New Delhi: All India Muslim Personal Law Board (AIMPLB) on Tuesday told
the Supreme Court that triple talaq has been observed by Muslims for last 1400
years and questioned the Centre for calling the practice un-Islamic."Triple
talaq is there since 637. Who are we to say that this is un-Islamic. Muslims
are practicing it for last 1,400 years. It is a matter of faith. Hence, there
was no question of constitutional morality and equity," former Union law
minister and senior advocate Kapil Sibal, appearing for AIMPLB, said.The Muslim
body also equated triple talaq with the Hindu belief that Ram was born at
Ayodhya. "If I have faith that Lord Rama was born at Ayodhya, then it's a
matter of faith and there is no question of constitutional morality,"
Sibal told a 5-judge Constitution bench headed by Chief Justice JS Khehar."Muslim
marriage is a contract through nikahnama between consenting adults and so is
divorce. If both marriage and divorce are contracts, why should others have a
problem," the AIMPLB asked.Sibal also referred to the fact that the source
of triple talaq can be found in Hadith and that it came into being after the
time of Prophet Muhammad.Responding to the Centre's stand that it will enact a
law on Muslim divorce if the SC quashed talaq in all forms, Sibal asked what
will happen if the SC quashed the practice and then Parliament refused. Today
is the fourth day of the hearing in the case as TOI reported. New Delhi: According
to NDTV, senior advocate Kapil Sibal said today said, triple talaq is undesirable and Muslims
know it, but they should be allowed to get rid of it on their own. Work is on
to discourage the practice and outsiders "should not interfere", he
told the Supreme Court. Triple talaq is something that should not remain
permanent, Sibal said. "We don't want someone to tell us that it is bad.
It is for the community to get rid of... Nobody should interfere in the
matter," he added. The Constitution bench asked why the community is not
taking any steps to eradicate the practice. "We are trying to educate
people and working on it advising them not to resort to this," replied Siba.
According the Hindu, yesterday, beginning
his arguments for AIMPLB, senior advocate Kapil Sibal said the root cause for
the inequality suffered by Muslim women is not triple talaq but the patriarchy
found dominant in society.“But all societies, be it Hindu or Christian, are
patriarchal. In a Hindu family, a father can gift his property outside his
family. In Muslim law, this cannot be done,”Sibal said. According to Deccan Chronicle,
Kapil Sibal argued, Hindu law of divorce and succession are more discriminatory
than triple talaq which has the sanctity of Muslim personal law. Sibal said
women seeking divorce under the Hindu law are waiting for years in courts to
get divorce. “Is this not discrimination,” counsel asked. Similarly under Hindu
succession law, a father may deny property to the daughter and give it to his
son, he said. Sibal said this kind of discrimination is not possible in Muslim
law as everyone gets a share. He opened his submissions saying, “Nothing is
permanent, when the time comes the nation will decide.” “Personal laws continue
to remain personal in the Constitution. A time will come when the different
societies decide that they need to encapsulate their laws into a Uniform Civil
Code,” he said. “At least till such time, we should preserve the individual
customs and usages of pluralistic societies. They have to be equally
protected,” Sibal submitted.He said the Hindu Marriage Act still protects
religious customs and usages. “There is even existence of polyandry. Situation is
highly complex and cannot be easily resolved.Over a 160 million people are

