Delhi: The sensational and unprecedented press conference by 4 senior sitting
Justices of the Supreme Court raising serious concerns about the functioning of
the judiciary has come on the eve of the hearing of the controversial Ram
Janambhoomi-Babri Masjid case that has generated chaos and conflict at
different points of what is now a seven decade old issue. The Supreme Court’s 3
member Bench had fixed Feb.8, 2018 as the day for hearing the civil appeals in
the title dispute despite protests from senior advocates pleading against the haste,
and asking for the case to be deferred till 2019 after the general elections.
The Supreme Court constituted a Bench---Chief Justice Dipak Mishra, Justice
Ashok Bhushan and Justice Abdul Nazeer--- to look into the slew of petitions on
December 5, just a day before the demolition of the historic mosque in 1992.
The significance of the date was not lost on political leaders and activists.
At the core of this dispute is the belief that Lord Ram was born 900000 years
ago in Treta Yuga, a room located under the central dome of the mosque that was
thus demolished by right wing groups in the presence of senior leaders LK
Advani, Uma Bharti, Murli Manohar Joshi on the said date.The Supreme Court
judgement is expected to have momentous impact, particularly in the present
environment with construction of the Ram Mandir central to the BJP/RSS movement
for the same. The final hearing by the apex court will run through several
crucial state Assembly elections before the Lok Sabha polls in 2019. Chief
Justice Mishra dismissed pleas for a five member Bench at the onset.For the
record, Justice Bhushan started his career in advocacy in Uttar Pradesh and was
a permanent judge with the Allahabad High Court. He was appointed Judge of the
High Court of Kerala in July 2014, Acting Chief Justice in July 2104, Chief
Justice in March 2015 in a speedy rise. He was appointed Judge in the Supreme
Court in My 2016.And Justice Nazeer has the distinction of perhaps being just
the third judge to be elevated directly to the Supreme Court without being a
Chief Justice of a High Court. He took office in February 2017, having earlier
been an Additional Judge of the Karnataka High Court.On December 5 the apex
court saw heated exchanges with senior advocates Kapil Sibal,Dushyant Dave and
Rajiv Dhawan representing different petitioners insisting the case be deferred.
At one point they threatened to walk out insisting they were “not being given a
fair chance.” Sibal who is representing the Sunni Board pointed out that,
"BJP leader Dr Subramanian Swamy had gone on record saying that Ram temple
would be built before 2019 through legal means. They want to make it as an
election manifesto and the court should not fall into the trap. These appeals
are not ordinary property disputes as they go to the heart of secular fabric of
the country.”Sibal also asked the Bench why it was rushing to hear the case
now. And if there is this haste then “Why wasnt it heard when it was filed? Why
now? Why haven’t the contempt cases (over the demolition) been heard so far? There
are some 19,000 documents to be studied in the case.”Sibal said it was one of
the most important litigations in the history of India and required time .”It
impacts on the future of India”, he said urging the Bench that it should be
heard “after everything is over in July 2019.” Dhavan pointed out that teh
case, “goes into the heart of a democratic, secular nature of a democracy. A
mosque was destroyed in this country. You can't run away from this fact. This
is not an ordinary case.”Lawyers Harish Salve and CS Vaidyanathan, who were
representing the other side, insisted that the court must treat the Ayodhya
case like any other. CJI Misra supported this view expressing “shock and
surprise” and maintaining that the judges were not “bothered about what’s happening
outside.” Senior BJP leaders including Chief Minister of UP Yogi Adityanath,
who won the elections last year, have spoken on the issue, maintaining that the
people want the temple, but the matter was sub judice , so they would wait for

on Sunday to resolve judicial crisis
As the crisis triggered by the revolt of 4
Supreme Court judges lingered, Chief Justice Dipak Misra and the rebel judges
may meet on Sunday to resolve the problems raked up by them as two of the
dissenting judges on Saturday sought to play down the issue.Three of the four
judges, who had attacked the Chief Justice at a press conference here on
Friday, were away from the capital and are expected to return on Sunday
afternoon. There was no official confirmation about reports that Justice Misra
will be meeting with the rebel judges.IANS

