MP family court nullifies triple talaq for not following norms: PTI
Ujjain:A family court here has “nullified” the triple talaq given by a
man to his wife on the grounds that due procedure, as prescribed in Muslim
religious texts, was not followed in the matter. Additional principal judge of
the family court, Omprakash Sharma on March 9 observed that the procedure
adopted by Tousif Sheikh to divorce his wife was “illegal” and “ineffective”
and nullified the same. Arshi Khan got married to Tousif from Dewas on Jan. 19,
2013 and after some time he (Tousif) started demanding money from her. When his
demands were not fulfilled, he started troubling her, the victim’s lawyer
Arvind Gaud said.After some time the woman left her husband’s place and
returned to her parents’ home. She later filed a case under Anti-Dowry Act
against Tousif, said Gaud. That case is still pending in the court, he said.Meanwhile,
on Oct. 9, 2014, Tousif verbally divorced Arshi by stating talaq in Ujjain
court premises, where they had come in connection with some other case.Later,
he informed her through a notice that he had divorced her by stating talaq
thrice while coming out of the court premises on that date.Arshi challenged
divorce on the grounds that due procedure as prescribed in the Muslim religious
text was not followed in the matter, Gaud said. The court in its order found
discrepancies in it and said that Tousif had failed to mention in his reply
that through which method ‘Talaq Ahsan or Talaq Hasan’ he had divorced his
wife.The judge said that he failed to give credible evidence of the presence of
Arshi in the court premises as mentioned by him when he had pronounced talaq
thrice, while as per the religious law, the presence of the woman in question
is mandatory. The court also observed that no steps were taken by the parties
concerned for any mediation on the issue as per religious law. Court took into
account various decisions given by other courts on the issue before declaring
the talaq as “illegal”, “ineffective” and “nullified” it Tousif raised the
issue of jurisdiction of the family court on the matter but the judge turned
down his plea. A statement issued by Gaud and his assistant Hafiz Qureshi said
they highlighted provisions mentioned in various Muslim religious texts on the
issue to convince the court that due procedures were not followed in the

Though this is good, there are other women of the community whose husbands have
either met with an accident or been murdered. They have to run from pillar-to-post

wheels of justice have moved slowly in the case of her husband. "My
husband, Muneer, was killed under Pahadi Shareef police station limits. He was

to sit for hours. The police seem to be serious enough with talaq cases. But I
am yet to get justice. I am not satisfied with ongoing investigation. I want my
husband's killers hanged,'' says Karimunnisa, who has to fend for herself and

she was divorced in 2010 and was looking for a better job to provide for her

Talaq, marriage, inheritance & women rights; mulls news channel
Lucknow: To clear confusion over Sharia laws, All India Muslim Personal
Law Board (AIMPLB) has decided to tread the social media path and also explore
the possibility of starting a TV news channel and newspaper. The board has
decided to constitute a special social media committee, which will provide
clear information about various issues pertaining to divorce, marriage, halala,
warisana haq (inhertiance rights) and women’s rights among other issues. It
will also convey the board’s stand on these contentious issues.“Senior office
bearers along with a large section feel the medium through which Sharia laws
are being criticised, the same medium should be utilised to register our
presence and also to present the right picture of things,” AIMPLB senior
executive member Maulana Yasin Usmani said.He said in the executive meeting of
AIMPLB in Lucknow on April 15 and 16, the issue cropped up and it was decided
to form a social media committee.“For this, the board authorised its chairman
Maulana Rabe Hasan Nadwi and general secretary Maulana Wali Rahmani,” Usmani
said. “The committee is likely to be formed soon. It is quite possible that
office bearers of the board, who are active on the social media and have
in-depth knowledge about Sharia laws, may be included so that they can
immediately respond to queries on the social media and give their reaction.” Board
also discussed at its recent meeting the idea of starting a TV news channel and
newspaper, Usmani added.“Most of the office bearers in principle had agreed to
the idea. But, on the issue of non-availability of the required resources in
the current scenario, no decision was taken,” he said. “Keeping in mind the
present circumstances, the AIMPLB has to take some tangible steps in this