New Delhi: Law Commission Chairman Justice BS Chauhan told News18 that
the proposed draft on Uniform Civil Code will not be prepared till the apex
court delivers its verdict in the case, which is expected in July. Justice
Chauhan said the Commission will wait for the Supreme Court verdict as it is
likely to observations which will be binding for all.“Court is asking a lot of
questions to understand the issue and we think the court is making
observations. The court will be discussing concept of religion, personal law,
and also the difference between religious faith and religious practice. Essentially,
what they are and how to determine them. I hope the judgment comes by July as
the CJI will retire in August,” said the Law Commission Chairman. Justice
Chauhan said there were multiple issues which require clarification by the apex
court. “SC will have to now determine what personal law is. Personal law was
first interpreted as Hindu law and not Muslim law. If you see Article 25, there
are words which are tricky like public order, health and morality. Now this
article has to be read subject to Article 21 and that is why we have kept quiet
and want to see the SC verdict on this,” he said. On a hypothetical question
around UCC’s role assuming a situation where the court strikes down Triple
Talaq and upholds Talaq-e-Hasan or Talaq-e-Ahsan, Justice Chauhan said, “UCC
includes right to succession, inheritance, property and other aspects…marriage
and divorce may be a part of it.”“Suppose SC comes to the conclusion that
Triple Talaq is a practice and it is not essential to the religion then UCC can
include divorce. There are also people who believe that Triple Talaq and other 2
(forms of talaq) are unconstitutional,” said Justice Chauhan.When asked about
his personal views on the subject, Justice Chauhan said the practice of instant
divorce needs to change. “Polygamy is not a big issue among Muslims as the
percentage is very less among them. It’s difficult to sustain a single wife
now, who would take care of two. The problem is with instantaneous divorce and
the court is looking into. It’s a very absurd thing for the wife and children.
There was a recent instance when the wife did not have milk to feed the child
and when she had asked the husband for some money, he pronounced Triple Talaq.
Now this is something which needs to change,” said Justice Chauhan.Justice
Chauhan said UCC will indeed be a herculean task as there is immense diversity
in the country with regards to the norms being followed and practiced. “North
East still has murder trials which are conducted by Panchayats. Judiciary has
not been separated there. Criminal procedure code does not apply in the North
East. It only applies in Shillong, and that too in 4 wards and not the entire

pronounced just once but becomes effective only after a period of 3 months, at
any time during which the husband can revoke the talaq) and talaq-e-hasan, a
staggered divorce with 3 pronouncements of the talaq, also revocable at any

fundamental right. This would be nothing but an enforced civil code, an attempt

self-help group (SHG) function here today when the crowd shouted slogans
against her and even flung chairs in the air. Mehbooba, who was hastily
escorted out of the venue by her security, sought to downplay the incident and
told reporters that her Govt was trying
to help the women and she would continue her efforts in this regard.The chaos
had begun early in the morning when some of the women — mostly from south
Kashmir which has seen an upsurge in violence since July last year — raised
‘azaadi’ slogans outside the SKICC convention centre where the event was being
held.The women were whisked away before the chief guest arrived but that was
not the end of the trouble. The anger was evident when Mehbooba reached the
venue where thousands of women from various self-help groups had gathered, an
official said. The function had been organised by Rural Development

Kashmiri man joins militants, he was ‘victimised’ under security law
Srinagar: A 23-year-old man from Shopian, who escaped from police
custody earlier this month, has released a video saying he has joined the
militant ranks and that “tyranny’ and “illegal detention” led him to become an
insurgent.District police authorities confirmed Zubair Ahmad Turray escaped
from Keegam police station in Shopian on May 1 but did not take any weapon with
him. Residents of the town called for a shutdown for three consecutive days
last week to protest his disappearance. “We had information that he (Zubair)
has joined militants after escaping from prison. It got confirmed by his
video,” director general of police, SP Vaid, said.In the video, which surfaced
on social media, Turray is seen in a military uniform with a cap and 2 rifles
and 2 grenades can be seen on a table in front of him.Turray begins his message
with Quranic verses and says he is a “victimised” Kashmiri who escaped from a
jail a few days earlier. He goes on to explain how “slavery” and the
“imperialist forces” had led him to become a militant.“My journey has been very
painful…I had no other way,” Turray says in the video.He says he was in jail
for the last 4 years and was charged under the controversial “PSA” 4 times. He
was referring to the J&K Public Safety Act (PSA), 1978 that allows the
state to detain a person without trial for at least 6 months. Activists say it
is ‘draconian’ and rights body Amnesty International has termed it a ‘lawless
law’.Turray says that even though his last PSA case was quashed by the high
court, he was placed under illegal detention for 3 months, following which he
escaped.Habeel Iqbal, a lawyer who is Turray’s counsel in 3 cases currently in
Shopian court, said in Feb.a PSA order on Turray was quashed and he was told by
the police to report to the counter-insurgency wing of the police in Srinagar.
He reported to the wing after 2 days of being set free from the prison, only to

New Delhi: Amid the unrest in Kashmir, the RSS will hold its annual
review meeting for the first time in Jammu in July, looking to send out a
message to separatists that the valley is an integral part of the country. RSS
chief Mohan Bhagwat, BJP president Amit Shah and leaders from VHP will attend
the three-day meeting which is scheduled from July 18-20, sources in the Sangh
said. “The time and place of meeting was decided to send out a clear message to
separatists in the Kashmir valley that the region is integral part of India and
the Sangh is committed to its unity,” they added.The sources also indicated
that incidents of stone-pelting and the attack on CRPF jawans could come up for

