SC quashes HC order
asking Govt to pay compensation to repair Mosques, shrines damaged in Gujarat
2002 riots
New Delhi: The
Supreme Court today set aside Gujarat High Court’s 2012 verdict asking the
state Govt to grant compensation for restoration of religious places damaged
during the 2002 post-Godhra riots. The court accepted the scheme formulated by
the state Govt to provide "ex gratia assistance" of up to Rs 50,000
to all religious places, including mosques and temples, which were damaged or
destroyed during the communal riots, on par with the relief granted for
destruction of houses.A bench of Chief Justice Dipak Misra and Justice Prafulla
C Pant referred to apex court verdicts and Article 27 of the Constitution
(freedom as to payment of taxes for promotion of a particular religion) and
said that substantial part of tax payers money cannot be granted for repairing
religious structures."The said scheme has to be appreciated on the anvil
of the directions issued in the Prafull Goradia and Archbishop Raphael Cheenath
SVDcases (earlier judgements). "In the first case, the 2-judge bench has
opined that object of Article 27 is to maintain secularism and the said Article
would be violated if the substantial part of entire income tax collected in
India, or a substantial part of the entire central excise or the customs duties
or sales tax, or a substantial part of any other tax collected in India, were
to be utilised for promotion or maintenance of any particular religion or
religious denomination...,"CJI Misra, writing the order,said. Gujarat Govt,
in its scheme, had proposed to pay ex-gratia assistance of Rs 50,000 for repair
of damaged religious structures on the lines of its policy to pay for the
houses damaged during riots and put certain conditions like such temples or
mosques should not be unauthorised ones.The policy also said that no ex-gratia
assistance would be sanctioned to religious places, located in the middle of
the public road or at any unauthorised place, and there should be a prior FIR
with regard to the damages caused."Person/persons claiming such ex-gratia
assistance shall have to satisfy the District Collector of the District in
which such religious place is situated about the ownership and/or
administration rights of religious places concerned so as to ensure that any
person unconnected with a religious place may not claim and receive ex-gratia
financial assistance under the Scheme. The decision of the District Collector
in this behalf shall be final," the policy said.Approving the Govts
scheme, bench said, "we have noticed that the Govt has fixed the maximum
amount under the caption of ex-gratia assistance and also conferred the power
on the District Collector of the Districts where religious places are situated
to determine about the ownership or administration rights of religious places
concerned.Setting aside the HC verdict,the SC asked the claimants to approach
authorities within 8 weeks and directed that "the authorities shall
determine the same within three months from the receipt of the claims."The
SC dealt with various aspects and judgements and said, "we find the case
hinges on its own facts regarding grant of compensation. The power of the court
of judicial review to grant compensation in public law is limited. There cannot
be any quarrel about the said proposition of law." It referred to Article
27 which said that no person shall be compelled to pay any taxes for
"promotion or maintenance of any particular religion or religious
denomination" and said that State cannot grant substantial part of
tax-payers money for such purposes. The State is obliged under the Constitution
to "treat persons belonging to all faiths and religions with equality. The
individual has his freedom to practice the religion as he desires and it is
totally immaterial from the perspective of the State," it said, adding
"the protection of property and places of worship is an essential part of
secularism."However, the SC agreed to the contention that the State cannot
be commanded to repair places of worships as this act "will create a dent
in the secular fabric and further the expenditure from the state exchequer is
impermissible in view of the language employed in the Article 27". State Govt,
represented by Additional Solicitor General Tushar Mehta, challenged the HC
verdict. HC, while dealing with the PIL filed by NGO Islamic Relief Committee
of Gujarat (IRCJ), had passed a slew of directions including the order asking
the state Govt "to give compensation in favour of the persons in charge of
all the religious places including those of worship, which were damaged during
the communal riot of the year 2002 for restoration to the original position, as
those existed on the date of destruction." Senior Advocates YH Muchhala
and Huzefa Ahmadi, appearing for the respondents, IRCG, contended, among other
things, that compensation was being appropriated in lieu of violation of human
rights and not for the promotion of any particular religion or religious