should resolve, say ex-CJIs
New Delhi: Expressing “shock” over the
unprecedented press conference Friday by the 4 most senior judges of the
Supreme Court, former Chief Justices of India said the Govt should not “interfere” in the matter, and
that CJI should “resolve the crisis with statesmanship”.Saying he was “pained”
by the developments, ex-Chief Justice RM Lodha questioned how such an issue
could have remained pending for two months.“I am disturbed by today’s
development. What happened today is unfortunate and painful for a person who
presided over an institution like the Supreme Court. Unfortunately, the letter
(made public) reveals that certain grievances were raised by the most senior 4
judges about two months ago. Obviously, the Chief Justice ought to have
discussed it with them and addressed those issues. Ultimately, CJI, being
leader of the institution, has to show statesmanship and ensure that grievances
are resolved. There is no role for the executive. This matter is exclusively
within the judiciary and should be resolved within the judiciary,” Justice Lodha
said. “And the issues that have been
raised should be resolved by the CJI. It goes without saying that the CJI is
the master of the roster but transparency is always maintained. But if there
was a very specific issue raised in this regard – that had to be discussed and
resolved… the issue should not have remained pending for two months. The way
forward is that they must sit together and openly discuss the issue. They
should be no constraint and they should collectively find a solution,” Justice
Lodha said.EX-CJI KG Balakrishnan said the press conference Friday will “erode
the credibility” of the Supreme Court in the eyes of the people, and that if
the crisis continues, it will “cut the root of democracy”. “It is a very
unfortunate situation. No other top court in the world has acted in this way,”
he said. Ex- Supreme Court judge KT Thomas said judges holding press a
conference “should not become a precedent” and if the “executive is reasonably
wise enough” it should keep away from the crisis.“CJI is the master of the
roster and it is a time-tested convention among constitutional courts. His
power is like that of a captain of a team. To say that some cases should be
allocated to one judge and not another judge – I don’t understand. How can one
judge be disqualified from hearing any case? This dispute should be resolved by
the full court. And if an executive is reasonably wise enough, they should keep
away from it. This is an internal matter of the Supreme Court,” Justice Thomas

never thought I will come across such a situation in my 67 years at the

New Delhi:Firing a fresh salvo at the Govt,
disgruntled BJP leader Yashwant Sinha on Saturday asked his party colleagues
and ministers to “get rid of their fear” and “speak up for democracy” like the 4
SC judges who came out publicly against the chief justice.He referred to the comments of 4 judges to claim
that prevailing atmosphere was like Emergency in 1975-77 and voiced concern
over short parliamentary sessions.If Parliament is compromised, SC is not in
order, then democracy is threatened, he told reporters. Sinha said “if four
senior most Supreme Court judges say democracy is under threat, we have to take
their words very seriously.”“Every citizen who feels for democracy should speak
up. I will ask party (BJP) leaders and senior cabinet ministers to speak up. I

New Delhi: Members of the legal fraternity on
Friday dubbed the apprehensions of four senior judges about the Supreme Court’s
functioning a “major concern”, with one claiming that the issue may “just be
the tip of the iceberg”.Senior Supreme Court lawyer Prashant Bhushan said he
had not seen such “blatant abuse of power” during his legal career. “I have not
seen such blatant abuse of power (in exercise of assigning cases by the Chief
Justice of India) as in the case of the present Chief Justice… if he has any
self respect, he would resign. Because, for the 4 most senior judges of the
Supreme Court, it clearly expresses public loss of confidence or lack of

New Delhi: The Supreme Court has sought
response from the Maharashtra Govt on pleas seeking an independent probe into
the alleged mysterious death of special CBI judge BH Loya who was hearing the
sensitive Sohrabuddin Sheikh encounter case, PTI has reported. Underlining it
to be a “serious” issue, the top court also said, “This matter requires
bi-party hearing rather than exparte”.A bench of Justices Arun Mishra and MM
Shantanagoudar asked the Maharasthra Govt
to file reply by Jan.15 when the next hearing will be held. Judge Loya
died in Nagpur on Dec.1, 2014, when he had gone to attend the wedding of a
colleague’s daughter. Te issue came in the spotlight in Nov. last year after a
report by Caravan magazine linking the circumstances surrounding his death to
the trial in Sohrabuddin case. Journalist BR Lone had filed an independent plea
seeking a fair probe into the alleged mysterious death of Loya.Lone’s petition
was mentioned before a bench of CJI Dipak Misra and Justices A M Khanwilkar and
DY Chandrachud on Jan.11 and it sought a probe saying there were several
contradictions emerging in the matter.