Denied haircuts by upper-caste diktat for decades, Valmikis at Sambhal
village threaten to convert to Islam
Sambhal: Fed up after decades of being denied haircuts at their own
village due to an upper-caste diktat, Valmikis at a Sambhal village have
threatened to convert to Islam, citing the recent agitation by Dalit leaders
over oppression in UP . At Fatehpur Shamsoi village under Bhajoie police
station here, there are about 15,000 Thakurs and Brahmins,and about 1,250
Valmikis in 250 families. For decades since Independence, Valmikis have
allegedly not been allowed to get haircuts or shaves from the village barbers,
because upper castes declared that if the Dalits were given haircuts, the upper
castes would not get haircuts from the 'impure' implements.A month ago, a
Muslim barber agreed to give haircuts to a Valmiki family. Facing alleged upper
caste pressure, when the family later turned up for a shave, he refused. This
has snowballed into a major agitation, with all the Valmikis of the village now
threatening to convert to Islam, following the path of national president of
Valmiki Dharm Samaj, Lalla Babu Dravid, who had recently announced that the
community would convert in the face of atrocities."A month ago my cousins,
Anil, Bhura and Birjesh Valmiki had got haircuts at Asif Ali's barbershop. Some
days later, when they turned up for a shave, Asif refused. He had been beaten
up by upper caste villagers because he broke the rule," said Saurabh
Valmiki, 21, a villager."The other barbers (the village has five) also
refused to give us haircuts or shaves in fear. We filed a police complaint
against them. When the police reached the village, all the barbers had shut
shop and fled," Saurabh added.Over the decades, Valmiki men have had to
travel 15 to 20 km to towns like Chandausi, Bhajoie and Islamnagar to get
haircuts."The barbers, under pressure from upper caste communities here,
refused to give haircuts to Valmikis. The barbershops have been shut ever
since," said village pradhan Chotay Lal Diwakar. On Monday afternoon,
national president of Valmiki Dharm Samaj, Lalla Babu Dravid, along with other
community leaders reached Fatehpur Shamsoi and called a panchayat . Ex- village
pradhan Sanjeev Sharma and Bhajoie SHO Ranjan Sharma were also present. Dravid
gave a 24-hour ultimatum to the upper castes in the village to reserve the
diktat, or the community would leave the Hindu fold."It is because of such
atrocities that the Valmiki community here has decided that if it is not
resolved, they will convert to Islam. The decision is now with the upper

Muslim exodus in UP: 33 more families flee Sambhal village
Sambhal:Another 33 Muslim families have left Nandrauli village here in
the days following an attack on the houses of some Muslim families on May 11,
in the aftermath of the elopement of an inter-faith couple. Shortly after the
violence, 10 Muslim families, including that of the youth who had eloped with a
married Hindu woman, had fled. In the days since, 33 more families have packed
up and left, rejecting appeals from various people including, the local MP, to
stay back. The families who fled are now living in Badaun, Sambhal and Aligarh.
Mohammad Shakeel, a schoolteacher whose family was attacked during the violence
and who now lives in Gunnaur town of Sambhal, told TOI, "We have lost
faith in the police and administration. My entire house was ransacked by the
assailants and my sons and daughters were assaulted."Another village
resident, Nafees Ahamed, 55, who has now shifted to Aligarh, said,"My
children still have disturbed sleep. The memories of those horrible attacks
haunt us. We were beaten up and threatened for hours."Gunnaur SDM Akhilesh
Yadav said, "We have appealed to the families not to leave the village and
assured them of the round-the-clock security. The administration is also
providing food to families still inside the village.""We have asked
the officials to prepare a list of all those who have left the village and
settled in other places. We will make an appeal to them to come back to their
houses and will take the responsibility of their security," SDM said. Nandrauli
village, under Gunnaur police station 60 km from here, saw Muslim houses
looted, ransacked, demolished and set on fire after a Muslim youth and a
married Hindu woman who were having an affair fled on May 8. After the violence
on May 9-10, 10 Muslim families, a total of 55 people have fled the village.
Those still around are also on the verge of leaving and narrated tales of
horror. Police have filed FIRs against hundreds of villagers. "Muslims
comprise 10% of the total population of the village, around 350 out of 3,500.
For two successive nights, I heard the cries of women and children when they were
attacked, molested and beaten up. They were even attacked in the presence of
police and PAC personnel, who did not intervene. Neither did the
administration," village pradhan Pramod Kumar Yadav had said. timesofindia
HC notifies AG:Seeks disqualification of Adityanath as CM
The Allahabad High Court today issued a notice to Attorney General of
India on a petition seeking disqualification of CM Yogi Adityanath and his deputy, Keshav Prasad
Maurya, from their respective posts.
Lucknow bench of the high court has set the matter for next hearing on
May 24. A division bench comprising justices Sudhir Agrawal and Virendra Kumar
passed the order on the Public Interest Litigation petition filed by Sanjai
Sharma.Petitioner pleaded that a parliamentarian cannot not become the minister
of a state Govt and this is in violation
of article 101(2) of the Constitution of India and as such the appointment of
Adityanath as the CM and Maurya as the Deputy CM should be set aside, for both
are still continuing as MPs. The petitioner also sought that their Lok Sabha
seats be declared vacant. Sharma challenged the constitutionality of section
3(A) of the Prevention of Disqualification Act. Since the constitutionality of
a central act cannot be tested without hearing the Attorney General, the court

