SC asks 8 states, 1 Union Territory to file
replies on mob lynchings within 2 weeks
The Supreme Court today asked 8 states and one
union territory, who have not complied with the apex court’s earlier order on
mob lynchings and cow vigilantism, to file their replies within two weeks,
reports said. The SC has taken a serious note of the fact that only nine of the
29 states and two of the seven UTs have so far complied with its July 17 order
giving a slew of directions to deal with mob violence and cow vigilantism
incidents across the country.On July 17, the SC, while decrying incidents of
lynchings, had asked the Parliament to come up with a law to deter such crimes
and warned that if the reports are not filed then home secretary of defaulting
state will have to appear in person before the court.A bench headed by CJI
Dipak Misra condemned cases of mob-lynching and called the incidents
“horrendous acts of mobocracy” which cannot be allowed to become a new norm and
asked states and union territories to give wide publicity to its orders and to
put it up on their websites so as to spread the awareness. Senior Counsel
Indira Jaising, appearing for one of the petitioners Tushar Gandhi, requested
that the SC to direct the states to disclose the names of the organisations
accredited by them as the Societies for Prevention of Cruelty to Animals under
Rule 3 of the Prevention of Cruelty to Animals Rules, 2001, livelaw.in reported.While hearing

New Delhi:The Supreme Court on Monday referred
to a 5-judge Constitution Bench petitions seeking a declaration that the
practice of female circumcision or ‘khafz,’ prevalent in the Dawoodi Bohra
sect, amounts to “female genital mutilation” and is a violation of women’s
right to life and dignity. A 3-judge Bench of CJI Dipak Misra, Justices A.M.
Khanwilkar and D.Y. Chandrachud observed that the issue deserved to be examined
by a Constitution Bench.Earlier, during hearings, Justice Chandrachud had
observed that circumcision leaves a permanent, emotional and mental scars in a
young girl.CJI had orally observed that the Constitution does not allow a
person to cause injury to another. The Bench had said that the practice should
be tested in the light of constitutional morality.However, senior advocate A.M.
Singhvi, appearing for 70,000 Bohra Muslim women under banner of Dawoodi Bohra
Women’s Association for Religious Freedom (DBWRF) in favour of ‘khafz,’ said
the practice was essential to religion and has been continued since 10th
century.DBWRF secretary Samina Kanchwala said, “The SC has today upheld the
voice of a large section of Dawoodi Bohra women in India... we have maintained
that female circumcision is not FGM and we will continue to clear the
misconceptions that the two practices are the same.”More recently, Nafisa
Vahanvati, the widow of former attorney general of India Goolam Vahanvati had
approached the SC in support of female circumcision and the right of the
Dawoodi Bohra women to practice their religion.The Hindu

Mumbai: Central Govt’s ordinance criminalizing
instant Triple Talaq has been challenged in the Bombay High Court. The petition
says the provisions of the ordinance are “illegal, null, void, unreasonable and
arbitrary”.As per a report in LiveLaw.in, a former municipal councillor, a
city-based NGO and an advocate jointly approached the Bombay High Court on
Friday challenging provisions of the ordinance.The petition was moved by a
former municipal councillor and social worker Masood Ansari, NGO ‘Rising Voice
Foundation’ and advocate Devendra Mishra.“The very construction of the
ordinance shows that it selectively targets men from the Muslim religion. The
provisions of the ordinance are violative of fundamental rights of Muslim men,”

