Pune Bhima Koregaon case: Police arrests 5 rights
activists, raids 4 others' homes across India
Mumbai/New Delhi:Pune Police is reported to
have launched simultaneous raids at the homes of several people in Mumbai,
Delhi, Ranchi, Goa and Hyderabad, including activists, priests, writers and
lawyers.Human rights advocate Sudha Bharadwaj’s home was raided and she was
taken into custody this morning, sources told The Wire. According to the
panchama, Bharadwaj has been charged under Sections 153a, 505, 117 and 120 of
the IPC and several sections of UAPA. Orders for the arrest came from Swargate
police station, Pune, according to the police, and 5 policemen from Pune were
part of the team that went to her house. The police were at her home from 5:30
am today and all electronic devices were seized.Sources told The Wire that the
police took away Bharadwaj’s laptops, mobiles and a pen drive, as well as a
diary with empty pages, and Bharadwaj expressed concern that these could be
tampered with. Bharadwaj’s daughter said that the police asked both of them to
write down their email and social media passwords. When Bharadwaj’s daughter
later tried to access her social media accounts, she reportedly found that they
had been blocked. Vernon Gonsalves has also reportedly been arrested.
Gonsalves’s family has claimed they don’t yet have clarity on why he has been
taken into custody. Varavara Rao was arrested from his home in Hyderabad this
afternoon and taken to Nampally court. His family has alleged that their house
was ransacked by a team from the Pune police.Rao’s nephew Venugopal, editor of
Veekshanam Telugu magazine, told TV channel Sakshi, “This is an attempt to
stifle voices that talk about murders of Dalit and Adivasis in areas like
Gadchiroli. There is a cooked up story that V.V. Rao was connected with an
assassination attempt on PM Narendra Modi. There is no truth to it. Apart from
V.V. Rao, his two daughters and son-in-laws have been targeted. They do not
have any connection with V.V. Rao’s politics. Central Govt , Maharashtra Govt ,
aided by the Telangana Govt , are engaging in intimidation to stifle democratic
voices.”Gautam Navlakha was arrested from his home in Delhi at around 2 pm
today. The police wanted to transfer him to Pune, but a habeus corpus petition
was filed in the Delhi high court. The high court has said that it will hear
the case tomorrow morning, and placed Navlakha under house arrest till then.Arun
Ferreira was arrested from his home at around 3:15 pm. “I am been arrested in
the same case as [Sudhir] Dhawale and [Surendra] Gadling. I will be taken to
Pune now,” he said while being arrested.Police constables had been stationed
outside Ferreira’s house in Thane. Around 15 officers from the Pune police
landed up at Arun Ferriera’s place around 6 am. Ferreira, who stepped out
briefly around 2 pm, told The Wire that he was then still under interrogation.
“The police is inquiring and the process is still on. I can’t say anything
concrete right now,” Ferreira said. Ferreira, his wife Jennifer, his son and
mother-in-law were home when the Pune police reached their residence.According
to Ferreira’s family, the police told him to cooperate and said that they would
only be carrying out search raids. Only around 3 pm, he was told that he would
be taken to Pune. His wife’s laptop and pen drives have been seized, and the
entire family’s bank details have been noted, they told The Wire. The panchnamas
say that the arrested individuals will be taken to Pune later today. Among
those whose residences were raided, according to sources, were Susan Abraham,
journalist Kranthi Tekula, Father Stan Swamy and Anand Teltumbde. A relative of
Varavara Rao confirmed that his daughter Anala and son-in-law K.V. Kurmanath’s
house had also been raided, and their laptops and hard drives seized. A
relative of Abraham’s said, “Susan and Arun are defending accused in Bhima
Koregaon violence of last Jan.” Dipak Nikam, inspector, crime branch Pune, led a
team of eight Maharastra police accompanied by the local Ranchi police to the
residence of Father Stan Swami with a search notice written in Marathi. Nikam
said there is an organisation called Elgar Parishad which is suspected to have
links with the Dalit movement in Maharastra, and the Vishambagh police suspects
that Swami has links with Elgar Parishad. When The Wire spoke to Swami, he said
he has never heard of, let alone have links with, any organisation called Elgar
Parishad. Those arrested for the Bhima Koregaon violence included human rights
lawyer from Nagpur Surendra Gadling, Dalit rights activist and journalist
Sudhir Dhawale, former PM Rural
Development fellow Mahesh Raut, Rona Wilson and associate professor from Nagpur
University Shoma Sen.A number of activists and political leaders including
Swami Agnivesh, Teesta Setalvad, Jignesh Mevani, Shehla Rashid and Sanam