Installation of Hindu deity near grave leads to communal tension in
Alwar
Alwar:Tension prevailed at Scheme 3 family area near the Mazar (Grave)
of Syed Baba on Monday in Alwar when some people attempted to install an idol
of Lord Hanuman near the grave.However, intervening on time, the administration
did not allow such installation and ensured law and order. Police also spoke to
members of both communities and urged them to follow the pact in this regard
that took place between the communities a year ago.According to police, some
people were adamant to install an idol of Dashmukhi Hanumanji. However, when
they were not allowed to do so, Hindu outfits decided to organise a protest and
a Mahaarti (veneration) at Kotwali police station."Some people had also
given call for Bandh in Alwar city. However, we spoke to them and urged them to
ensure that law and order and communal harmony is maintained. Responding to it,
they have called back their protests," said a senior police officer.
Tension erupted when people of Muslim community were irked after seeing an idol
of Lord Hanuman and complained about it to ADM, city, Mahendra
Meena."While police approached the spot, large number of people from both
communities gathered. Some people also informed that the matter was settled in
writing a year ago and still some people are attempting to disturb peace and
communal harmony," said an officer. Police invited members of both
communities and urged them to maintain the written pact in this regard as

HC transfers missing JNU student Najeeb’s case to CBI
New Delhi: Delhi High Court on Tuesday transferred the investigation
into the disappearance of JNU student Najeeb Ahmad, missing since last October,
to CBI from the police with immediate effect.A bench of Justices GS Sistani and
Rekha Palli transferred the matter to the CBI on a plea by the student’s mother
after the Delhi Police said it has no problem with such a direction. The court
said the probe by the CBI would be supervised by an officer, not less than the
rank of a DIG. While transferring the matter, the court noted that the Delhi
Police had implemented all directions and suggestions given by the court. The
matter will be taken up next on July 17. The student had gone missing a day
after an altercation with some ABVP students on the night of Oct.14, 2016.The
court was hearing a plea by Najeeb’s mother, Fatima Nafees, seeking the
whereabouts about her son who went missing from the JNU campus and is yet to be
traced.Now she is seeking dismantling of the SIT and setting up of an independent

Batla House encounter case: Court drops charges against L-18 flat
caretaker Abdul Rehman
New Delhi: Abdul Rehman, caretaker of the Batla House where two suspects
of Delhi serial blasts were killed in a police encounter in 2008, was on
Tuesday discharged in a case by a Delhi local court. His counsel advocate MS
Khan informed TOI about the development. Rehman was arrested on Sept.21, 2008,
for allegedly forging the lease agreement of L-18 flat in Batla House colony
near Jamia Nagar. Earlier his defense counsel MS Khan had argued that the
police had failed to recover the original rent agreement that was alleged to
have been forged. "In the FIR, the complainant has also admitted that he
had handed over the keys to the applicant to let out the flat on rental basis
to a good tenant. Once the keys were handed over what was the reason for him to
forge rent agreement," he had argued.TOI

Cuttack: Terror suspect Abdul Rehman was sent back to Tihar Central Jail
after being produced in the court of Judicial Magistrate, First Class(JMFC) at
Salepur here on Monday. Rehman (38), who was allegedly running a Madrasa at

