Only Parliament can decide on
scrapping Art.370:SC
New Delhi: Days after the J&K High Court
observed that Article 370 is a “permanent” provision of the Constitution, the
Supreme Court Friday said that only Parliament can take a call on scrapping
Article 370 that accords special autonomous status to Jammu and
Kashmir.Refusing to entertain a PIL that wanted Article 370 removed from the
Constitution, a bench led by Chief Justice H L Dattu said that the court cannot
issue such directives. “Will it be done by the court or by Parliament? Can we
ask Parliament to delete a provision from the Constitution? It is not for this
court to do so,” observed the bench, also comprising Justice Amitava Roy.PIL
petitioner BP Yadav, a lawyer based in Andhra Pradesh, argued that the issue
required interference by the Supreme Court but the bench turned down his plea.
“We can strike down a provision if it is unconstitutional but we cannot be
asking Parliament to remove a provision. It has to be done by them(Parliament),”
said the bench as it asked Yadav to file a better petition if he intends to
pursue this matter any further.Noting that Article 35A protected the existing
laws of the state, the High Court said that J&K had retained limited
sovereignty while acceding to the Dominion of India, and did not merge with the
Dominion of India like the other princely states that signed the Instrument of

Ahmedabad: Gujarat High Court ordered removal of
Vadodara district govt pleader Raghuvir
Pandya over his record as a public prosecutor in the 2002 Best Bakery case.
Mere eligibility is not enough for selection as a district pleader, a chief law
officer in the district, but his or her credentials and "institutional
integrity" must be assessed, said Justice JB Pardiwala in his order.
Laxman Meghwani and two others had challenged Pandya's appointment in May. They
cited the Supreme Court order against Pandya which had termed him as unfit for
the post in view of his performance in the Best Bakery trial. "The public
prosecutor appeared to have acted as defence counsel," the apex court had

New Delhi: A group of academics and scholars on
Friday expressed their outrage and anger against the "assault on academic
and constitutional freedom", joining the recent protests by writers,
artistes, filmmakers, historians and scientists over "rising
intolerance". "We as social scientists, scholars, teachers and
concerned citizens, feel extremely concerned about the lynching at Dadri, and
the murders of scholars and thinkers like MM Kalburgi, Narendra Dabholkar,
Govind Pansare and others and wish to register our strong protest," a
statement signed by a group of 250 academics said. The scholars, including professors
from leading institutions like Delhi University, JNU, Madras Institute of
Development Studies, IIT Delhi and IIM Calcutta, expressed "shock" at
PM Narendra Modi's "late
response" to the incidents as also the "implications of the victim

Srinagar: Several people in south Kashmir are
coming forward to lay claim to the body of top Lashkar-e-Taiba commander Abu
Qasim and demand his burial at their respective villages.Police had to use
force after a group of people from Khandaypora village of Kulgam district on Friday
tried to exhume the Lashkar commander’s body who was buried in Bugam village of
the district.Qasim, a Pakistani national, was killed on Thursday after security
forces launched an operation in Khandaypora village following information about
his presence in the area. Some locals of Bugam opposed the exhumation by
Khandaypora villagers leading to verbal spar between the two groups. Some
locals of Bugam had agreed to the exhumation after the people of Khandaypora
argued that the militant commander had wished to be buried in their village
near grave of a local militant. Eyewitnesses said that police lobbed tear-smoke
smoke shells to prevent the people from exhuming the body, which resulted in
clashes between the people and police. Similarly, residents of Kakapora in
Pulwama had also claimed the militant’s body.Meanwhile, a family from
Khandaypora has claimed that the slain Laskhar operations chief was actually a
family member, Muhammad Yaqoob Hajam, who went missing when he was

Delhi:A new study on air pollution in Delhi by a
team of researchers led by University of Surrey in the United Kingdom has found
the city suffers from a “toxic blend of geography, growth, poor energy sources
and unfavourable weather that boosts its dangerously high levels of air
pollution”. The study also recommends all-round solutions instead of just
focusing on vehicular pollution. The study was recently published in the
journal Atmospheric Environment and includes a professor from IIT Delhi. The
team researched how Delhi’s landscape, weather, energy consumption culture, and
growing urban population combines to elevate concentrations of air pollutants,
including ultra-fine particles, the most harmful to human health.