To dissect the uproar and shed light on the
reality of how darul qazas operate, IndiaSpend spoke with Flavia Agnes, a
leading women’s rights lawyer and co-founder of Majlis, a legal and cultural
resource centre that campaigns for and provides legal representation to women
and children. Studies have shown that the main beneficiaries of Islamic
alternative dispute resolutions largely consist of women, agitating for
divorce, land and other family disputes. With each court visit costing
litigants on average Rs 350 per day (25 % of earnings for those with a
household income of less than Rs 100,000 per annum), many lower-income and
subsequently disempowered individuals can feel financial barriers block their
path to justice.In an email interview, Agnes explains why at a time of
heightened Islamophobia, we must avoid politicised readings of darul qazas in
order to fully understand how the communities themselves are using and potentially
benefiting from their work. Agnes said, "An impression seems to have been
created that this move to set up darul qazas in every district is driven by an
objective to undermine the impact of the recent constitutional bench ruling in
the triple talaq (Shayara Bano vs Union of India) case, which had declared
triple talaq invalid last August. But this premise has no basis since darul
qazas have been functioning in India for a long time.For instance,
Imarat-e-Sharia in Patna,which has a well-oiled alternate dispute resolution
mechanism, was set up in 1920 and has a broad network of darul qazas across
many north Indian states.At that time, there was no controversy around the
setting up of this institution. Additionally there are also darul qazas run by
muftis who are not affiliated to any darul qazas. In fact, the AIMPLB does not
have the monopoly of setting up darul qazas. Any learned mufti who is socially
conscious may set up a darul qaza to help resolve family disputes." She
continued,"Right now, there is so much Islamophobia and fear of ‘the
other’, because we do not know about the traditions, customs and practices of
Muslims. Through our ignorance, we are branding everything concerning Islam as
anti-women. We can all visit a darul qaza and find out for ourselves how
disputes are resolved before making erroneous and invalid presumptions about
them. This might help to clear the air."She added, "I have visited
around 8 that are functioning and each one said more women approach them than
men. A few of these stated that around 95 % are women. This is because when a
Muslim woman faces domestic violence she often prefers to go to a darul qaza to
dissolve her marriage rather than the family court. In a darul qaza, women feel
more comfortable since they are familiar with the culture, understand the
language. Also, darul qazas offer expeditious and cheaper options to resolve

Day after bail in hospital case, Kafeel Khan
and Brother Arrested in 9 yr old Bank Fraud Case, Family Says Charges False
Dr Kafeel Khan, who was out on bail in a case
related to the death of infants at a state-run hospital in Gorakhpur last year,
and his elder brother Adeel Khan were arrested on Sunday in a 9-year-old fraud
case.A case of forging documents was registered against Adeel and Kafeel Khan
at the Rajghat police station by Gorakhpur resident Muzaffar Alam in 2009. Complainant
accused Adeel Khan and Dr Kafeel Khan of opening a bank account in Union Bank
of India in 2009 under his name using fake documents and forged signatures.The
matter is being investigated by SSP Shalabh Mathur.“We found the complaint to
be true as the bank account was opened in the name of Mohammad Faizan using the
photograph of the complainant Muzaffar Alam. As per the complaint the accused
also made transactions of Rs 2 crores from the same account,” said SSP
Mathur.Local police sources in the Rajghat police station told The Citizen,
“Both brothers have been arrested, but we are not aware of the location where
they are being held.”Dr Khan’s re-arrest comes two days after he was released
on bail after being arrested on charges of creating a disturbance and ruckus at
a district hospital in Bahraich. According to the police Dr Khan was arrested
on Saturday allegedly for arguing with doctors and causing a hindrance in the
treatment being given to patients at the hospital. He was later released on the
orders of the magistrate. Khan’s family shared posts on Facebook relating to
his arrest and that of his brother, accusing the UP police of framing false
charges. The statement by the family states that Khan was going to organise a
press conference about the wrongdoings of Baharich district hospital
authorities,and to explain the cause of death of 79 kids.But, he was arrested

as "serious" the allegations made by the wife of arrested former IPS
officer Sanjiv Bhatt that he was not being allowed to sign any document in
custody to enable him approach the SC.A bench of Justices Ranjan Gogoi and
Navin Sinha said the Gujarat Govt should
file a reply to the allegations levelled by Shweta Sanjiv Bhatt in her
petition, on or before Oct4."Before we go into the merit of the case, we
would like Gujarat Govt to respond to
the allegations. According to us, the issue raised is serious as it pertains to
allegation made against the state that it is preventing a citizen to approach
us," the bench said.Advocate Divyesh Pratap Singh, appearing for Shweta
Sanjiv Bhatt said they have also challenged the remand of Bhatt, who was arrested
by the Gujarat CID on Sept. 5 in connection with a 22-year-old case of alleged
planting of drugs to arrest an advocate."We are not on remand at present.
We are not on individual hardship. If a citizen is not allowed to come to court
and his wife has to come before us, then it's a very serious issue," the
bench said.At the outset, the bench asked Bhatt's lawyer to read the averments

