Proposed revision: Govt relaxes rules on
cattle market, drops reference to slaughter
New Delhi; In a significant rollback, the
Centre is all set to remove any reference to the term “slaughter” in its new
version of the Prevention of Cruelty to Animals (Regulation of Livestock
Market) Rules, 2017, according to a draft of the notification being vetted by
the Law Ministry.The original version, dated May 23, 2017, had notified a ban
on sale of cattle for slaughter in animal markets, triggering an outcry over
its effect on trade across the country. The diluted version is being vetted by
the Law Ministry prior to its notification by the Ministry of Environment,
Forest and Climate Change.Indian Express had first reported in Nov., 2017, the
Centre’s intention to withdraw its controversial plan. According to the new
version, “no unfit animal or young animal shall be sold in an animal market”.
Further, it states that “no person shall permit an animal to be offered or
displayed for sale in an animal market if it is likely to give birth while it
is there or during its transportation to or from such animal market”.In its
notification last May, the Environment Ministry had restricted the sale of
cattle and stated that “no person shall bring a cattle to an animal market
unless upon arrival he has furnished a written declaration signed by the owner
of the cattle or his duly authorised agent… stating that the cattle has not
been brought to market for sale for slaughter”.Further, it had stated that the
“purchaser of the cattle shall… not sell the animal for purpose of slaughter”. However,
the rules invited controversy with NDA govt coming under criticism for
attempting to impose a nationwide ban on ideological grounds. Farmers opposed
the move to restrict trade in markets to animals meant for agricultural use,
saying they cannot directly access slaughterhouses. Farmers normally bring
their redundant animals to livestock markets from where traders purchase and
transport the cattle to abattoirs.The decision had also sparked outrage in
states such as Kerala, West Bengal and Meghalaya on the grounds that it related
to an issue under their jurisdiction.MoEF’s plan to rollback the controversial
rules followed its move to seek feedback from states. The ministry had sent 2
sets of letters to states, the first after the Supreme Court had stayed the
ban. Ministry also held consultations with animal rights activists and traders
on the issue. The new version sets down rules to constitute what is now
“Prevention of Cruelty to Animals Committee”, replacing what was earlier
referred to as “district animal market monitoring committee” or “animal market
committee”. The committee, which will comprise of DM, a representative of the
State Animal Welfare Board and the district Superintendent of Police among
others, will “take all necessary steps to ensure that no unnecessary pain and
suffering is caused to animals in animal markets in its jurisdiction”.indianexpress

In a shocking development, Justice Revati
Mohite Dere, who slammed the CBI’s approach in the fake encounter case of
Sohrabuddin and his wife Kauser Bi, will no longer hear the case. She was
hearing the revision applications in the Sohrabuddin encounter case at the
Bombay High Court.As per the new sitting list effective from Feb.26, 2018,
Justice NW Sambre will be hearing all the revision applications, reported Live
Law website.Justice Dere’s removal from the case assumes significance in light
of her recent outbursts against the CBI in the fake encounter case of
Sohrabuddin.In January, she had dismissed a CBI judge’s earlier order banning
the media from reporting on the proceedings in the Sohrabuddin Sheikh’s fake
encounter case. In September last year, Justice Revati had slammed the CBI
asking the federal probe agency why it had not challenged the trial court
orders discharging senior IPS officers in the alleged fake encounter case of
Sohrabuddin Sheikh and Tulsiram Prajapati.Justice Revati Mohite-Dere said that
the CBI should have been “equally aggrieved” with the trial court’s order. She
asked the federal probe agency whether it was planning to challenge the trial
court orders of August 2016 and August 2017 discharging IPS officers Rajkumar
Pandiyan, DG Vanzara, and Dinesh MN. BJP President Amit Shah was a key accused
in the alleged fake encounters of Sohrabuddin and his wife. CBI judge, BH Loya,
who was presiding over the fake encounter case had mysteriously died in Nov.

in Assam is 34 pc; the majority of them are Bengali Muslims who have settled

say that lakhs of illegal infiltrators from Bangladesh have settled in Assam.Election
Commission has marked them in the voters’ list as ‘doubtful voters’, who could
not produce proof of their citizenship.A list of all residents of Assam is
being prepared under the supervision of Supreme Court for identification of
illegal Bangladeshi infiltrators. The final list of National Register for
Citizens (NRC) will be released in June.State Coordinator NRC, Shri Prateek
Hajela told that ‘D voters or those who have been declared foreigners will not
be included in the NRC. Besides 29 lakh women have submitted Panchayat
certificate, their nationality will also be scrutinised. He says it is hard to
say how many people will be removed from citizenship and nationality. This is a
test whose result is inappropriate to declare now. According to civil society
and human rights groups, lakhs of Bengali Muslims can be expelled after the NRC
is released. Abdul Batin Khandkar of Justice Forum says the number of D voters and
declared foreigners is nearly 5 lakh; their children would be around 15 lakh.
They will not be included in the list. He fears that at least 20 lakh Bengali
Muslims will be deprived of citizenship and nationality. siasat