Govt mulls to revive missile deal with Israel

New Delhi: Indian army and the Govt are
discussing ways to revive a USD 500 million order to buy Spike anti-tank guided
missiles from Israel's state-owned defence contractor Rafael, Army chief Bipin
Rawat has said.New Delhi recently called off the deal to procure 8,000
missiles, souring the build up to Israel PM Benjamin Netanyahu's visit to India
this week. General Rawat said the deal was scrapped after the state-run DRDO
offered to manufacture similar missiles in line with PM Narendra Modi's 'Make in India' initiative."They
(DRDO) said... why you are going for a missile that we are capable of
manufacturing and can give you better results," General Rawat
said."That is what led to retracting of the RFP (request for
proposal)," he added.General Rawat said the DRDO missiles were yet to be
tested and would not be ready till 2022, which could hit India's operational
capabilities in the interim."So how do we bridge the gap between now and

than one vote in UN, Israeli Ambassador to India Daniel Carmon said on Friday,
referring to New Delhi’s vote against US President Donald Trump’s decision to
recognise Jerusalem as Israel’s capital.“Question is if it will influence our
relationship or if it can influence the relationship,” Carmon said in response
to a question ahead of Israeli PM Benjamin Netanyahu’s visit to India starting
Sunday.“I think the relationship is much stronger than one vote in the UN here
and there,” he said.Last month, India joined the overwhelming Assembly majority
to vote for the resolution that demanded that US comply with UNSC decisions

Just 4.9% of higher edu teachers are Muslim
New Delhi: At 4.9%, Muslim representation
among teachers in higher educational institutions in India is much lower than
the community’s proportion in India’s population (14.2%), going by the recently
released All India Survey on Higher Education for 2016-17.The representation of
the Scheduled Castes and Scheduled Tribes is also lower than the populations of
the two categories. While the survey, done by the Ministry of HRD, shows the
representation of SCs at 8.3% of the total number of teachers in higher
educational institutions, ST representation is 2.2%. The SCs account for 16.6%
of India’s population and STs about 8.6%.“At the all-India level, teachers
belonging to the general category are more than half, that is, 58.2% of the
total number of teachers in India; OBCs follow at 31.3%,” says the survey

Aligarh School Portrays Zakir Naik As An
'Important Islamic Personality' In Book, Issued Notice By UP Govt
Aligarh-based Islamic Mission School has come
under the scanner of UP Govt on Friday
for allegedly portraying Zakir Naik as "an important Islamic
personality" in a book published by it. The state education department has
ordered an inquiry and issued a show cause notice to the school in this
regard.News Indian Express reported that the book called ‘Ilm-un-Nafe’, which
is the part of curriculum in Islamic Mission School, has a chapter talking
about the Islamic heroes figuring Zakir Naik as well. Hindustan Times reported
that the Class 1 book has chapters on 9 famous Muslim personalities. One of
them features Naik, founder of Mumbai-based NGO – IRF.The school management
claimed that the book – aimed at enhancing children’s general knowledge – was
published two years back, but in the new session the chapter on Naik would be
removed from it, the HT report added.“The book has chapters on renowned Muslims
and one chapter is on Zakir Naik,” the author of the book, Kunen Kausar, who is
also the manager of the school, told the newspaper.Kausar, however added that
when the book was published two years back, there was no case against Naik. Now,
the chapter on him will be removed.Aligarh Basic Shiksha Adhikari , Dhirendra
Kumar said that Naik’s depiction as a hero fell in the category of
anti-national activity. “After giving notice to the school, action will be