Maulana Khursid Ansari shot dead in Nepal,
assailants flee to India
Kathmandu: A man was shot dead on a broad
daylight in southeast Nepal by four unidentified assailants who escaped to
India, police said Friday.The assailants were suspected Indian criminals, they
said.The deceased has been identified as Maulana Khursid Ansari, a social
worker and the chairman of a local school management, police said.The incident
took place Thursday at Harinagar area, 14-km from Indo-Nepal border, in Sunsari
district.The assailants came in a motorcycle and shot dead Ansari before
escaping to India, police said, adding that the reason behind the murder is not
known yet.As the gunmen were fleeing to India, they also shot at a police
constable, Shiva Poudel, who had tried to stop them at Ghuksi Bazaar, according
to Kathmandu Post.The injured constable was taken to Dharan for treatment, it
said.Meanwhile, the local people took to the street to protest the killing. The
protestors said they will not allow police to collect the dead body until the

what they described as “good riddance” to a man “known for encouraging Koli (a
dalit caste) men to marry Rajput women”. At the same time they are vehement it

Gujarat: Fight over DJ music snowballs into
communal riots near Borsad
Vadodara/ Anand: A verbal spat over loud DJ
music between two groups snowballed into clashes between mobs of two
communities in Pipli village of Anand’s Borsad taluka during Ganesha immersion
procession on Sunday.Sources said that the groups resorted to stone pelting
clashed after dispute over playing music and bursting fire crackers near a
mosque located in the village. The processions were going on peacefully in the
morning. Earlier, in the day, two mandals had already taken out immersion
processions from the same route that passes from the heart of the village. But
fight erupted when a Ganesha mandal, with youth from the Darbar community, took
out a procession from near the masjid.There was a heated altercation the mandal
members and a group from the minority community standing outside the mosque.
Soon, a group allegedly started abusing members from the minority community.
Situation turned ugly when some members of the procession threw stones on the
mosque, police said, adding this led to heavy stone pelting.The stone pelting
which had started at around 12 noon continued for nearly 30 minutes. It was
only after teams from local crime branch, special operations groups and
additional force rushed to the spot that the situation was brought under

school students, remained stranded across Himachal Pradesh on Monday after
incessant rainfall for third consecutive day triggered landslides and snapped
over 200 road links, officials said, adding that a 'high alert' had been issued
for Kullu.3 people were washed away near Manali late on Sunday night when their
vehicle fell into the swollen Beas River. Two were washed away in the Parbati
River in the Manikaran Valley, while one girl died near Bajaura. Both incidents
occurred in Kullu, one of the worst-affected by flash floods.Meanwhile, schools
in most districts of the state were closed as a precautionary measure due to
continuing moderate to heavy rains. People residing in low-lying areas, especially
in Kangra, Chamba, Kullu and Mandi districts, are being evacuated, officials
said. They are also being asked to remain alert due to rising water levels in

New Delhi: India has congratulated Maldives’
Opposition candidate Ibrahim Mohamed Solih after provisional results released
by Election Commission showed that the Maldivian Democratic Party (MDP) leader
won the presidential elections by 38,484 votes.“Welcome the successful
completion of presidential election process in the Maldives which, according to
preliminary information, Ibrahim Mohamed Solih has won.We heartily congratulate
him on his victory and hope that Election Commission will officially confirm
the result at the earliest,” Ministry of External Affairs said.This comes as a
possible blow for China which has invested millions of dollars in projects
under the outgoing administration. Incumbent Abdulla Yameen, who had cultivated
ties with both Beijing and Saudi Arabia, conceded defeat after the Election
Commission said Solih had won Sunday’s election by a margin of 16.7 percent.
Stating that the election, which took place amidst a Govt crackdown and Opposition fears of rigging, was
a triumph of democratic forces, MEA said New Delhi was looking forward to
deepening its partnership with Male under its “Neighbourhood First” policy.
“This election marks not only triumph of democratic forces in the Maldives, but
also reflects the firm commitment to democracy and rule of law. In keeping with

trial in 35 cases related to the Brotherhood, has been sentenced to death in

cassation. He got life sentences in more than 5 cases. A court in Cairo has
also upheld the death sentences for 20 Egyptians convicted of killing 13
policemen during violent unrest after the military overthrow of President
Mohamed Morsi in 2013. "The verdict is final and cannot be appealed,"
a judicial official said on Monday.The case involves 156 defendants, all of
whom had received either death or lengthy imprisonment sentences in the first trial

16 Killed In Pakistan Anti-Terror Operation
Pakistan Army has announced that nine
militants and seven soldiers were killed in an anti-terror operation carried
out in North Waziristan district bordering Afghanistan. Inter-Services Public