mosque thwarted by the elderly
New Delhi: An empty liquor bottle was allegedly
thrown inside a North Delhi mosque during Friday prayers, causing tension.
However, restraint shown by the Namazis ensured that the situation remained
peaceful. Those present at Masjid Shahgul in Sadar Bazar at the time of the
incident said that there were a large number of devotees at that point of time
and an instant appeal for calm by the elderly managed to pacify those enraged.
The matter was reported to the police soon after. Recounting the incident,

and the Namazis had occupied their slots in three different floors including

Kaswa, prime accused in Petlawad blast, is alive and hopes to find out his
whereabouts with narco test of Manoj Gadia, a distant relative of
Kaswa."We have got few video footage of Kaswa. In one footage, which was
recorded after the blast, Kaswa was seen riding pillion on a two-wheeler and
Manoj Gadia in front seat," additional SP (SIT) Sima Alawa said. The
footage is of a CCTV installed close to Kaswa's house in Petlawad. The footage
shows Gadia is taking Kaswa from his house to some other place on his
bike.Alawa said they are sure that person riding as pillion on Gadia's bike was
Kaswa. "During interrogation, Gadia admitted someone was sitting on his
bike after the blast, but he claims to have not remembered, who was sitting

was on Friday convicted for killing Sitaram Yadav, a constable of
anti-terrorist squad of Madhya Pradesh Police, in Khandwa in Nov.2009.Police
said Faisal, Aijazuddin and Mohammed Aslam had shot dead the constable in the
communally sensitive Khandwa town in broad day light and minutes later also
killed two others, one for challenging them and another for snatching his bike.
Aijazuddin and Aslam were killed in an encounter in Telangana in April this
year.Faisal, who had hatched the conspiracy to kill Yadav, was also the
mastermind of the daring jailbreak in Khandwa after which 6 SIMI activists
escaped in Oct.2013. Faisal, who wanted for several cases, was caught two
months later, the police said.B S Bhadoriya, the special judge in Bhopal, is
likely to announce the quantum of punishment on Saturday. Mehtab, another SIMI
activist, was acquitted of the murder charge but convicted under the Arms Act,

Farooq Hafiz Mohammed Dhantiya, an accused in the Sabarmati Express train
carnage at Godhra. Acting on a tip-off, the local crime branch nabbed Dhantiya
from his residence in Signal Falia early in the morning. He was on the run ever
since the carnage took place on Feb.27, 2002. Sources said Dhantiya used to
frequently visit his house. It has come to light that Dhantiya was sleeping on
the upper floor when the police swooped on his house. An SIT team arrived at

'Missing' Russian airliner
with 224 passengers crashes in Egypt
Cairo: A
Russian airliner carrying 224 passengers and crew crashed in Egypt's Sinai
peninsula today, the Egyptian govt has
confirmed. The search and rescue team has found more than 100 bodies, including
those of five children, in the wreckage of the Russian aircraft, an officer at
the site told Reuters. "The plane split into two, a small part on the tail
end that burned and a larger part that crashed into a rock. We have extracted
at least 100 bodies and the rest are still inside," the officer
said.Egyptian search and rescue team members have also heard voices in a
section of a Russian plane, an officer, who requested anonymity, said.
"There is another section of the plane with passengers inside that the
rescue team is still trying to enter and we hope to find survivors especially
after hearing pained voices of people inside." he said. Most passengers on the flight are

authorities flooded the area along the border with Gaza with water to destroy
underground tunnels between Sinai and the Palestinian territory.Palestinian
source said that many tunnels were flooded with sea water in 6 areas in
southern Gaza.
Sunni preacher handed death
sentence in Iran

Supreme Court has approved the death sentence issued against the Sunni preacher
Shahram Ahmadi, Arabi21 has learnt from informed sources.Ahmadi, an Iranian
Sunni preacher, was sentenced to death after he was arrested in 2009 by the
Iranian intelligence forces.In July, the Supreme Court denied his sentence, but
he was re-tried in the same court by the same judge, and was sentenced to death
again. His lawyer informed him of the court’s decision on 15 Oct.and his case
was referred to the court that will carry out the execution. During his
imprisonment, Ahmadi was subject to various forms of severe physical and
psychological torture. He was initially sentenced to death in 2012 by the
Iranian Revolutionary Court during a hearing where his lawyer was prohibited
from attending.Ahmadi suffers from chronic illnesses, and he lost one of his
kidneys due to the suffering and torture exercised against him during his time
in prison. Despite this, the judicial authorities did not allow him to receive
treatment outside jail, even after a medical report was issued stating he
needed to be admitted to a hospital immediately.His younger brother, Bahram
Ahmadi, was executed in Ghezel Hesar on 27 Dec.2012. middleeastmonitor

include Muslims: Sri Lankan govt
Colombo: Sri Lankan Muslims will be an integral
part of the proposed truth, justice, reparations and non-recurrence process,
according to the country’s Foreign Minister Mangala Samaraweera.“Muslims’
grievances and concerns will be a part of the consultations, design and
operationalisation of the domestic mechanisms including Commission for Truth, Justice,
Reconciliation and Non-recurrence, the Judicial Mechanism, the Office of
Missing Persons and the Office of Reparations,” Samaraweera said at a function
held by the Sri Lanka Muslim Congress to mark 25th anniversary of Muslims’