London: A new report by a London-based think
tank on Islamist extremists exploiting charities and NGOs for funds and support
for terrorism mentions Indian preacher Zakir Naik, who was banned from Britain
in 2010 but remains the chair of a UK-based organisation.The report by the
Henry Jackson Society, titled “Wolves in sheep’s clothing: How Islamist
extremists exploit the UK charitable sector”, assesses that in the last year,
more than £6 million of taxpayers’ money was given to such charity
organisations. “Review found that some organisations were ‘purposefully vague’
about their activities and charitable status, portray themselves as charities
to increase their credibility and exploit the Islamic duty to give to charity,
and that those donating money may not be aware of the organisations’ agenda,”
it said.The figure of £6 million, it said, represents “only the tip of the
iceberg”. The report said that despite more than a decade of attempts to
improve the regulation of the charitable sector, “a concerning number of
UK-registered charities continue to fund and support extremism”. The report
noted that Naik, whose UK visa was revoked in 2010 when Theresa May was home
secretary, was invited to speak in Birmingham in June of that year by the
Islamic Dawah Centre International. His Peace TV channel had been banned in
India, Bangladesh and Canada, it added. “Though there is no evidence of Naik’s
direct involvement in terrorism, there are concerns about the radicalisation
potential of Naik’s lectures,” it said, and reproduced some of his
controversial remarks, as well as those of Satya Pal Singh, former Mumbai
police commissioner who reportedly investigated Naik’s activities.

Nirav Modi case: PNB fraud rises to Rs 12,700
crore, more unauthorised transactions detected
New Delhi: The quantum of unauthorised
transactions by diamond merchant Nirav Modi and his uncle Mehul Choksi has
increased by Rs 1,300 crore, PNB said in a stock exchange notification late on
Monday night. Total amount of fraudulent transactions now stands at Rs 12,700
crore.The financial fraud, one of the biggest in the banking sector, was
unearthed after an internal inquiry by the PNB. It was found was the two
Mumbai-based diamond jewellers had been allegedly duping foreign banks with
fake Letters of Undertakings from PNB for several years.The development comes
at a time when the Enforcement Directorate is planning to move the Supreme
Court to obtain non-bailable warrants against the diamantaires after they
failed to appear before the agency despite the repeated summons.Meanwhile, CBI
has written to at least five banks — Axis Bank, Allahabad Bank, State Bank of
India, UCO Bank and Union Bank of India — asking them to share details from
their international divisions on buyer’s credit availed by firms which are part
of the Modi and Choksi groups.With PNB fraud coming to light, the CBI has
registered cases against several companies in instances of wilful loan default
in last one month; the most recent being the case against Simbhaoli Sugars Ltd
for allegedly defaulting loans to the tune of Rs 97.85 crore. The bank named Deputy
General Manager Gurpal Singh, who is the son-in-law of Punjab Chief Minister
Captain Amarinder Singh, as one of the accused in the case. Expressing concern
over the increasing number of wilful defaulters in the banking sector, Finance
Minister Arun Jaitley blamed the bank management and auditors, internal and
external, of failing to do their jobs.“Bank frauds which have now come to
surface if you periodically have this kind of incidences, I think the entire
effort of Ease Of Doing Business itself goes into the background and therefore

Bank of Baroda (BoB) officials suppressed numerous alerts filed by junior
officials at the Johannesburg branch about transactions in accounts controlled
by the Gupta brothers of the Sahara group, whose financial dealings resulted in
the resignation of South African President Jacob Zuma.These alerts or
suspicious activity reports (SARs) were voided by BoB managers and thereby
never reached the South African Financial Intelligence Centre, an investigation
by The Hindu and the Organized Crime and Corruption Reporting Project (OCCRP)
has found.Over 17,000 transactions of the BoB’s South African operations since
Jan.2012, as well as internal communications, show that the bank continued to
allow the Gupta brothers to operate a web of accounts to create a complex
corporate maze even as the political scandal about their influence on Mr. Zuma
was playing out.This continued even after other banks terminated their dealings
with the brothers in 2016. Their accounts received payments from state-run
enterprises against bills that are under scrutiny, moved large sums of money
abroad and shifted equally large sums between accounts of a clutch of shell
companies.President Zuma’s fourth wife Bongi Ngema Zuma, who was gifted a house
by the Guptas, was on the payrolls of a Gupta firm for a staggering $12,300
monthly salary, making her one of the higher paid private sector executives in

