Modi govt exploring law on
banning beef & cow slaughter
New Delhi: Setting the ball
rolling for a possible law banning beef and cow slaughter, the Union
environment ministry has asked the agriculture ministry to explore the option
of enacting a national law to prohibit slaughtering of cow, selling of beef or
beef products. Anil Madhav Dave-led ministry of Environment, Forest and Climate
Change (MoEFCC) sent a letter to this effect to Union agriculture ministry’s
Department of Animal Husbandry, Dairying and Fisheries (Cattle Division) on 23
Dec. Mint has reviewed a copy of the letter.It is not the first instance when
protection of cow, considered holy by a section of Hindus, is in news. Since
May 2014, when the NDA govt led by BJP assumed power, there have been several
occasions when the issue of cow protection has been in the limelight.MoEFCC
letter seems to be in response to a July 2016 judgment by the Himachal High
Court asking the Central govt to, “enact the law prohibiting slaughtering of
cow/calf, import or export of cow/calf, selling of beef or beef products, in
its wisdom, at national level”.“In view of the fact that slaughtering of
cow/calf, import or export of cow/calf, selling of beef or beef products and
related matters fall under the administration of Department of Animal
Husbandry, Dairying and Fisheries (cattle division), it is required that
necessary action in the matter may kindly be taken,” said the MoEFCC letter.Meanwhile,
there have been demands to declare cow as India’s national animal replacing
tiger. The home ministry has discussed ways to check cattle (mainly cows)
smuggling to Bangladesh. The environment ministry has also asked the Animal
Welfare Board of India to assess the cost of building new cow shelters and

Re-promulgation of
ordinances is 'fraud' on Constitution: Supreme Court
New Delhi: The Supreme
Court has held that re-promulgation of ordinances without being placed before
the legislature was constitutionally impermissible as it amounted to bypassing
the legislative body which was the primary source of lawmaking authority in a
parliamentary democracy. A 7-judge constitution bench held that govt's decision
to bring ordinance can be reviewed by judiciary and said that it was obligatory
on the govt to place the ordinance before the legislative body for its
approval. Failure of govts, at the Centre as well as states, to place
ordinances before Parliament and state legislatures would itself constitute a
fraud on the Constitution.The majority verdict, by Justices AK Goel, UU Lalit,
DY Chandrachud and L Nageswara Rao, held that "re-promulgation defeats the
constitutional scheme under which a limited power to frame ordinances has been
conferred upon the President and governors". "The danger of
re-promulgation lies in the threat which it poses to the sovereignty of
Parliament and the state legislatures which have been constituted as primary
law-givers under the Constitution. Open legislative debate and discussion
provides sunshine which separates secrecy of ordinance-making from transparent
and accountable governance through lawmaking," it said.Chief Justice TS
Thakur, who was heading the bench, also agreed with majority verdict on the
issue but differed on one aspect. "I am in complete agreement with the
view expressed by my esteemed brother Chandrachud,that repeated repromulgation
of the ordinances was a fraud on the Constitution especially when the govt of the time appears to have persistently
avoided the placement of the ordinances before the legislature." CJI,
however, questioned whether it is mandatory for the govt to place the ordinance
before legislative body saying that the matter should be examined in a separate
proceeding. The court said that SC's `hope and trust' that lawmaking through
re-promulgated ordinances would not become the norm had been belied by

SC bans religion, caste in poll
campaigns: Kancha Ilaiah says inclusion of caste in judgement was "unfortunate".
Kancha Ilaiah, a prominent
writer and political scientist based in Hyderabad, told Al Jazeera that the
inclusion of caste in the Supreme Court judgement was "unfortunate". "Verdict
said mobilising voters on the basis of caste, race, language and religion
amounted to corruption," he said. Ilaiah, who belongs to the Dalit caste,
India's so-called lowest caste, said the judgement undermines the ability of
his social class to use politics as a means for their upliftment."The SC
now says we cannot use the caste issue for our liberation, for our equality. If
they say that, then how do we achieve our liberation? What about the right to
speak about my oppression?" Ilaiah said. "It is as if the SC has said
[our enslavement] cannot be used as an instrument to fight back," he
added.However, Ilaiah believes the judgement means that parties like BJP could
no longer openly intimidate minorities or use "Babri [a demolished mosque]

argue that candidates should not be barred from addressing their “legitimate
expectation” that deprivation due to these “immutable characteristics” will be
remedied through the electoral process.Stating that issues of religion, caste,
etc. “are crucial to maintaining a stable balance in the governance of the
nation,” the minority view in the 4-3 judgment said that “the spirit of
discussion, debate and dialogue sustains constitutional democracy” and “a sense
of inclusion can only be fostered by protecting the right of citizens freely to
engage in a dialogue in public spaces”.Deliberation on religion, caste, etc. is
the affirmation of “constitutionally protected values and…an intrinsic part of
the freedom of speech and expression”, held the minority view, and warned that
imposing a prohibition on electoral discourse on issues pertaining to caste,
race, community, religion or language might reduce democracy to “an
abstraction” apart from restricting the fundamental right of freedom of speech

“matters of constitutional importance,” the minority judgment, authored by

the political parties in poll-bound Punjab, where sacrilege is an issue, and

Congress called the judgment a blow to the ruling party, Shiromani Akali Dal
(SAD), the latter sought to downplay it by saying they had never used religion
to seek votes.Referring to the SC verdict that politicians can’t use religion,
caste, creed or language for seeking votes, state Congress president Captain
Amarinder Singh said the order has far reaching implications for Punjab where
the Akalis have always misused religion to seek votes. He said even today,
Akali leaders were taking people to gurdwaras and making them swear their
support to the SAD.Amarinder alleged that many Akali leaders were holding
‘ardaas’ outside gurdwaras to influence people to cast their vote on basis of
their religion. He also accused the Akalis of misusing Sikh Gurdwara Parbandhak
Committee (SGPC) for electoral purposes.The SAD, however, put up a brave front
on the issue. “There is no doubt that the SAD is a party for which Sikhism is a
core value and politics and religion in Punjab are in a way inseparable. But it
is a disciplined party and has never used religion, caste, etc for elections.