the forced castration of hundreds of devotees have come to light, all allegedly

controversial movie MSG: Messenger of God, a former member of the Dera accused
the spiritual guru of forcing around 400 men in his ashrams to undergo surgical
castration. In a chilling report in The Quint, Hansraj Chauhan describes the
ordeal he went through as a 19-year-old in the year 2000, when he was drugged
by a compounder with a glass of Pepsi a Dera Sacha Sauda hospital in Gurusar
Modiya in Rajasthan's Sri Ganganagar. He woke up two days later to find his
testicles wrapped in a bundle of bandages. Since then, he's not been able to
indulge in sexual activities for the past 17 years.His predicament, allegedly,
was shared by hundreds of other premis (or beloveds, as the male sadhus at the
Dera are called), who were spiked with drugs and forced to undergo such a
procedure in a bid to keep them celibate and pure. Castration, the men were
told, would allow them to get closer to god.CBI is currently looking into these

enforced by the moral police at the ashrams, the chief of the sect presumably
indulged his carnal desires, as the stories of several women being raped would

"historic" the All India Muslim Personal Law Board (AIMPLB) has said
it is a step forward in "constraining Govt al power to shield the
fundamental freedoms against legislative majorities". The board said the
ruling will "particularly help minorities, scheduled castes, scheduled
tribes and different sects that often face the trauma of legislative and
administrative action based upon majoritarian views"."Judges of the

students to educate Muslim men about 'correct way to divorce wife'
Agra:With the
Supreme Court holding triple talaq illigal, madrasas have begun preparations to
educate Muslim men on the "correct way to divorce their wives". Mufti
Muddasar Khan, who runs a madrasa in Agra, said they have a full chapter on the
correct way of going through a divorce and will ask students to educate others
about it.Syed Jamal, who runs a madrassa in Aligarh also said triple talaq was
wrong according to Sharia Islamic law. "We want to educate people on the
correct manner in which talaq can be effected," he said adding that they
would tell their students to spread the message. Maulana Noman Ahmed Azhari,
who is lecturer in Albarkat Islamic Research and Training Institute,Aligarh
said institute gives cultural and social training to students who come from
madrasa. He said that it is true that many people are not aware of the Sharia
law and practice it incorrectly. "We will not only train our students well
but would motivate them to teach the correct things to others also, as there is
an urgent need to end the wrong practices.At present, there are 200 madrassas,
including non-recognised ones in Aligarh and 150 in Agra.TOI

curriculum in madrassas: Dargah Ala Hazrat
Bareilly : To
educate Muslims about the practice of ‘talaq’ after recent Supreme Court ruling
on the matter, a leading Dargah of the Sunni sect has decided to include it in
the curriculum of madrassas. “There are many safeguards as per the Shariat
regarding talaq , but in a majority of cases they are overlooked and people
remain unaware of them…Now the right manner of practising ‘talaq’ as per the
sunnat will be taught to students of madrassas,” head of Darul Ifta Manzare
Islam of Dargah Ala Hazrat, Mufti Sayed Kafil Hashmi said. He said that the syllabus of madrassas linked to Dargah Ala Hazrat is
prepared in the light of the Quran and Hadis. This order will be issued to all
madrassas as also the ones run by Dargah Ala Hazrat, Hashmi stressed. Dargah
has also issued a helpline number for such cases, the Mufti said. Hashmi said that the Dargah Ala Hazrat has
also issued directives to the ulema all over the world to apprise the people of
the right way to practise talaq in their speeches at Urs and seminars. PTI

Kolkata: Terming
the Supreme Court verdict on triple talaq as "unconstitutional" and
an "attack" on Muslim personal law, West Bengal minister Siddiqullah
Chowdhury on Monday urged Muslims in the country to continue with the practice.
"We respect the Supreme Court and the CJI but the verdict to bar the
triple talaq practice is an attack on the century-old Muslim personal law. It
is unconstitutional," Chowdhury, who is also the Jamiat Ulema state
secretary, said at an event of the organisation's state wing. "Muslims
would keep following the order of Quran and Muslim personal law on the triple
talaq practice. We do not agree with the verdict of barring talaq for the next 6
months," he said. Claiming the Supreme Court's decision was not unanimous,