to allow a claimant to change his legacy document for inclusion in the draft

Jharkhand HC quashes ban on Popular Front Of
India
Jharkhand High Court has quashed State Govt’s
notification passed under section 16 of the Criminal Law Amendment Act, 1908
declaring the Popular Front of India (PFI) unlawful.Justice Rongon Mukhopadhyay
opined that the notification seemed to have been issued in “haste and in an
imprudent manner being totally oblivious to the absence of congealed materials
to declare PFI as an unlawful association”. The Court noted that the State had
issued the notification on the basis of inputs that some PFI members had left
for Syria to join ISIS. It, however, opined that the allegations were vague and
therefore quashed the notification, observing, “The State has faulted on the
decision-making process itself. Sound reasoning and rational basis should have
formed the backbone of the impugned notification. Even if in the interest of
security the reasons were not mentioned the State was not prevented to apprise
this Court of any substantive material, investigating agency may have collected
indicating the involvement of PFI in subversive activities. Neither has such
material been brought to the notice of the Court not the counter affidavit
highlights such instance which would be supportive of the decision of the State
Govt for issuing the Notification dated
21.2.2018.”The Court was hearing a petition filed by Abdul Wadud, general
secretary of PFI, challenging the notification as well as the proceedings
initiated against him and other members of the organization pursuant to the
notification. He had submitted that the aim and object of PFI is to “protect
national integration, communal harmony, peace, progress and prosperity amongst
the people, irrespective of the community to which they belonged, as also to
establish social order, freedom and justice for all, to work for the welfare
and progress of the weaker sections of the society, to protect dignity and life
of the members of marginalized part of the society, to check the menace of
casteism and communalism and to rain voice against the violation of human
rights and to protect the unity and solidarity of different social groups.”He
had then asserted that PFI had raised its voice against the leader of a
political dispensation of the State, which resulted in several members of the
organization being arrested and assaulted. He had, therefore, challenged the
notification issued by the Home Department on Feb.21, 2018, declaring the PFI
as unlawful under section 16 of the Act. Livelaw.in

Genital Mutilation Causes Irreparable
Physical, Emotional Damage to Dawoodi Bohra Girls: Supreme Court
New Delhi: The Supreme Court on Monday said
the female genital mutilation (FGM) of minor girls of the Dawoodi Bohra Muslim
community leaves a "permanent emotional and mental scar" on them and
the practice may be held as violative of dignity of women as prescribed in the
Constitution.A bench comprising Chief Justice Dipak Misra and justices A M
Khanwilkar and D Y Chandrachud referred to constitutional schemes as
interpreted by the apex court over a period of time and said "the fact
that the practice is essential religious practice does not make it
constitutional"."You just cannot inflict any kind of injury to
another person," the bench said, adding that for husbands, young girls
should not go through all this. "This
kind of mutilation leaves a permanent emotional mental scar on small girls. You
snip her genitalia," the bench said. Senior advocate A M Singhvi,
appearing for a Dawoodi Bohra Muslim group, said if this practice, which is an
essential religious practice, is questioned then somebody may challenge the
male circumcision in Muslims and there would be no end to such judicial
scrutiny. He said the petition be referred to a larger Constitution bench as it
pertained to religious practice as was the case with the Sabarimala temple
where menstruating women are denied the entry. He also referred to the triple
talaq judgment and said the present petition also raised the "substantial
question of law" pertaining to Articles 25, 26 and 29 of the Constitution
which deal with the freedom of religion and protection of religious rights of the
minorities.PTI
SC Allows Girl To Stay With Her Parents While
Hearing “Husband’s” Habeas Corpus Plea
In an inter-faith marriage case, the Supreme
Court bench headed by CJI Dipak Misra on Monday while hearing the habeas corpus
plea of a man, who claimed to have converted his religion from Islamism to
Hinduism to marry a Hindu girl, allowed the 22-year-old Hindu woman to stay
with her parents after she expressed her desire not to stay with her husband. To
a court’s query whether she is under any pressure from her parents, Anjali Jain
categorically answered that she was not willing to stay either with her husband
or in the hostel, but wanted to go with her parents. She even admitted that she
had married 33-year-old Mohd Ibrahim Siddiqui in February this year. She told
the bench that she married him after he induced her to take the step and now
she is not willing to stay with him. After recording her statement, the bench,
also comprising Justices AM Khanwilkar and DY Chandrachud, allowed Anjali to go
with her parents and modified the Chhattisgarh High Court order directing her
to be lodged in a hostel in Bilaspur. On the issue for annulment of marriage,
the court left the issue to the girl saying as she is a major and could take a
decision and the marriage issue is not before the court. The counsel for
Siddiqui requested the court to send her for examination of mental status which
was declined by the bench. The petition filed by Siddiqui challenges a judgment passed
by the high court on 30 July, when the high court had refused to allow his plea
for reuniting him with Anjali.livelaw.in