Army chief Rawat calls for 'some' control over
mosques, madrasas
New Delhi:Social media and Govt schools in
J&K are spreading “disinformation campaign” resulting in radicalisation of youth,
Army Chief General Bipin Rawat claimed
on Friday, and called for “some control” over mosques and madrasas in the
state. He said a “major revamp” of the education system was needed in the state
to deal with the problem. Rawat said the issue of exercising some amount of
control over mosques and madrasas to check the flow of disinformation was being
looked into.Addressing a press conference on the eve of the Army Day, Rawat
said each classroom in Govt schools in

besides that of India which sowed the seeds of thought of some kind of
“separate identity” among the children.“The damage done to us is through the
social media. A very large amount of disinformation campaign is being spread in

General Bipin Rawat, J&K Education Minister Altaf Bukhari said that the
chief is not an educationist and since education is a state subject, the
Govt knows how to run schools. The
criticism came in the wake of COAS statement, saying school education system in
Govt schools in J&K has been corrupted, and that they have two maps in
classrooms: one of India and the other of J&K.Bukhari said that the state
has its own constitution and the Indian constitution, similarly, every school
has a state map as it is needed to teach students about the state. Bukhari
said, “There are two flags in the state, we have J&K constitution and
India’s constitution also. Every school has a state map as it is needed to

Kawa ,who was arrested in Delhi in connection with the Red Fort attack case, on
Friday termed his arrest illegal and accused police of framing him in a fake
case. They also said that he was never absconding and also owns a house in
Delhi. The family and relatives blamed the media for projecting an “innocent
civilian” as a “terrorist” and demanded his immediate release. According to his
relatives, Ahmad is married and a father to 2 young daughters. The family
members and their relatives demonstrated in the city’s Press Colony on
Friday.They said Bilal owns a house near Sadar Bazar, New Delhi, and had gone
to the national capital for a medical check-up.“My son went to New Delhi for a
checkup as he has a health problem. His brother who lives in Delhi told him to
come and he was detained at the airport,’’ said Ahmad’s mother Fatima Begum. She
said that if he was involved in militancy, he would have never gone to Delhi on
his own name. “Now my son is being framed in a fake case.He was a frequent
traveller to Delhi.’’She said Ahmad was carrying household and food items when
he was picked up by the police at the airport. ‘’The claims of police that my son
was planning an attack on Jan. 26 are all fake and fabricated. After his
arrest, police told us that he will be released and asked us not to tell anyone
about his arrest. But then they released the news in the media.’’Bilal’s cousin
asked that if police were looking for him, how come he managed to get all sorts
of documents on his own name. “His house is located near a CRPF camp in

killed and over 9,000 injured, including over 6,000 due to pellets, during the
eight months-long unrest in Kashmir after the killing of Hizbul Mujahideen
terrorist Burhan Wani in 2016.In a written reply to the question of a National

Mehbooba Mufti today said 51 people were killed in Kashmir division from
July 8, 2016 to February 27, 2017 in the unrest.She said 9,042 people were
injured in firing of bullets, pellets, pava-shells and others during the

Lucknow:Maharashtra wing of Jamiat
Ulama-e-Hind (JUH) sent a legal notice to UP Shia Waqf Board chairperson,
Waseem Rizvi for his letter to PM
calling madrasas terrorists producing centres. The body has sought a
written apology from Rizvi for his controversial statements while also
demanding Rs 20 crores as defamatory damages to the body.The letter states that
Rizvi has made his statements with an intent to harm the Sunni community and
create a rift between Shias and Sunnis.

on late Thursday night snowballed into a major communal build-up leading to
vandalism and arson injuring around two dozen people including an SDM and 3
cops in Ghoorpur locality of Allahabad city on Friday.The situation turned
tense after 2 neighbours --Dhamrendra Patel, 22,son of Subhash and Wasim, son
of Salim – in Ghoorpur, indulged a scuffle over bonfire on Thursday night. In
fact, Dharmendra confronted Wasim for taking away some husk (puaal) kept near
his house without asking him to ignite the bonfire.Both sparred over the issue
and after the intervention of elders, the issue subsided on Thursday night.
Next morning, Wasim and his aides attacked Dharmendra with a knife and injured