Court’s judgment on Triple Talaq is an open interference in the Shariat of the
Muslims. It is imperative on the part of the Govt. to negotiate with the Muslim
scholars in order to understand the meanings of the Quran and Hadith.Any person
who violates the Quran and the Hadith will no longer be a Muslim. A meeting of
the Muslim Ulema and lawyers was held at Sadaqath House, Malakpet on Sunday. It
was decided not to support the judgment of the Supreme Court which is
interference in the personal laws of the Muslims. During the time of Prophet
(PBUH) and the caliphs, the system of pronouncing divorce three times at one
sitting was not liked but divorce used to take place.Constitution of India has
given freedom to profess any religion and no one has any right to interfere in

issued notice to the Jharkhand Govt on
the reported deaths of 52 infants in 30 days at Jamshedpur’s Mahatma Gandhi
Memorial Medical College, an official statement said on Monday.Taking sou motu
cognizance of media reports, the Commission has observed that the “painful
deaths” of children and infants, in such a large number, are a matter of
concern.Commission said it has also learnt that the cause of the deaths is
reportedly malnutrition.Accordingly, the Commission has issued notice to

cash dealings above Rs. 2 Lakh
New Delhi: Income
Tax Department on Monday warned people against cash dealings of Rs. 2 lakh and
more, saying any violation of this cap will invite strict penalty under law.In
a public message, the department said "accepting Rs. 2 lakh or more in aggregate
from a single person in a day for one or more transactions relating to one
event or occasion is prohibited". "Similarly, receiving or repaying
Rs. 20,000 or more in cash for transfer of immovable property and paying more
than Rs.10,000 in cash relating to expenditure of business or profession is
also banned."Cash payment prohibited! Contravention may result in levy of
penalty! Go cashless. Go clean," the message stated.The tax department has
also asked the public to report such violations or those pertaining to black
money to their jurisdictional principal commissioner of I-T dept or email the

Satellite data
accessed by a rights body shows widespread fires burning in at least 10 areas
in Myanmar’s Rakhine state, following a military crackdown on the Muslim
Rohingya population. Residents and activists have have accused soldiers of
shooting indiscriminately at unarmed Rohingya men, women and children and
carrying out arson attacks. However, authorities in Myanmar say close to 100
people have been killed since Friday when armed men, reportedly from ARSA,
launched a pre-dawn raid on police outposts in the restive region.Myanmar
authorities say Rohingya "extremist terrorists" have been setting the
fires during fighting with Govt troops,
while Rohingya have blamed soldiers, who have been accused of carrying out
extrajudicial killings. A Govt spokesperson could not be immediately reached
for comment."Burmese Govt should
grant access to independent monitors to determine the sources of fires and assess
allegations of human rights violations," HRW saidon Tuesday.HRW said fires
have razed 100km of land - an area larger than that burned during a crackdown
by Myanmar military following attacks by Rohingya fighters in Oct.2016, when
data from the group suggested some 1,500 buildings were destroyed.The locations
of the fires correlate with some witness statements and media reports
describing blazes deliberately set, the group said."This new satellite
data should cause concern and prompt action by donors and UN agencies to urge Burmese
Govt to reveal the extent of ongoing destruction in Rakhine State,"Phil
Robertson, HRW's deputy Asia director, said ."Shuffling all the blame on
insurgents doesn’t spare Burmese Govt from its international obligations to
stop abuses and investigate alleged violations." UN believes army's

Rohingya crisis: UN
human rights official urges Myanmar to rein in security forces
Geneva:The top UN
human rights official called on authorities in Myanmar on Tuesday to ensure
that the security forces refrain from using disproportionate force against
Rohingya Muslims in Rakhine state. Zeid Ra’ad al-Hussein, UN High Commissioner
for Human Rights, condemned coordinated attacks by insurgents on security
forces last Friday, but said that the political leadership had a duty to
protect all civilians “without discrimination”. More than 8,700 Rohingya have
fled from Myanmar into Bangladesh since the attacks, Zeid said in a statement.
“This turn of events is deplorable. It was predicted and could have been

President Recep Tayyip Erdogan has urged the international community to step up
efforts to help Myanmar's Muslim Rohingya minority, saying the world was

has blown himself up at a bank in the Afghan capital, killing at least 5 people
and wounding several others, officials say.The bomber hit the entrance to a
Kabul Bank branch close to the US embassy and the city's main diplomatic
quarter, Najib Danish, an interior ministry spokesman, said on Tuesday.The
front side of the Kabul Bank was completely shattered and there was much damage