Women tying rakhis to police officers
un-Islamic: Cleric
timesofindia.indiatimes.com/city/meerut/women-tying-rakhis-to-police-officers-un-islamic-cleric/articleshow/65567833.cms
Meerut: A day after UP police officials got
women residing in their areas to tie rakhis to them under the #RakhiWithKhaki
campaign, which was launched on Raksha Bandhan in the state, a Muslim cleric
held it against the girls, saying the act of tying the threads on wrists of
cops was against Islam. “It is compulsory for Muslim women to wear a purdah and
even if they don’t want to do that, it is against Islam for any woman to touch
a man, which she has to, while tying a rakhi. Hence, I condemn this act of
Muslim women tying rakhis on the wrists of police officers,” said Ahmed Goud, a
cleric and a resident of Deoband. “Raksha Bandhan is a festival of Hindus and
is celebrated with great enthusiasm in the country. The festival became the
talk of the town after women tied Rakhis on the wrists of police officers here.
I believe that in spite of taking steps for the progress of the country, we are
treading on a path which is controversial. As far as religion is concerned,
each individual should follow his own. Trying to follow some other person’s
religion is unacceptable and will result in a clash of thoughts,” added Goud. TOI

Land allotted for rebuilding minority school
demolished 40 yrs ago: HC told
New Delhi: Delhi High Court was today informed
by the DDA that it has allotted land to the AAP Govt for constructing building for a minority
school which has been functioning from tents since its demolition over 40 years
ago during the Emergency. A bench of Acting Chief Justice Rajendra Menon and
Justice V K Rao was told that a plot of 4,000 square metres has been allotted
by the Delhi Development Authority (DDA) for the construction of the school in
Old Delhi. It noted that the competent authority had in principle granted
approval for constructing the secondary school at Eidgah at Quresh Nagar in the
walled city. The bench disposed of the petition after the petitioner expressed
satisfaction over development. The court, which was hearing a PIL seeking
reconstruction of the school building, had expressed concern after it was told
that the minority institution has been functioning from tents since its
demolition on June 30, 1976 during the Emergency. PIL filed by civil activist
Firoz Bakht Ahmed had contended that the state of affairs at the Qaumi School
was "sad and pitiable" as it was functioning from the ground of the
Eidgah at Quresh Nagar in Old Delhi after its building was demolished.PTI

SC extends stay on Gujarat HC order on
minority schools
Ahmedabad: In a relief for schools run by
minority educational institutions in Gujarat, the Supreme Court on Monday
extended the stay on the Gujarat high court's order that all schools must
obtain certificates for minority status from a competent authority. The HC last
month had also ordered that such minority schools must give admission to poor
children in class 1 on 25% of seats under the provisions of Right to Education
(RTE) Act. The schools cannot deny admission under RTE without a certificate of
minority status from a competent authority, which is National Commission for
Minority Education Institution(NCMEI) or the state education department. Some
of nearly 400 litigant schools had approached the apex court against the HC
order. During the hearing, the SC bench of Justice S A Bobde and Justice L
Nageswara Rao commented that NCMEI Act provides that it's not mandatory for a
minority institution schools to obtain declaration certificates. It is only in
the case of a dispute that the school is required to obtain such a certificate
from NCMEI, said petitioner schools' advocate Saurabh Patel. After extending
the stay earlier granted by HC on its own order, the SC has posted final
hearing on Sept. 6. There is likelihood that similar matters from Karnataka and
Orissa may be attached to this case, advocate Patel said. TOI