CBI Still Clueless About Missing JNU Student

New Delhi: CBI said on Monday that it had a
“fresh and very important lead” in the mysterious disappearance of Najeeb
Ahmed, but the premier investigating agency apparently failed to walk the talk
when it told the Delhi High Court that it was awaiting forensic results of call
details, WhatsApp messages and location details of 9 students who are accused
of assaulting Najeeb prior to his disappearance. CBI, which was handed over the
probe on May 16, 2017, after Delhi Police failed to trace the young man, had
said the same on the previous date of the hearing that had taken place on
November 14, last year.Najeeb (27), a JNU student, had gone missing from the Hostel
in 2016 following an alleged scuffle with students associated with ABVP, previous
night.Senior Advocate Colin Gonsalves,counsel for Najeeb’s mother Fatima
Nafees, argued to put on record the fact that the Crime Branch of the Delhi
Police caught a random auto driver and peddled a false theory of him going on his
own to Jamia Millia Islamia university.
CBI had on Nov. 14, 2017, placed this fact on the record of the court that the
Crime Branch officers had randomly picked up an auto driver and forcefully
extracted a false statement from him.As the hearing resumed on Tuesday, the
counsel for CBI referred to Monday’s demonstration outside the CBI HQRS,
alleging that the protesters blocked CBI gates. Students of JNU, Delhi
University, JMI, AMU and others had on the call of Fatima Nafees staged a
protest outside CBI HQRS, alleging that the agency is not doing enough to trace
Najeeb. CBI SP SS Gurum had assured the protesters that agency has fresh and
very important leads which they would present before the court in today’s
hearing. HC bench comprising Justices S Muralidhar and IS Mehta told the CBI
that this was a “democratic expression of the anxiety of the people” since the
case is dragged on for so long. CBI – said Advocate Colin – has not pursued the
investigation with the much-needed urgency and now they came to court
requesting an order to speed up the process. He alleged the police wasted one
year pursuing the concocted story of the auto driver.He reiterated an earlier
prayer for a court-monitored inquiry. He requested that a retired judge should
be appointed by the court to monitor the case and look at all the documents
submitted by the Crime Branch and the CBI. The judges have put this plea on
hold to look at the CFSL reports.“The probe has not moved an inch since the
incident took place.CBI has done nothing except force me to run from pillar to
post in the last one-and-a-half years. Instead, fake stories on Najeeb having
joined ISIS are being circulated without any evidence,” Fatima Nafees told the
gathering at the protest venue on Monday.The court has set April 3 as the next
date of hearing.

New Delhi:In a huge relief for JNU students
who had taken admission in PhD courses in 2016, the Delhi High Court on Monday
quashed 2 circulars issued by the varsity in 2017 making an MPhil degree
mandatory for candidates keen on pursuing PhD retrospectively from the 2016
academic session. Justice Rekha Palli said that once the admission process has
started, the condition cannot be altered to the detriment of the students.The
judge said that the 2009 UGC regulations, which was the eligibility condition
in force when the prospectus was issued in Feb. 2016, would apply to the
students who took admission in 2016.The students had challenged the circulars
issued on Sept. 21, 2017 and Sept.25, 2017 by JNU in which a condition was laid
down that candidates who wish to pursue a PhD programme must have an MPhil
degree. The students contended that the condition was not present in the
admission brochure, under which they took admission.The students — both Indian
and foreign nationals — said in their pleas that the two circulars were based
on UGC regulations of 2016 which came into effect in May 2016, while their admission
process started in Feb.2016.“When the students had applied for their respective
courses and were issued admit cards, the 2016 regulations were not even
notified by UGC,” one of the petitions filed by advocate Abhik Chimni and

Chandigarh: Opposing the appeal filed by
murdered teenager Junaid Khan’s family, who sought a CBI probe into his
killing, the agency told the Punjab and Haryana High Court Monday that trial in
the case was at a “crucial point” and that Haryana police was “well equipped”
to investigate the case.15-year-old Junaid, his brother and two cousins were
attacked on a Mathura-bound train by a mob, which also hurled communal slurs at
them. The teenager was stabbed to death during the attack in June, 2017.The
murder trial was stayed by a division bench of the High Court in Dec. after
Junaid’s father Jalaluddin filed an appeal against an earlier single bench
judgment, which dismissed their plea for a CBI probe.“Chargesheet has already
been filed before the concerned court at Faridabad and proceeding of trial is
at a crucial stage in prosecution evidence,” said CBI in its response filed
through counsel Sumeet Goel.CBI also told the HC that “State Police of Haryana
is well equipped and has the requisite resources at its command to conduct
investigation of the case properly under supervision of senior officers”. It
has also said the agency was already “over burdened” with investigations of

