced itself on Tuesday from a promotional
video that categorized feminism and atheism as extremist ideas, blaming it on
an action by individuals, reports Reuters. The animated clip was posted on
Twitter at the weekend by a verified account of the State Security Presidency
which reports directly to the king. It has since been removed. In a statement
published by state television, the security agency said the video contained a
number of mistakes in defining extremism, and that the individuals who made the
video did not do their job properly. In a separate statement, the
state-affiliated Saudi Human Rights Commission said feminism was not a crime
and that the kingdom “accords the utmost importance to women’s rights.”Neither
statement referenced feminism and atheism – which have long been illegal and
punishable by death in the absolute monarchy.middleeastmonitor

has been trying to deflect criticism of its human rights record and prison
conditions ahead of a UN review in Geneva today that comes in the wake of
thousands of new arrests, reports Reuters. The crackdown, which rights activists
say was the most intensive campaign of arrests for years, came after rare
protests against President Abdel Fattah al-Sisi in Cairo and other cities in
late Sept.More than 4,400 were detained, among them prominent activists,
lawyers, academics and political figures, according to the Egyptian Commission
for Rights and Freedoms. Around 3,000 are still being held under charges