‘Ansari not given proper treatment, sent back to jail under govt pressure’
Lucknow: Jailed BSP MLA Mukhtar Ansari’s
family alleged that he was not provided proper treatment after he suffered a
heart attack and was “hurriedly” sent back to Banda district jail due to
“pressure” from the state Govt .After he reportedly suffered a heart attack on
Tuesday,prison authorities had referred Mukhtar to SGPGI in Lucknow for an
examination. He was discharged and shifted back to the district jail on
Thursday. Mukhtar’s brother and ex-MP Afzal Ansari on Friday said he suspected
a “conspiracy” behind his brother not being provided the “required medical
help”. He said, “Doctors in Banda had informed us that Mukhtar had suffered a
heart attack and they referred him to Lucknow’s SGPGI for treatment. Doctors at
SGPGI, after examining Mukhtar, had told us that his condition is serious and
examination report is positive.They conducted Mukhtar’s angiography and later
said there is no serious blockage found in the veins.Doctors had told us that
Mukhtar would be kept under observation for 72 hours and would be discharged
only after his condition is found to be stable.”IE
Afrazul case chargesheet: Enmity between

Jaipur: Rajasthan police have completed its
probe into the murder of Afrazul, a labourer from West Bengal who was killed in
Rajsamand district of Rajasthan, and have filed the chargesheet against the
accused, Shambhulal Regar, officials said Friday. Regar was arrested on
December 7 in Rajsamand district, a day after he allegedly murdered Afrazul and
filmed the act with the help of his minor nephew. Regar recorded several videos
in which he went on an anti-Islam diatribe.“The chargesheet in the case has
been filed and the documents were submitted to the court of the chief judicial
magistrate here in Rajsamand today,” Rajsamand SP Manoj Kumar said. The
investigation was done for over a month given the seriousness of the case, the
police said. “Chargehseet is 413-page-long and we have made 68 witnesses in the
case. Evidence, including material and digital, has been cited along with the

technology minister Ravi Shankar Prasad said the legislation that makes instant
triple talaq a criminal offence had been widely welcomed by Muslim women and
organisations representing them. They had met him at his residence, he
said."The hope it (new law) has generated among victim Muslim women is
very assuring," he said. "Many of them told me why only three years,
why not seven or ten years (of jail time)? Why not enforce it with
retrospective effect?" The new law is "a transformative initiative
for India," Prasad said. "I would urge those who are opposing it to
rise beyond politics of vote bank... Even otherwise, nearly 9 crore of 18 crore
Muslim population is not a small number," he said, referring to Muslim

Thursday rejected the Triple Talaq Bill, calling it “meaningless”. It also
questioned the Govt’s intention on the Uniform Civil Code.“If the Govt is serious
about bringing a Uniform Civil Code, why doesn’t it come with a draft of such a
legislation and put it in the public domain for open discussion and
suggestions?” JIH president Maulana Jalaluddin Umari said.“They keep using it
to frighten the minorities, but in reality can they bring a uniform code for
such a diverse population with numerous ethnicites, tribes, religions and
belief systems and cultures and traditions.” Criticising the Triple Talaq Bill,
Umari said, “It is against the rights of women as there are a many cases where
a Muslim wife wants to get rid of her husband immediately. She does not want to
continue being his wife even for a day. She wants her freedom by opting out of
marriage with immediate effect. Are we not going to prolong her agony by