New Delhi: Continuing with
its spate of show-cause notices, JNU administration has now issued a notice to
student union president Mohit Pandey warning him of action if the protests at
the administrative block are not stopped. Following chaos in Academic Council
(AC) meeting, the administration has also sought police presence for the
Executive Council (EC) meeting scheduled today. 9 students were suspended for
allegedly "disrupting" the AC meeting along with a teacher who was
served notice for addressing them."The series of show-cause notices and
suspensions are just an attempt by the administration to attack the student
unity and destroy the protest culture at the varsity. The suspended students
have refused to appear before the enquiry committee and we will protest outside

Mumbai: With the
office-bearers of banned IRF untraceable, the Mumbai Police has not been able
to serve a notice on it to appear before a judicial tribunal that was formed to
look into the ban. After the Central govt notified the UAPA comprising Delhi
High Court Justice Sangita Dhingra Sehgal to adjudicate whether there was a
just cause to declare IRF as an ‘unlawful association’, the tribunal issued a
notice to the IRF to appear before the tribunal on Feb.6. Tribunal has given
televangelist Zakir Naik’s IRF 30 days to provide its written objections to the
ban.However,Mumbai Police has only been able to paste a copy of the notice at
the IRF office on Tandel Street in Dongri. The office has been shut ever since
the organisation was banned by Union Ministry for Home Affairs in Nov.Officers
at the Dongri police station have spent the last week tracing home addresses of
IRF’s office-bearers after the tribunal was not satisfied with its initial
efforts. “At first, we served a copy of the notice on IRF’s lawyer Mubin
Solkar. But the tribunal has instructed us to serve copy only to the

2008 Malegaon blasts: Court
allows NIA to use copies of missing documents as evidence
Mumbai: A special court has
allowed NIA to use available copies as secondary evidence in place of papers
that have gone missing in the 2008 Malegaon blasts case. In April last year,
the special NIA court had been informed that some original documents that were
part of the evidence were untraceable. These included 13 witness statements
recorded by Maharashtra ATS under Section 164 of Criminal Procedure Code and
two statements of the accused recorded under the MCOCA.In Sept., NIA, which
took over the probe in 2011, had approached the court seeking permission to use
photocopies of the original documents. The accused, including Lieutenant
Colonel Prasad Purohit, had opposed the plea, stating they had been provided
truncated copies, and their authenticity was not verified.Special public
prosecutor Avinash Rasal said the court observed that among the documents were
various statements available with the investigators, including the ATS and the
NIA. Case is at the stage of framing of charges against the 11 accused,
including Sadhvi Pragya Singh Thakur, Major Ramesh Upadhyay, Sameer Kulkarni

urged the govt to implement the Sachar Committee recommendations with honest

of Delhi University said:"There were two major recommendations (of Sachar
Committee). First, diversity index to be applied in all public and private
organizations. This is still on paper only. Unless we really apply this index
we don’t realize whom we are missing out. Second was to set up a National Data
Bank. We still don’t know whether govt has any policy about this yet.The
present govt has in fact almost dropped Right to Education Act. This was
strongly recommended to be implemented with special emphasis in Muslim

Damascus: A chilling video
released by the Islamic State says that leaders like Narendra Modi, Recep
Tayyip Erdogan and Vladimir Putin, among others, work against the interest of
Muslims and Islam. In a gory 19-minute clip, which is filled with bloodshed and
devastation in Syria, has a voice over in Arabic and Turkish. The video is
titled--The Cross Shield. In the video, the IS speaks about how these leaders
are to be blamed for the bloodshed in Syria. The main focus of the video is
around Erdogan who is blamed for the war in Syria. In the 19-minute clip, there
is a picture of Modi with Erdogan, which was clicked at the G-20 Summit in
Turkey in November. Apart from Modi and ErdoÄŸan, the video goes on to blame US
President Barack Obama, Russian President Putin, Syrian President Bashar
al-Assad and Pope Francis for working against the interest of Muslims and
Islam.Video also makes references to the situation in Afghanistan.Video which

Russia is to host a meeting
for the major Palestinian factions on 15 January, local news agency TASS
reported. Russian news agency said that senior PLO official Wasel Abu Yousef
told the Israeli newspaper the Jerusalem Post about this planned meeting.Quds
Press also reported a senior Palestinian official discussing the meeting. The
news organisation did not name the official but said the meeting would discuss
the reorganisation of Palestinian institutions.“The Russians will host a
meeting of Fatah, Hamas and other Palestinian officials in Moscow in the middle
of January to discuss reconciliation,” Abu Yousef said.TASS reported the Deputy
Russian Foreign Minister and Special Presidential Envoy for the Middle East and
North Africa Mikhail Bogdanov saying on 3 June 2016 that, in addition to
Israeli settlements, “the split among Palestinians is another negative factor
hampering the peace progress”. “Russia fully supports efforts on soonest
restoration of inter-Palestinian unity on the basis of PLO and the Arab Peace
Initiative, holds dialogue with representatives of the whole range of
Palestinian forces, first of all Fatah and Hamas, in the interests of achieving

Press that this meeting would not be more than a show of public relations for

Recapturing Mosul is ‘a

country, is likely to take weeks, the French President Francois Hollande said
on a visit to Baghdad on Monday. He vowed to continue supporting Iraq in its