electronic media – has crossed all the levels of decency, the Indian Muslims
have really started to feel the heat. They see in it as a clear design to
malign and demonize Muslims and Islam.
Now they have decided that the best defense is a good offense. So for
the first time, prominent Muslim leaders and groups hit out at Prime Minister
Narendra Modi for preaching “justice” for Muslim women. They questioned his
moral right and authority to speak about Muslim women when he himself is ‘guilty’
of abandoning his wife and allowing crimes against Muslim women and stalking of
young women in Gujarat under his orders.Terming Modi’s new-found love for
Muslim women as “sheer hypocrisy”, Welfare Party of India President Dr S Q R
Ilyas told Caravan Daily that “a person who did not do justice to his wife for
the last 48 years and allowed sexual assaults on Muslim women during the 2002
riots in Gujarat has no moral right to speak about Muslim women or any other
women of the country”. “First Mr Modi used to deny that he is a married man and
now he himself has admitted his marital status by revealing his wife’s name.
What does then prevent him from bringing his estranged wife to his home

deprived Jashodaben’s rights of a wife,
but also rights of a citizen as she did not get a passport to visit her family
members abroad. In 2015, Jashodaben had
applied for a passport but her application was rejected because she failed to
produce marriage certificate or a joint affidavit with the spouse which is
mandatory for getting a passport.Echoing his views, Maulana Khalid Saifullah
Rahmani, Secretary, All India Muslim Personal Law Board, said that the PM’s
sudden concern for Muslim women is a pretense and reflects his sheer duplicity
on the subject.Speaking to Caravan Daily, Maulana Rahmani asked: “Where was he
when Muslim women were being raped and pregnant women’s womb were being ripped
apart with swords and tridents under his watchful eyes during the Gujarat
pogrom of 2002?”The survey conducted by Bharatiya Muslim Mahila Andolan (BMMA)
claimed the divorce rate among Muslims to be as high as 11% as opposed to the
Census. However, when this scribe contested survey findings with the BBMA
founder member Zakia Soman, her only explanation was that divorced Muslim women
did not reveal their status to Census enumerators.Furthermore, a random sample
survey done by the Muslim Mahila Research Kendra (MMRK) contradicts BBMA’s
claims. Dr. Asma Zehra, who is also a member of the AIMPLB, said MMRK collected
data through RTI applications in family courts in Muslim concentration
districts that showed the prevalence of divorce among minority community to be
lower than Hindus, contrary to the perception that is sought to be made about
his community being a perpetually divorcing lot. A random survey of 13,000 women across the
country showed 100 cases of divorce, of which a dozen were through instant
triple talaq.Dr. Ilyas said it is a clear-cut case of making a non-issue as a
very serious matter while Muslim women feel safer and secure than Hindu women

Vadodara: AT A time when BJP-led Central govt has been raising the issue
of triple talaq in the Muslim community, the Girls Islamic Organisation, a
woman’s wing of the Jamaat-e-Islami-e-Hind, has launched a state-wide campaign
in Gujarat to raise awareness among the Muslim community on Muslim Personal
Laws, as well as started initiatives to “clear misconceptions” harboured by
other communities, regarding the important issues pertaining to talaq and
marriages. On Saturday, members of GIO— Fatima Tanveer and Razia Shaikh—arrived
in Vadodara to kick off the campaign, which will continue until May 7.
Addressing the issue of triple talaq and marriages in Islam, Tanveer said, “We
are planning to undertake mohalla meetings, public gatherings, table top
discussions as well as door-to-door campaign to educate the Muslim community
members about the issues of personal laws, so that they do not get swayed by
the misconceptions that are being promoted these days such as triple talaq and
polygamy.” Tanveer blamed the ongoing campaign against triple talaq as a
“conspiracy” to influence Muslims who are unaware of the personal laws. Speaking
about Muslim women, who have reportedly supported Narendra Modi in public on
his stand on triple talaq, Tanveer said, “We do not know if these women are
really Muslim or not. Islam is a religion that does not believe in coercion.
Anyone who wants to follow the tenets based on the commandments of Allah, is
free to do so. None of us has the right to alter these tenets.”Tanveer added
that Shariah law is sacrosanct and cannot be altered and said that the notion