Kolkata : Syed Noor ur Rahman Barkati, Islamic cleric from Kolkata who
recently threatened jihad in India, will be sacked as head of Kolkata’s Tipu
Sultan mosque.“He is a blot on our community,” Shahezada Anwar Ali Shah,head of
the mosque’s trustee board, said on Tuesday while confirming that Barkati’s
sacking will likely be announced on Wednesday evening. Barkati headed the
mosque for 28 years.He fell out of favour with Mamata Banerjee, one of his
strongest backers once, last week after he warned of a ‘jihad’ if India was
declared a Hindu state and also refused to take off the red beacon from his

Raids on Chidambaram, Lalu houses; Opposition cries vendetta

Bihar Muslim man kills minor daughter after wife marries another person
Katihar: An impoverished man in Bihar’s Katihar district, 304 km east of
Patna, allegedly strangled to death his 8-year-old daughter after being told
that his estranged wife had married another person.Police said the incident
took place at Laliyahi in Katihar town police station area on Monday.“Mohammad
Mustaque, 40, lost his cool when he came to know that his wife had married
another man in New Delhi. In a fit of anger, Mustaque started beating up his
daughter Suhani and finally strangled her to death,” town police station SHO
Anupam Kumar said.Mustaque, a daily wager, had been arrested and sent to jail
after his mother-in-law lodged a complaint with the police on Monday evening,
SHO said.Kumar said Mustaque’s wife Dukhni Khatun, 35, left for New Delhi with
a son and a daughter 5 months ago and had been living there with her sister
since then. Their 3 other children — one son and two daughters — were staying
at Katihar with Mustaque, he added. “Mustaque had been staying at the house of
his in-laws after his marriage about 20 years ago. With the small earning as a
daily wager, he was finding it difficult to support his family, resulting in

The US administration has accused the Syrian government of installing a
crematorium in a military prison in order to destroy the remains of thousands
of murdered prisoners.Stuart Jones, acting assistant secretary for the state department's
Bureau of Near Eastern Affairs, gave reporters satellite pictures apparently
showing snow melting on the roof of the facility."Beginning in 2013, the
Syrian regime modified a building within the Saydnaya complex to support what
we believe is a crematorium," he said, referring to a military jail north
of Damascus."Although the regime's many atrocities are well documented, we
believe that the building of a crematorium is an effort to cover up the extent

highly classified information about a planned ISIL operation, supplied by a US

intelligence on ISIL at risk, according to the Washington Post, which broke the
story on Monday.The White House reacted to the reports, but did not deny that

US secretary of state, and HR McMaster, US national security adviser, issued

A US-led coalition air strike on Monday killed 23
civilians in eastern province of Deir al-Zor, a Syrian town held by the Islamic
State group on the border with Iraq, a war monitoring group said.The
Britain-based Syrian Observatory for Human Rights said the strike on the town
of Albu Kamal hit around 3:00 am local time. They also said that jets thought
to belong to the US-led coalition hit the town of Al-Bukamal near the border
with Iraq. The warplanes struck near a residential area and a mosque, wounding
dozens more. Those killed in the strike were civilians displaced from other
areas controlled by IS, including Syria's Deir Ezzor and Raqa provinces, and
neighbouring Iraq. Islamic State-linked media outlet Amaq said coalition
strikes killed 15 people and wounded 35 others in Al-Bukamal. A spokesman for
the US-led coalition against Islamic State could not immediately be reached for

have been targeted in an organized manner by state forces in northern Rakhine
state during military operations since last Oct.“What is new about the material
contained in this report is that it documents, through photographs, testimony
and forensic analysis, physical evidence of attacks against civilians,” BROUK
said in its report. The report was based on more than two dozen interviews with
Rohingya refugees in the Cox’s Bazar region of Bangladesh, who fled the

Beijing:China appears to be laying the groundwork
for the mass collection of DNA samples from residents of a restive, largely
Muslim region that's been under a security crackdown, rights observers and
independent experts said today. Police in western China's Xinjiang region
confirmed that they are in the process of purchasing at least $8.7 million in
equipment to analyse DNA samples.Observers from Human Rights Watch said they've
seen evidence of almost $3 million in additional purchases related to DNA
testing. They warned such a collection programme could be used as a way for
authorities to beef up their political control.The move comes after Chinese
authorities in 2016 reportedly required Xinjiang residents to submit DNA
samples, fingerprints and voice records to obtain passports or travel abroad.If
used at full capacity, the new equipment could be used to profile up to 10,000
DNA samples a day and several million a year, said Yves Moreau, a computational
biologist specialising in genome analysis and DNA privacy at University of