Punjab Assembly clears bill making sacrilege
of religious text punishable with life imprisonment
New Delhi:Amid uproar over Justice Ranjit
Singh commission report that indicted ex CM Parkash Singh Badal in the 2015 Guru Granth
Sahib sacrilege case, the Punjab Assembly on Tuesday passed a bill allowing
amendments to CrPC and IPC to make sacrilege of all religious texts punishable
with life imprisonment. This comes a year after the same bill was returned by
the Centre on the plea that it could not single out a religion. The new bill
provides for insertion of Section 295AA to IPC to provide that “whoever causes
injury, damage or sacrilege to Sri Guru Granth Sahib, Srimad Bhagwad Geeta,
Holy Quran, and Holy Bible with the intention to hurt the religious feelings of

Aadhaar cards misused to carry out big ration
scam in UP, finds probe
Lucknow:A massive scam in Public Distribution
System (PDS) has surfaced in UP revealing that the owners of ration shops have
been misusing Aadhaar Cards to siphon off subsidized ration meant for the poor
and selling it on high rate in open market.
A probe found out that hundreds of Aadhaar cards have been used over
1.80 lakh times to carry out a very large-scale corruption in the state. The
probe ordered by Alok Kumar, Commissioner,Food and Civil Supplies, revealed
that hundreds of tons of ration, meant for distribution among the card holders,
was sold by PDS shops owners in open market. Alok kumar said that so far the
department has detected anomalies in ration shops in 43 out of total 75
districts in the state.“Orders have been issued to register FIRs against PDS
shops owners involved in the ration scam. The probe is still on and many more PDS
shops are under the scanner. We will cancel licences of PDS shops after
registering criminal cases against those involved in the scam,” Kumar quated as
saying by DNA. Probe reveals that PDS shop owners hired technical operators to
change registered data. They used to change the Aadhaar details of ration cards
holders in Point of Sale (PoS) electronic machines which are used for biometric
authentication and fed new Aadhaar numbers of people who they wanted to be
benefitted. After conducting transaction from unregistered Aadhaar card the
shop owners used to restore the original data so that no corruption can be
easily detected.caravandaily