Lucknow: UP govt has taken note of the demand from Muslim organisations
campaigning against triple talaq to use Waqf property for creating shelter
homes for women who have suffered because of the controversial practice. All
India Women Muslim Personal Law Board chairperson Shaista Amber had given a
proposal to state minister for women and child department Rita Bahuguna Joshi
earlier this week that shelter homes for women should be constructed on Waqf
properties. While confirming this, Joshi, however, said it was yet to be
discussed properly."UP government is already running shelter homes,"
she said. "We believe in `sabka saath sabka vikas' and the approach would
be to look for a solution that benefits all women in need," she added.It

Coimbatore:Muslims are not questioned for their crimes because of vote
bank politics, said Tripura governor Tathagata Roy at a university event here
on Saturday. Roy was addressing on furthering the role of women in Indian
polity, and said that traditions like parda (veil), polygamy and triple talaq
have suppressed women in the country.Roy said that the reason we do not find
enough women making inroads in politics is because of the suppression by the
society. "Nobody questions about these traditions because it will affect
their vote bank. Most of these traditions are followed by Muslims," said
Roy. "Recently some steps have been undertaken to create an atmosphere
where Muslim women are made aware of their rights, and they are beginning to
come out and speak for themselves," he added.Roy said that he is not
against the Muslim community. "I respect Muslims and their religion is as
much important as the Hindu, Christian or any other religion," he said.
Quoting examples of some Muslim women who have spoken for their rights, he
spoke about famous Bangladesh author, Tasleema Nasrin, a Syria-born

deals including procurement of an air defence system for the Indian Navy are
likely to be sealed during PM Narendra Modi's upcoming visit to Israel which
will be first by an Indian Prime Minister to the Jewish nation.Ahead of the
visit, which is likely to take place in July, Israeli envoy Daniel Carmon said
it will be a "big" visit, reflecting the depth of cooperation between
the two countries in a range of key areas.The much-awaited deal for Barak-8 air

missiles for the Indian Army are expected to be firmed up during PM Modi's

Washington/New Delhi: Leading NGO Amnesty International is lobbying with
the United States’ lawmakers to advocate for “protection of human rights
defenders” in India among other countries, as also to seek “political pressure”
on the American companies responsible for the Bhopal gas tragedy.It also wants
the top leaders of the US and India to demonstrate “the importance of making
the respect and protection of human rights an integral part of a just society.”In
its latest quarterly lobbying disclosure report filed with US Senate last week,
Amnesty International has listed “protection of human rights defenders” in
India and several other countries among the “specific lobbying issues” for the
quarter ended March 31.There are several other issues listed in the report,
including the issues related to the Trump administration, on which it has
lobbied with the Senate as well as various government departments in the US
during this period. While the lobbying report did not further explain the
India-related lobbying issues, the global rights group told PTI, in reply to
specific queries, that it raises human rights issues around the world at
various levels of government to supplement its “research, campaigning and
mobilisation to highlight various human rights issues and seek accountability.”An
analysis of previous disclosure reports filed by Amnesty shows that it has been
lobbying on India-related issues in the past also, while in the year 2014 ahead
of Prime Minister Narendra Modi’s visit to the US, one of the “specific issues”
included that visit itself.Under the US laws, all entities engaging in lobbying
activities with the lawmakers and the government departments need to file a
‘lobbying disclosure report’ on a quarterly basis, listing out the lobby
issues, the departments and offices approached and the costs involved.Incidentally,