Delhi: Alleging that the number of persons declared as foreigners in Assam has
increased dramatically during the BJP regime, the Jamaat-e-Islami Hind (JIH)
has formed a three-member committee to look into the entire NRC issue.The
committee will also help the economically and educationally backward people to
comply with the necessary documentary requirements for citizenship, JIH
president Maulana Syed Jalaluddin Umari said addressing a press conference
here. He said Jamaat-e-Islami Hind was deeply concerned with the publication of
the draft NRC in Assam. “Thus far, the NRC has held 1.9 crore people of the 3.3
crore applicants to be valid and bona fide citizens of India. The fate of 1.4

drafted and brought by the Modi Govt , is politically motivated, feels the
Muslim intelligentsia cutting across sectarian lines and schools of thought --
but they are happy that the controversy has created awareness in the public
mind about the evils of the practice. Is the saffron party indeed serious about
addressing the root issue of the social evil called instant divorce, and wants
it stopped, or is it indulging in political posturing? The latter, say an
overwhelming majority of stakeholders -- from "fundamentalists" to
liberals, Islamic clerics and women rights activists.They think that the bill
in its present form cannot stand judicial scrutiny."It's an atrocious
piece of legislation which is against the constitution because it discriminates
on the basis of religion," Irfan Ali Engineer, Director, Centre for Study
of Society and Secularism, Mumbai, told IANS.Jamat-e-Islami Hind General
Secretary Mohammed Salim Engineer said he could not understand the objective of
this legislation."If the said bill had held three talaqs (divorces) as
one, it would have made some sense. Which would mean that a divorce will not
take place no matter how many times a man utters the word 'talaq' in one
sitting, and which is in consonance with several schools of Islamic
jurisprudence," he said. Muslim Majlis-e-Mushawarat Chairman Navaid Hamid
had a similar view: "This bill is clearly faulty. In many Muslim sects,
talaq pronounced thrice is treated as only one talaq. But this bill would hold
a person of any sect guilty no matter if as per his belief irrevocable talaq
has not happened."Shia cleric Maulana Kalbe Sadiq, who is opposed to
instant divorce and wants it abolished, could not find a reason to justify the
penal provision in the bill. owever, amid the heat of discussion on tripel

positive in the whole discourse."One benefit of this entire brouhaha has
been that common people have got some awareness about the evil of triple talaq.

Nagpur: The Jamaat-e-Islami Hind, Maharashtra,
has taken the initiative to spread the message of peace through teachings of Quran.
The speakers invited at the inaugural ceremony of 'Islam for peace, progress
and salvation' campaign said proper interpretation of the religious text must
be propagated among the public to debunk misinformed notions about the
religion.The programme was held at Shikshak Sahakari Bank Hall, Mahal, on
Friday. DCP Rahul Maknikar, former chief of Akhil Bharatiya Marathi Sahitya
Sammelan Shripal Sabnis, and state president of JIH Taufiq Aslam were
present.The peace campaign will be carried out through talks and symposia
throughout the state between Friday and January 21. Aslam informed other
regions in the country will also be taking part in the campaign during this

Yangon: Rohingya Muslim insurgents said on
Saturday that ten Rohingya found in a mass grave in Myanmar’s troubled Rakhine
state last month were “innocent civilians”, and not members of their
group.Myanmar’s military said earlier this week its soldiers had killed 10
captured Muslim “terrorists” during insurgent attacks at the beginning of
September, after Buddhist villagers had forced the captured men into a grave
the villagers had dug.It was a rare acknowledgment of wrongdoing by the Myanmar
military during its operations in the western state of Rakhine.The Arakan
Rohingya Salvation Army (ARSA), whose raids against security posts starting
last August sparked sweeping military operations in the Muslim-majority
northern part of Rakhine, said it “whole-heartedly welcomes the admission” of
“war crimes” by the “Burmese terrorist army”.“We hereby declare that these ten
innocent Rohingya civilians found in the said mass grave in Inn Din Village
Tract were neither ARSA nor had any association with ARSA”, the group said in a

Johnson Public School in the Canadian city of Toronto when a man holding
scissors came from behind and started cutting her headscarf, the victim
said. The girl turned and screamed,
forcing the suspect to flee. But shortly after the first assault, the same man
returned and "continued cutting" Noman's headscarf while grinning,
before running away. "Sadly, someone insulted me by cutting my hijab two
times," Noman, who was not hurt in the incident, told reporters. "I

foreign intervention in Yemen details the extensive civilian casualties
inflicted by the Saudi-led coalition's air attacks. The United Nations panel

targets included a migrant boat, a night market, five residential buildings, a
motel, a vehicle and Govt forces,