UN accuses Saudi-UAE alliance of possible war
crimes in Yemen
United
Nations has accused the Saudi-UAE military alliance of committing possible war
crimes in Yemen, adding there was "little evidence of any attempt...to
minimise civilian casualties. "In a damning report on Tuesday, the UN said
air attacks had caused the most direct civilian casualties in the war, and a
blockade of Yemeni ports and airspace may have violated international
humanitarian law.The alliance, which has been at war with Houthi rebels since
March 2015, has repeatedly denied allegations of war crimes, and claims its
attacks are not directed at civilians. However, data collected by Al Jazeera and
the Yemen Data Project, has found that almost one-third of the 16,000 air raids carried out in the country
have hit non-military sites. The attacks have targeted weddings and hospitals,
as well as water and electricity plants, killing and wounding thousands. The
charity Save the Children has estimated that an average of 130 children die
every day from extreme hunger and disease - a crisis brought about by the
conflict."The group of experts has reason to believe the Govt of Yemen, Saudi Arabia, and UAE, are
responsible for violations of human rights,"said Kamel Jendoubi, the chair
of Group of International and Regional Eminent Experts on Yemen.aljazeera
Report: Saudi's King blocked public listing of
Aramco
For the past two years, Saudi Arabia has
prepared to place up to 5% of its national oil company on the stock market.
Officials talked up the Saudi Aramco initial public offering (IPO) with
international exchanges, global banks and US President Donald Trump. The planned
listing was to be the cornerstone of the kingdom’s promised economic overhaul
and, at a targeted $100bn - the biggest IPO ever. It was the brainchild of
32-year-old Crown Prince Mohammed bin Salman, also known as MBS, the heir
apparent of world's largest oil exporter. But after months of setbacks, international
and domestic legs of the IPO were pulled. The reason: MBS's father King Salman
stepped in to shelve it, 3 sources with ties to Govt insiders told Reuters news agency. The decision
came after the king met with family members, bankers, and senior oil
executives, including a former Aramco CEO, said one of the sources, who
requested anonymity. Those consultations took place during Ramadan, which ended
in the middle of June.King's interlocutors told him IPO, far from helping the
kingdom, would undermine it. Their main concern was an IPO would bring full
public disclosure of Aramco's financial details, the sources said.aljazeera
Hamas: Between unity with Fatah and a deal
with Israel
On Saturday, a Palestinian Authority (PA)
delegation departed for Egypt to discuss reconciliation with Hamas and the
ongoing negotiations with Israel for de-escalation in Gaza. This visit comes
after weeks of tensions between Ramallah and Cairo, marking the lowest point in
relations between the two in recent years. Reports have been circulating that President
Mahmoud Abbas has become increasingly angered by the Egyptian Govt, fearing its
alleged role in the "deal of the century" and its disregard for
Ramallah's interests in Gaza. Egypt has been given the green light by the US
and Israel to lead efforts to reconcile Fatah and Hamas and form a unity Govt
meant to usher the PA back into power in the Gaza Strip. It has also been
mediating in de-escalation negotiations between Israel and Hamas, which Fatah
views with suspicion. But given the increasing hostility and intransigence in
relations between the 2 main Palestinian factions, it paradoxically appears
that the Palestinians are more ready to conclude a truce with the Israelis than
reconcile with each other. aljazeera
Catholic priest calls for civil disobedience against
PA
Senior Roman Catholic priest Monsignor Manuel
Musallam has called for resistance against the Palestinian Authority and the
Israeli authorities in occupied Palestine and abroad, Shehab.ps reported on Monday.
He called specifically for acts of civil disobedience in the occupied West
Bank. The veteran activist and member of the Islamic-Christian Committee to
Protect Holy Sites told Shehab that the Palestinian resistance should establish
an army and announce obligatory service across Palestine and in the diaspora.
Protest tents, he added, should be erected in front of the office of PA
President Mahmoud Abbas to “scream” in his face.“He [Abbas] must not be let go
while Gaza is suffering,” explained Monsignor Musallam. “He and PLO must be
compelled to lift their sanctions on Gaza.” This, he suggested, could not be
achieved peacefully, but through massive demonstrations and civil disobedience.
“The problem which Fatah does not recognise is that the Palestinian people are
not ruled by a single faction. Palestinians must choose their leadership from
all Palestinian factions.”MEMO
Iranian parliament refers Rouhani to judiciary
Iran's parliament has referred President
Hassan Rouhani to the country's judiciary after he failed to impress
legislators with his explanation of his Govt's handling of Iran's economic
struggles. Rouhani was summoned by parliament on Tuesday for the first time
since taking power five years ago to answer questions on a range of economic
issues, including unemployment and inflation. In voting after the session, which
was broadcast live on state television, MPs expressed dissatisfaction with four
out of five of Rouhani's responses. The leader has been under intense pressure
since US President Donald Trump withdrew from a landmark nuclear deal between
Iran and several world powers, worsening an economic crisis and sparkings a
series of domestic protests. In Tuesday's session, he blamed Iran's economic
woes on an "American conspiracy" and urged parliament to support his
cabinet."There is an anti-Iran group sitting in the White House that is
planning a conspiracy against us," Rouhani said. "But together we
will tackle this phase. Parliament has already impeached Rouhani's labour and
economy ministers this month and the president replaced the head of the central
bank, amid concerns about the sharp depreciation of the national currency,
which has lost more than half of its
value since April.aljazeera

Pakistan condemns blasphemous Dutch cartoon

Pakistan's senate has unanimously passed a
resolution condemning an anti-Islam cartoon contest planned by a far-right
Dutch politician - one of the first actions taken by the assembly since last
month's general election. Senators in the upper house of parliament formally
protested on Monday the announcement by Dutch opposition MP Geert Wilders to
hold a Prophet Muhammad caricature competition in the Netherlands later this
year. In his first address to the senate in the capital, Islamabad, newly
elected PM Imran Khan vowed to take the issue to the UN General Assembly in
September, calling it a "collective failure of the Muslim world".
"Very few in the West understand the pain caused to Muslims by such
blasphemous activities," said Khan."Our Govt will raise the matter in
the Organisation of Islamic Cooperation and get the countries there to come up
with a collective policy that could then be brought up at international forums.
This should have been done a long time ago."I understand the Western
mindset as I have spent a lot of time there. They do not understand the love