A senior journalist who encountered the victims at the metro station
questioned why the policemen at the scene did not intervene on behalf of the
victims. 3 men transporting buffaloes in a truck were allegedly beaten up by
vigilantes near Kalkaji metro station in south Delhi late Saturday night.
Senior journalist Hartosh Singh Bal, who witnessed the incident, said he even
spoke to the alleged perpetrators of the crime who were all “sporting saffron
tilaks” and they admitted to beating up the men, who were all Muslims. Bal, who
first tweeted about the incident at 1:50am, kept providing regular updates
through his Twitter account. He said he first saw the victims “lying by [the]
roadside”. Alleging collusion with the police, Bal wrote that the accused, who
beat up the cattle transporters, “were all milling at the spot when police came,”
but not one of them was picked up by the cops.The Quint originally reported the
story, saying the attack took place around 11:45 pm on Saturday night when
Ashu, Rizwan and Kamil were accosted while on their way to Ghazipur with a
truck containing cattle.According to NDTV, a local police officer said the

People for Animals has been working against animal cruelty in Delhi for a long

been arrested and were sent to be kept in the lockup at the Sadar police

Ayodhya: In the first indication
that Uttar Pradesh chief minister Yogi Adityanath’s support for the speedy construction
of a Ram temple at the disputed Babri Masjid site is leading to policy changes
on the ground, the district administration has violated a long-standing order
of the Supreme Court by allowing a sadhu armed with a trishul, or trident, to
enter the the makeshift Ram Lalla shrine where the Babri Masjid once stood.On
Saturday afternoon, VHP leader Ram Vilas Vedanti along with senior Hindu cleric
Abhay Chaitanya – who was armed with a trishul – entered the shrine in violation of the Supreme Court’s 2002
order that the status quo be maintained and that “no religious activity of any
kind by anyone either symbolic or actual including bhumipuja or shila puja,
shall be permitted or allowed to take place.”Speaking to The Wire, Anil Kumar,
additional district magistrate (law and order) of Faizabad district, said,
“Yes, we allowed the sadhu with t a trishul to enter the premises because the
trishul was his religious symbol and such kind of religious symbols are
allowed.”Kumar’s reasoning was countered by the Muslim petitioners in the case,
who say there is no ambiguity in the Supreme Court’s instructions.“In March
2002 , a Supreme Court bench in the case of Aslam Bhure Vs Union of India
banned all types of symbolic religious activities at the disputed site. Now that
the Faizabad administration had allowed a person in with his religious symbol –
and the symbol is a weapon – the Supreme Court’s order has been violated”, said
Khaliq Ahmad Khan, a party from the Muslim side in the Babri Masjid/Ram
Janmabhoomi case before the Supreme Court.“The SC in its previous order of
maintaining status quo at the disputed site had said that the status quo
of Jan.7, 1992 will be maintained at the
disputed shrine, and on that date only one priest was allowed to offer worship
to deity, so no further clarifications of religious symbols are needed and what
happened at the Babri site is an open violation of Supreme Court’s two order in
this sensitive issue”, Khan added. “By allowing a sadhu armed with a trishul
inside the disputed premises, the district administration has breached existing security norms which
are in the knowledge of the SC,” Haji Mahboob, another party in the case, told
The Wire. “Under these norms, even pens, paper, wallets, bags, watches and
anything besides the clothes on the devotee’s body are banned. So does the
Faizabad administration have an approved list of religious symbols which they
have allowed?,” he asked. ” Mahboob said he has spoken to the Faizabad
commissioner and district magistrate and registered his objection over the