Defence ministry ‘report’ picks holes in
arms-buying procedure
A defence ministry document purportedly
picking holes in India’s arms-buying procedures has painted a grim picture of
how unreasonable delays are hindering the military’s modernisation, at a time
when several key programmes are running years behind schedule and some remain
stuck on the drawing board.Only 8-10% of the 144 deals initiated during the
last three years came to fruition within the stipulated time period, an NDTV
report said on Monday, quoting from an “internal report prepared in late 2017
by minister of state for defence Subhash Bhamre”.HT could not independently
verify the contents of the purported report and a defence ministry spokesperson
did not immediately confirm or deny the report. However, it is no secret that
several projects have been hit by inordinate delays, experts say. These include
the purchase of assault rifles, light machine guns, artillery guns, fighter
planes, mid-air refuellers and submarines.“I cannot comment on the authenticity
of the report but the fact is that several of our projects are floundering at
one stage or the other,” said a person tracking the military’s
modernisation.The development comes days after India dropped a plan to locally
produce single-engine fighters in collaboration with a global defence
contractor to expand the scope of the competition by including twin-engine
fighters too. The Centre is preparing to launch a fresh hunt for fighter

militants as a reason for recruitment of local youths into militancy, J&K
Police’s intelligence wing has asked the state police to take steps to prevent
“massive and multiple” funerals of militants in the Valley.“Funerals of killed
militants have become a fertile ground for recruiters,” reads a confidential
report sent by IGP, CID, to DGP SP Vaid.The report states,“(The) massive
gatherings that are being witnessed in funerals of killed local militants
post-2016 unrest is a serious concern which has to be addressed…. These
gatherings romanticise and glamourise the terrorists and give boost to
militancy.”Citing many examples of young men who have joined militant ranks
after attending the funeral of a slain militant, the report says that militants
have been successful in glamourising militancy by appearing at such funerals
and offering gun salute.The report, prepared two months ago, states: “It has
been noticed that soon after burial of killed local militant(s), one or two
local boys, who have participated in their funerals, join militancy. By giving
regular appearance at funerals to give gun salutes, or to put forth their point
of view/ideology, active militants have been successful in glamourising
subversive activities. The massive turnout at funerals of killed terrorists is
an indicator of the radicalisation level.”The report calls for keeping an eye
on potential recruits living in the locality of the slain militant and the need
to keep them away from such funerals. These youths, “who have inclination

popular financial assistance scheme of the state government, the money was for
the treatment of Ashok Pandurang Bhosle, a 45-year-old resident of
Ahmednagar.There was one problem, though.An investigation by Indian Express,
based on documents obtained under RTI Act, show that no one bothered to verify
the patient’s status while depositing the money. Bhosle had died on May 27,
2017 — 21 days before the money for his treatment was deposited. The
application for assistance in his name
was submitted on June 6 — 10 days after his death.The investigation found how a
well-intentioned scheme to help the poor was being corrupted during the
implementation stage, with stolen identities, fake records, proxy applicants,
inflated medical estimates and dubious income certificates being used to claim

continued to approve funds to hospitals across the state even after red flags
were raised by a senior official linked to the scheme.The findings assume relevance

from the title of the Shahi Imam of Jama Masjid. Following this, the court in
November last year had issued a notice to the Delhi Waqf Board and Ministry of
Minority Affairs. The petitioner in his plea cited Article 18 of the
Constitution, which prohibits Indian citizens from receiving titles from any
foreign state, thus barring the use of “Shahi” or an officer appointed by an
Emperor (Shah), which used to be accorded during the Mughal Period. The plea
also argued that there was no space for artificial distinctions in a true

notification issued on August 10, 2017 for conduct of election to AP Wakf
Board, contending that the impugned notification was issued in violation of the

submitted that election to Wakf Board should be conducted under four categories
i.e. MP, MLA, Mutawalli and Bar Council members. There was scope to have two
members from each category. However, the government had issued notification

participate in a naval exercise next month.As India gears up to host navies
from 16 countries, Maldives was also sent an invite to attend 'Milan', an
eight-day naval exercise, but it has declined, Navy Chief Admiral Sunil Lanba
said today. "Maldives has not given any reason for the decision," the
Navy Chief said.The biennial naval exercise, that was first held in 1995 with
just five navies, aims to expand regional cooperation and combat unlawful
activities in critical sea lanes.Australia, Malaysia, Mauritius, Myanmar, New
Zealand and Oman are among the countries that have confirmed their
participation in the joint activity that starts March 6 in Andaman and Nicobar
Islands. The latest development is a reflection of a strain in ties between