said, "Muslims have realised that since Allah himself has not allowed the
mosque to come up there, it's unlikely that it will ever come
up."Questioning the legitimacy of the Babri Masjid, Kumar said that the
15th century structure was named after an individual (Babur) and so it could
never be used by Muslims as they only worshiped one God."The land is
disputed and it was claimed after destroying a Ram temple that existed there,
thus Allah never accepted the structure and even namaz was never conducted at
the place. Today, Muslims have realized that it was an illegal structure,"

on a mistake by Babur, the founder of the Mughal dynasty in the

an epitome of a “good Hindu”. The revolutionary-poet’s “nationalism”, which the
Sangh says is reflected in his opposition to the British imperial rule in India
and his efforts at uniting Hindus and Muslims, has earned him the epithet.To
honour the poet-laureate, the Sangh is planning to mark his birth anniversary
on May 25 in West Bengal. It will also translate Nazrul’s works into all Indian
languages. A Hindi translation of 39-poems by him is expected to hit the stands

activists brought a prayer service at a church in Dathauli area of Maharajganj
district to a halt, alleging that the pastor was converting Hindus to

AIUDF chief Badruddin Ajmal to challenge Assam's draft population policy
in Supreme Court
Guwahati: AIUDF chief Badruddin Ajmal said that he is thinking of
approaching the Supreme Court against the two-child norms for government jobs
proposed in the Assam government's draft population policy. "The draft
policy is against the fundamental rights. The government should have focused
more on improving education and health facilities in backward areas where the
population is high. We will challenge it in the Supreme Court if the population
policy is finalized," Ajmal said here on Saturday.Ajmal termed the draft
population policy as against Muslims and other marginalized communities of the
state.While the draft policy stated candidates having more than 2 children will
be made illegible for government jobs, it also suggested the government to
legislate legal mechanism to bar people from being elected or nominated to

Chennai: Calling A lower court order the “worst judgment”, the Madras
High Court on Saturday acquitted five people in a 2010 temple burglary case and
said that it is ridiculous on the part of trial court to conclude that the
accused had committed murder and robbery because they belong to a particular
community. In July 2015, a sessions judge in Kancheepuram had given life
imprisonment to the five. The court ruled that they are from a particular
criminal community whose main occupation is stealing and dacoity.Acquitting all
convicts, HC bench of Justices S Nagamuthu and N Seshasayee said, “In our
little experience, we have not come across this kind of worst judgment. Let
this be the last judgment ever written on communal considerations.” The bench
also observed, “Judiciary cannot afford to decide cases by tracing criminal
activities of the forefathers of the accused. No court of law can stigmatise a
community as a whole.”Stating that this is a classic example on how a court
should not pen a judgment, the court directed the HC registrar’s office to

New Delhi: The Supreme Court has set a benchmark for maintenance to be
paid by a husband to his estranged wife, stating that 25% of his net salary
might constitute a "just and proper" amount as alimony.A bench of
Justices R Banumathi and MM Santanagoudar made the observation while directing
a resident of West Bengal's Hoogly, earning Rs 95,527 a month, to set aside Rs 20,000
as maintenance for his former wife and their son, turning down the man's plea
that the amount was excessive. The court said the amount of maintenance or
permanent alimony must be sufficient to ensure that a woman lived with dignity
after separating from her husband.Its order came on the man's plea challenging
a Calcutta high court order directing him to pay her Rs 23,000 per month.
Though the apex court said there was nothing amiss in the high court order, it
reduced the amount by Rs 3,000 on the ground that the man had remarried and
hence needed to provide for his new family."25 per cent of the husband's
net salary would be just and proper to be awarded as maintenance to the
(former) wife. The amount of permanent alimony awarded to her must be befitting
the status of the parties and the capacity of the spouse to pay maintenance,
which is always dependant on the factual situation of the case... and the court
would be justified in moulding the claim for maintenance passed on various
factors," the bench said."A Hindu woman's right to maintenance is a
personal obligation so far as the husband is concerned, and it is his duty to
maintain her even if he has no property.... It is well settled that under the
